A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Carico, Dochnahl, Kuranoff, Lachenbruch, Struthers and Chairman Rydell Absent: Commissioner Stewart Staff: City Engineer/Planner John A. Carlson; Assistant Planner Pat Webb; Secretary Leslie Mullins B. CCNSENI CALENDAR: Item Ra ved - B.1. - (Lachenbruch) on page one, Planning Commission Minutes, Lachenbruch requested after restrictions the remainder be reworded as follows: Both applications were consistant with letter and spirit of applicable regulations. Variance & Permit Minutes - on page three, l.a. after shape, should read as follows: its proximity to an I-280 right of way and E1 monte Road, and the existence of speciman oak tree in patio area which cannot tolerate watering in its proximity. l.b. remove area after development l.a) reword as follows: It requires no grading MTION SECONDED AND CARRIED: Nbved by Rydell, seconded by Lachenbruch and passed to 1) approve Planning CCcr;mission Minutes of April 13, 1983 as amended; 2) approve Variance & Permit Minutes of April 13, 1983 as amrended - approved by Carico and Lachenbruch; and 3) Setting Public Hearings for May 25, 1983: 1) Lands of Meringo & Feiler, File #VAR 3-83 Commissioner Struthers abstained from approval of the Planning Commission Minutes for April 13, 1983 as she was absent from that meeting. C. REPORT FROM CITY CQINCIL MEETING OF MAY 4, 1983: Mr. Carlson reported the City Council approved the ordinance relating to Patios at Grade as recommended by Planning Commission. PRESENTATION OF SATELLITE SAUCERS: `• comnissicner Kuranoff introduced Mr. Les Levitt and Mike Dettinger who gave a presentation on Satellite dishes, antennas and equigmnt, noting the most critical item regarding the dish is the placement of such, must be placed on a slab of concrete for sturdy base, faced south at a 450 angle and for full effectiveness cannot be obstructed by trees, foliage, mountains, etc. Materials generally used are fiberglass, usually white in color, but could be painted other colors to blend, however, there would be a slight degregation of performance. Questions were then asked regarding materials, colors, landscaping and performance. E. PUBLIC HEARINGS: 1. Lands of Fowls, File #TM 6-82, 27060 Old Trace Lane, Request for approval of Negative Declaration and Tentative Map, 8 Iots. Mr. Carlson noted since the Planning Commission did not meet at their last regular scheduled meeting, staff ran into a time problem as to setting the public hearing date and needed to advertise without the Con- sent of the Planning Commission and asked that co mission approve the public hearing being set for the Lands of Fowle. MOTION SECaWED AND CARRIED: Moved by Lachenbruch, seconded by Struthers and passed anenimously to approve setting of Public Hearing for the Lands of Foale, File #TM 6-82. Mr. Carlson referred to his staff report of May 6, 19B3 indicating the planning Cannission should adopt a motion recaimexiding to the City Council that a Negative Declaration be filed with the Santa Clara County Clerk. The Public Hearing was then opened and closed with no one speaking for or against the Negative Declaration. MOTION SDCONUM AICD CARRIED: Moved by Carico, seconded by Dochnahl and passed unanimously that the City Council adopt the Negative Declaration for the Lands of Fowle, File #TM 6-82, and that it be filed with the Santa Clara County Clerk. Mr. Carlson referring to his staff report of May 6, 1983 indicated the site is bounded by Freront Road on West, Old Trace Lane on North, undeveloped land in Palo Alto on East and residences on the South. Noting there are four items peculiar to this subdivision: 1) access over Old Trace Lane; 2) existing structures on the property; 3) street improvmients;. and 4) access on Freront Road, as detailed in the staff report. Staff recrnmenled approval of the Tentative Map with Conditions of Approval as outlined in staff report dated May 6, 1983. The Public Hearing was then opened Mr. Dexter Ahlgren, Civil Engineer, addressed cc mission with question re- garding the conditions of approval: 4a) clarification of vegetation remval; 8a) Road Maintenance Agreement, concerned with neighbors that may not wish to enter into the agreement; 8b) chicken house, noting it is now being used for storage and the owners would like to retain this as well as the shop and condition as in 8d; 8d) can we eliminate the 10 year requirement and make the removal of the shop and chicken house contingent upon the sale of the 2 lots. planning Commission Minutes - May 11, 1983 Page Three E. POBLSC HEARINGS: (continued) 1. Lands of Fowle Mr. Carlson noted condition 4a clearing of vegetation is for purposes of pathway in case some of the existing vegetation needs to be removed for location of the path; condition 8a, it will be a requirement of the new lots entering off Old Trace Lane to join the Road Maintenance Agreement; 8b and 8d, Mr. Carlson indicated he saw no problem with changing as requested by Mr. Ahlgren. Mr. Joseph Seiger, 27087 Old Trace Lane, supports the subdivision and asked caanission to recd mend approval. Mrs. Mary Stutz, Pathway Comnittee, noted the pathway being requested is Neary fines with headerboards along Fremont and along Old Trace a natural pathway to go up behind the first row of trees. The Public Hearing was then closed, ccnmission then began review of the Conditions. of Approval. Passed by consensus to amend Condition 4.A. as follows: All path easements within the subdivision shall be cleared of vegetation only as necessary to permit unobstructed passage of equestrian and pedestrians. Passed by Consensus to amend Condition 4.B. as follows: A Type II B path shall be installed along Fremont Road across the frontages of Lots 6,7, and 8 and should be separated frau roadway by five feet (5') at least. Passed by consensus to amend Condition 8.A. to include after agreement: for Old Trace Lane... Passed by consensus to amend Condition 8.B. as follows: The chicken house on lot 4 must be removed when the lot is sold by current owner. Passed by consensus to amend Condition 8.D. as follows: The existing shop shall be reroved when either lot 4 or Lot 5 is sold by the current owner. The owner shall sign an agreement and post a bond for 100% of the remval cost to ensure ccupliance. MDTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Kuranoff and passed unanimously to reccnmend approval of the Tentative Map, lands of Fowle, File #7M 6-82 with Conditions of Approval as amended. F. OLD BUSINESS: 1. Report on wall at 12251 Menalto Drive Ms. Webb gave a brief background on the property and the location of the subject wall, noting the wall exceeds 6' on the right hand side of the gate. Ms. Webb indicated the owner has been informed of his alternatives which include lowering the wall on the right hand side or applying for a variance. Ms. Webb further indicated at this time, the owner has not made a decision, staff will follow up on this item and report back to the omission at their next meeting. Comnission and staff discussed the possibility of amending the fence ordinance so that this type of problem would not occur again, staff will investigate options with the City Attorneys input and report back to connission. Housing Task Force Chairman Rydell noted the comm ttee (Carico, Stewart and Rydell) will be meeting in early Juneto discuss the new state legislation; after staff and 2 sembers attend a workshop held by ABAG on second unit legislation. G. NEW BUSINESS: 1. Site Developmnt Referral - Lands of Ersepke, 25740 Josefa Lane, Request to construct a garage, stable and bath addition Mr. Carlson referred to his staff report of May 6, 1983 indicating this item was referred to the Planning Ccsnnission by the Site Development Can ttee due to neighbor concern and the need to resolve the question on proper use of the land for a hom occupation. Mr. Carlson noted there are two basic issues: 1) does the operation of the Ins Altos Overhead Door Co., exceed the allowed use as specified in the code under Home Occupations; and 2) issuance of the site development permit. Staff feels there should not be a site development permit issued until the matter regarding the hone occupation is solved. Commissioners noted the drawings presented show lack of necessary infor- mation, ie. scale, size of the proposed barn, etc. Chairman Rydell noted this matter regarding the hone occupation should 4 be a matter for staff and City Attorney to be looking into and would !' prefer that this item be investigated further and returned to Planning Commission with a recacmendation. MOTION SECONDED AND CARRIED: Moved by Ruranoff, seconded by Carico and passed unanimously to send the Lands of Ersepke back to staff for further investigation, both technical and legal aspects, and return to Planning Conmission with recce miendation.
