Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, December 9, 1981 Reel 96, Side 1, Tract I 781 -End; Side II, Tract 1 000-885 Chairman Rydell called the meeting to order at 7:40 p.m. in the Town Hall Council Chambers. A. ROLL CALL & PLEDGE OF ALLEGIANCE: Present: Chairman Rydell and Commissioners Carico, Lachenbruch, Stewart and vanTamelen Absent: Commissioners Dochnahl and Kuranoff Also Present: City Engineer/Planner John A. Carlson; Assistant Planner Pat Webb; Secretary Leslie Penfold Commissioner Lachenbruch arrived at 6:00 p.m. `. B. CONSFFT CALENDAR: Item Removed - 2a and 3a (Commissioner Stewart) MOTION SECONDED AND CARRIED: Moved by vanTamelen, seconded by Carico and passed unanimously to approve the balance of the Consent Calendar, specifically: 1. Approval of Minutes - October 28th & 29th, 1981 Commissioner Stewart removed items 2a and 3a for clarification of drainage problems. REPORT FROM CITY COUNCIL MEETINGS OF NOVEMBER 9th and 18th, 1981: Commissioner Stewart and Mr. Carlson reported the City Council approved the `r widening of Edith Avenue Bridge and Fremont Road Twisters and that the Public Safety Department has been reduced to studies only, and will be on the April Ballot. Commissioner Rydell reported dtht Mayor was appointed to talk with Foothill College regarding parking PLANNING COMMISSION MINUTES - December 9, 1981 Page Two D. PUBLIC HEARINGS: 1. Lands of Tossy, File HSA 5-81, 13711 Old Altos Road, Request for recommendation of Site Approval. Mr. Carlson referred to his staff report of December 3, 1981, indicating that there are 3 items peculiar to this property; creek, pathways and Town Boundaries. Staff recommends approval with Conditions as outlined in staff report. Commissioners and staff discussed in detail the creek and storm drain easements. The Public Hearing was then opened. Mr. Jerome Tossy, 13711 Old Altos Road, asked commissionif notinos it Bible that he not dedicate the storm drainage easement, g would hender the potential development of the lot. Mr. Bill Kull, Nowack & Associates, noted that they agree with the conditions except for the storm drainage easement. Mr. Kull proposed that this be changed to a HFBSL instead of storm drainage. Mr. Carlson noted the easement is requested because new and old construction in the area of the creek and storm drain easement could very possibly be flooded, he also suggested that the patio, bridges, etc. be removed. The Public Hearing was then closed. After some considerable discussion of the conditions it was felt this item should be continued for further investigation by the City Engineer with regard to the creek and storm drainage easements. MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Lachenbruch and passed unanimously to continue the Lands of Tossy, until further investigation is made by. the City Engineer and all concerns brought up at this meeting are reported on. 2. Lands of Chung, File NA 5232, 13139 Delson Court, Site Development Referral, Request for Tennis Court. Mr. Carlson reported that this item was referred to the Planning Commission for consideration of a tennis court, the site committee felt it necessary for the full commission to consider this application. commissiner not , could pssily be problemso located h inbthe areae where the tennis coumseepage rt wouldbeplaced. The Public Hearing was then opened. Mr. Chung, 13139 Delson Court, noted he did net feel there was a seepage problem and asked commission to approve his request. The Public Hearing was then closed. Lands of Chung, File #A 5232 (continued) ` After discussion of the possiblity of a spring in the area of the tennis court placement it was felt this item would need further investigation. MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Stewart and passed unanimously to continue this application until the applicant hires a Soils Engineer to review the site; this report will then be reviewed by the Town Geologist. When all reports are received by the Planning Department this item will return for con- sideration by the Planning Commission. E. OLD BUSINESS: 1. Lands of Wachs, File #A 5094, 27450 Sherlock Court, Continued consideration of an Appeal of a Site Development Denial. Mr. Carlson reviewed his staff report of December 2, 1981, noting this item has been continued from previous meetings for a Site Development Denial of a swimming pool. Mr. Carlson recommended denial for the following reasons: 1. visibility of pool from off-site. 2. more suitable location to the west of residence. 3. pool is located in a graded area. MOTION SECONDED AND CARRIED: Moved by Rydell, seconded lbtheachenbruch following and passed unanimously to continue Lands of Wachs, information is supplied by the applicant: 1. Landscape Plan, to be in accordance with Town's Landscape Policy. 2. Site Plan showing existing and proposed contours and elevations. E.Z. Lands of Bellucci, File #TM 2104-79, Request for change in Tentative Map Conditions of Apnroval, referred to Planning Commission from City Council at their November 18, 1981 meeting. Mr. Carlson gave a background of the existing and proposed access alternatives for Parcel 2. The applicants request is shown on Exhibit Y, Proposed Ingress -Egress Easement, dated received November 13, 1981. Commission, staff and applicant discussed alternatives for access to Parcel 2 in detail. MOTION SECONDED AND CARRIED: Moved by Carico, seconded by vanTamelen and passed unanimously to recommend approval to the City Council of the request made by applicant asrindicatved Novemb"Exhibit er 13, 1981 Proposed Ingress -Egress Easement", dated E.3. Ad Hoc Committee: Commissioners were concerned with the status of the new committee that was formed and what steps are being taken /ter in regard to committee vacancies. PLANNING COMPIISSION MINUTES - December 9, 1981 Page Four F. NEW BUSINESS: 1*01 1. Commissioner vanTamelen's letter, dated received, October 14, 1981, regarding Site Development Ordinance. Commissioner vanTamelen reported that she felt very strongly about revising the Site Development Ordinance, and requested that this letter be forwarded to the City Council for their consideration. She also noted that Spangle & Associates should be hired to review the Site Development Ordinance. MOTION SECONDED AND CARRIED: Moved by Caries, seconded by Lachenbruch and passed unanimously to send the letter to City Council for their consideration; with a budget amount of $5,000.00 for Spangle & Associates as consultants. 2. Resurfacing of Driveways. The Pathway Committee prepared a letter to the Commission regarding the dangers of the new driveways, which are causing accidents with horse and riders. Commission asked staff to investigate the Woodside Ordinance and see how it is policed; staff is to return with a recommendation at a later date. 3. Commissioner Carico reported there is a new State Law regarding Conservation Open Space Easements that might be of concern to the Town. Staff reported that the City Attorney is reviewing the bills and will report back on the implications. G.
