A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Dochnahl, Lachenbruch, Stewart, Struthers, and Chairman Rydell Absent: Commissioners Carico and Kuranoff Staff: City Engineer/Planner John A. Carlson; Assistant Planner Pat Webb; Secretary Leslie Mullins B. CONSENT CALENDAR: MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Struthers and passed unanimously to approve the Consent Calendar, namely: 1. Minutes - December 22, 1982 2. Setting Public Hearings for January 26, 1983 - a. Lands of Owlwood Farms, Annual Review b. Lands of Westwind Farms, Annual Review C. Ordinance - Patios at grade C. REPORT FROM VARIANCE AND PERMIT COMMISSION: Commissioner Stewart reported the Variance & Permit Commission denied without prejudice a variance request for Lands of Tyler, 12800 Alta Verde Lane, for placement of solar panels to encroach a maximum of twenty four feet into the rear yard setback. D. REPORT FROM CITY COUNCIL MEETING OF JANUARY 5, 1983: Commissioner Stewart reported the City Council approved: 1) Lands of Schwarz, Tentative Map with changes to Conditions of Approval; 2) Lands of McCandless, Site Approval and 3) Lands of Roth, Site Approval. MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Struthers and passed unanimously to hear Agenda item "E" before "D", with the approval of the applicant. Mr. Leo Ruth, representing the Daughters of Charity, indicated this would be appropriate due to the length of their item. Planning Commission Minutes - January 12, 1983 Page Two E. OLD BUSINESS: 1. Lands of Chung, 13139 Delson Court, Site Development Referral for tennis court Mr. Carlson recommended that the Planning Commission approve the Site Development Permit for the tennis court at 13139 Delson Court, indicating a review of the geotechnical report prepared by the applicant's engineer has been made by Cotton & Associates; Cotton is recommending approval with conditions as outlined in staff report dated January 6, 1983. The Public Hearing was then opened. Mr. Chung, 13139 Delson Court, informed the commission that he would be planting acacia trees and ground cover; and his contractor will be installing a drainage system and retaining wall. The Public Hearing was then closed. MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Dochnahl and passed unanimously to approve the Lands of Chung, Site Development Permit - Tennis Court, 13139 Delson Court, with conditions of approval as outlined in the January 6, 1983 staff report. D. PUBLIC HEARINGS: 1. Daughters of Charity, File #CUP 1-82, 26000 Altamont Road, Request for Conditional Use Permit to allow construction of two additional buildings on site. Mr. Leo Ruth, Ruth & Going, Inc., introduced his staff to the Com- mission and noted which items each was handling in the proposed project. Mr. Jerry DeYoung, Ruth & Going, gave a slide presentation showing overall site views, off site views from adjacent property and surrounding properties that view the site. Mr. Ed Janke, Architect, indicated they have designed the additions so there would be minimal amount of existing vegetation removed (gave a slide presentation of architectural renderings of the site with new additions). Ms. Webb referred to her staff report dated January 10, 1983, noting the property currently contains two parcels, for a total of 45+ acres, at this time the applicant is concurrently filing a parcel map to combine the parcels. This request before the com- mission is to increase the size of the administration building and to add a separate residential unit to house aged nuns. Ms. Webb noted the major impact on the community will be off site views, noting staff has not received any written or verbal objec- �" tions to this request. PUBLIC HEARINGS: (continued) has reviewed this application and recommends approval subject to the applicant conducting a geotechnical study, geotechnical plan review and geotechnical field inspec- tion, noting these recommendations are included in the Conditions of Approval. Staff recommends approval of the Conditional Use Permit with the following change to the Conditions of Approval, Condition #1: The primary use of the above referenced property shall be restricted to that of an orphanage, convent and the administration thereof, in the ownership of the above mentioned religious organization as well as administrative headquarters of the western province for the Daughters of Charity. Any change in ownership shall be cause for cancellation of this permit. Commission and staff discussed traffic and the increased number of employees and residents and their effect on the Town; the number of residents with respect to the total number allowed by the CUP. The Public Hearing was then opened. Mrs. Fran Stevenson, Chairman Pathway Committee, informed the commission there is a need for an important path con- nection on this property if the applicant's agree. Mr. Leo Ruth, informed the commission the applicant has no objection in providing the pathway easement; and suggested that the pathway commitee meet at the site with their (Ruth & Going) field engineer to determine the exact loca- tion of the pathway. Commission and applicant discussed the landscaping and screening to soften the impact of the new structures from off site. The Public Hearing was then closed, commission began a review of the conditions of approval. PASSED BY CONSENSUS: Passed by consensus to amend Condition 4, as follows: Remove all wording after persons. PASSED BY CONSENSUS: Passed by consensus to add Condition 4a. as follows; The number of non-resident employees shall not exceed thirty (.30). PASSED BY CONSENSUS: Passed by consensus to amend Condition 11, as follows: Landscaping shall be required to soften the impact of structures from off site vantage points; applicant is requested to reference the Town of Los Altos Hills Land- scape Policy. PASSED BY CONSENSUS: Passed by consensus to add Condition 13 as follows: An equestrian/pedestrian easement shall be dedicated as shown on the Parcel Map, dated received January 26, 1983. E. OLD BUSINESS• Commission and staff discussed the Lands of Huth, Burke Road, reasons why Bob Owen Homes was allowed to change subdivision from sewers to septic. F. NEW BUSINESS: Chairman Rydell informed commission he and Pat Webb will be attending a workshop regarding second units, and will report at the next meeting. G.
