MINUTES OF A REGULAR MEETING
Wednesday, February 9, 1983

Chairman Kuranoff called the meeting to order at 8:00 P.m. in the
Town Hall Council Chambers.
A. ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Commissioners Dochnahl, Kuranoff, Lachenbruch, Stewart
and Struthers
Absent: Commissioners Carico and Rydell
Staff: Assistant Planner Pat Webb; Secretary Leslie Mullins
B. CONSENT CALENDAR:
MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by
Struthers and passed unanimously to approve the Consent Calendar,
namely:
1. Planning Commission minutes - January 12, 1983
C. REPORT FROM VARIANCE & PERMIT COMMISSION:
Commissioner Stewart reported Variance and Permit recommended
approval for Lands of Tyler, 7' encroachment into setback for
construction of solar panels; and denied without prejudice a
variance request Lands of Fritz, to encroach into building envelop
and exceed building coverage, noting the applicant will be
returning with revised. plans.
D. REPORT FROM CITY COUNCIL MEETING OF FEBRUARY 2, 1983:
Commissioner Struthers reported the City Council discussed with
citizens and Santa Clara Valley Water District flooding problems
which occurred during last storm; set public hearing for the
Daughters of Charity for February 16; and discussed the parade
which will take place on May 21st.

1. Owlwood Farms, File #CUP 8007-75, 24970 O'Keefe Lane,

PUBLIC HEARINGS:
1. Owlwood Farms
Ms. Webb referred to her staff report of February 1, 1983,
indicating the last annual review by City Council was on
January 20, 1982, and since that time there have been no
amendments or additions to the Use Permit, noting there are
currently 18 horses on site. Ms. Webb noted inspections
have taken place by Fire Department, Health Department and
Staff, and all indicate compliance with CUP. Ms. Webb
indicated to commission due to recent storms some flooding
and erosion has taken place on the property, and applicant
is requesting to construct a retaining wall; the Building
Official has requested further information before issuance
of the Building Permit. Ms. Webb noted Condition B.S. of
the Conditions of Approval indicate any earth movement shall
be noticed to the Town Historian, Ms. Webb indicated she,
Town Historian and 2 anthropologists met at the site this
morning and found no sitings of Indian artifacts in the area
of the retaining wall. Staff recommended approval of the
Annual Review.
The Public Hearing was opened and closed with no one speaking
for or against this item.
MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by
` Dochnahl and passed unanimously to recommend approval to
the City Council for the Annual Review, Lands of Owlwood
Farms, File #CUP 8007-75.
2. Westwind Farms, File #CUP 8022-77, 27210 Altamont Road,
Annual Review for Conditional Use Permit. (.This item
was continued by staff for further information, to be
heard on February 23, 1983)
F. OLD BUSINESS:
1. Lands of Oskay, File #CUP 8029-78, 25231 La Rena Drive,
Review of Conditional Use Permit - Secondary Dwelling
Ms. Webb noted at the last hearing on the subject property,
all conditions had been satisfied and staff has made several
site visits, noting the most recent visit shows landscaping
has died and the property is vacant. Ms. Webb noted the property
is now owned by Centry Mortgage Company, and that she has
talked with the president regarding the CUP, and Conditions
of Approval.
Commission questioned since the landscaping was previously
approved and the bond was returned, can we now say that they
are not in compliance and revoke the Use Permit. Commission
discussed writing a letter to the new owner advising them of
the existing situation.
MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by
Dochnahl and passed unanimously that the Planning Commission

F. OLD BUSINESS: (continued)
1. Lands of Oskay
intends to recommend that the City Council revoke the Condi-
tional Use Permit, Lands of Oskay, File #CUP 8029-78, unless
Conditions setforth dated July 19, 1978, are complied with.
It is our contention Condition 1.E. is not complied with.
Prior to this being forwarded to the owner, staff shall get
a legal opinion from the City Attorney.
E. NEW BUSINESS:
1. Lands of Gigli, File #CUP 2-81, 27231 Elena Road, Review
of Conditional Use Permit - Secondary Dwelling
Ms. Webb noted this item is before commission for information
only, it is a condition of the CUP that staff review this
annually for compliance. Ms. Webb indicated all conditions
are in compliance and that the Building official has indicated
a final inspection of the secondary dwelling will not be
granted until the applicant has submitted a landscape plan
and it be approved by the Town.
MOTION SECONDED AND CARRIED: Moved by Lachenbruch., seconded
by Dochnahl and passed unanimously to concur with Ms. Webb's
staff report dated February 41 1983.
Mr, Gigli informed commission he would take care of landscaping
prior to final.
2. Verbal Report - ABAG Workshop on Second Units - Pat
Webb, Assistant Planner
Ms. Webb brieflyinformed commission of the ABAG Workshop
she and Chairman Rydell attended on Second Units, noting the
Town has numerous options to look at and will have a written
report for the February 23, 1963 meeting.
3. Sherlock Road
Commission questioned staff on the memo dated January 17, 1983,
regarding Eberz. Ms. Webb informed commission the recorded road
and actual road has recently become very prominent in discussion
for setbacks, etc., as it stands now, property owners along
Sherlock have no objections to placement of the road, however,
the Lemes family does object and it would have a substantial
effect on their property.
4. Commission questioned landscaping which is being performed
on Page Mill Road (Dawson subdivision properties), asking
staff to investigate and report at a future meeting and
possibly having Environmental Disign Committee discuss
landscaping policy with the owners of the property.

E. NEW BUSINESS:
5. Commissioner Struthers discussed concern over the
location of the pathway for Daughters of Charity.
Ms. Webb informed commission Ruth & Going's Engineers
have been working closely with the Pathway Committee
to resolve the pathway problem and should have a
solution for the City Council at their meeting of
February 16, 1983.
F. ADJOURNMENT:
There being no further new or old business, the meeting was
adjourned at 9:00 P.M.
