A. ROLL CALL: Present: Commissioners Carico, Dochnahl, Kuranoff, Lachenbruch, Stewart and Chairman Rydell Absent: Commissioner Struthers Staff: City Engineer/Planner John A. Carlson; Assistant Planner Pat Webb; Secretary Leslie Mullins �� MOTION SBCONDED AND CARRIED: Moved by Kuranoff, seconded by Carico and passed to approve the Consent Calendar, namely: Approval of June 8, 1983 Planning Commission minutes. (No public hearings for July 13, 1983) C. REPOjU FROM CITY COUNCIL =ING OF JUNE 15, 1983: Commissioner Lachenbruch reported the City Council referred to the Planning Commission for review the item regarding 448 Building Coverage rule as applied to Mataderc, Creek Lots; indicated it would be desired if at each Council meeting the Planning Commission representative gave a report from the full commission. (continued for discussion under New Business) Mr. Carlson reported the City Council approved a change of ownership on a tentative map frau Tokheim & Green to Walker; fcroation of a Ad Hoc Cortnittee to clean up Town Hall and Council would be holding a budget session on July 5, 1983 at 9:00 a.m. (Commissioner Carica to attend) (amended 3;m 2 , 1983) ova i?, D. PUBLIC HEARINGS: 1. Lands of Qubain, Lot #9, Tract 47187, 28605 Matadem Creek Court, Site Developmmt Permit Referral for construction of new residence and pool. Mr. Carlson reported this item was continued from the June 8, 1983 Planning Ommission meeting for the applicant to revise the landscape screening and investigate the use of a berm along the front of the residence. The architect has submitted new plans for the commissions review. `r The Public Hearing was then opened. Planning Commission Minutes - June 22, 1983 Page Two D. PUBLIC HEARINGS: (continued) %W Mr. Fred Bisaharat, Architect, introduced the landscape architect and noted these are prelimary drawings and the working drawings will be conpleted with all specifications at the time of finalizing the residence. Mr. Bob Petersen, landscape Architect, noted that they have not yet tied down the specific types of trees and shrubs to be used on this site. The Public Hearing was then closed. Commission discussed with staff the need for assurance that the landscaping will be installed. Mr. Carlson suggested to Planning Conmission that they make a notion that the landscape plans be brought back to the full camiission with specifics prior to the final of the residence. MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by Lachenbruch and passed unanimously to have the applicant submit Final Landscape Plans to full Planning Commission which would specify the types, sizes and locations of trees and shrubs. At that time, the Planning Commission can make a decision regarding the bonding of the subject landscaping for this particular site to ensure maintenance of landscaping. MOTION SECONDED AND CARRIED; Moved by Dochnahl, seconded by Carica and passed by the following roll call vote to approve the Site Development Permit for the Lands of Qubain, 28605 Matadero Creek Court. ROIL CALL: Ayes: Commissioners Carico, Dochnahl, Lachenbruch, Stewart and Rydell Noes: Commissioner Kuranaff 2. lands of Alhouse, File #CUP 1-83, 26173 Rancho Manuella Road, Request for Conditional Use Permit for secondary dwelling. Ms. Webb referred to her staff report of June 17, 1983 noting the existing buildings on the subject property were constructed prior to the Town's in- corporation. Further noting, Ms. Webbinformed commission the guest house is approximately 1,000 square feet and originally contained kitchen facilities, but as a requirement of a subdivision in 1967, the then owners were required to remove the kitchen facilities to meet Town requirements, staff has made a site inspection and finds that only the sink was removed, (stove and refrig- erator still remain). Ms. Webb indicated there have been no written or ver- bal objections to this request and staff reoommiends approval of the Use Permit with conditions as outlined in the June 17, 1983 staff report. Commissioners questioned staff regarding the new state law and second units and if it would ing>act the decision of allowing this use. Commission and staff had discussion relating to the new State Law, and this second unit being brought up to Building Cie Standards. 4W The Public Bearing was then opened. Mr. Alhouse, 26173 Rancho Manuella Road, informed corwdssion they are planning to remodel the existing residence on the property and would like to live in the second unit during construction period. Mr. Alhouse noted there is no separate meter (PG&E) for the cottage; and future use is being geared for elderly relatives. Planning Commission Minutes - June 22, 1983 Page Three D. Passed by consensus to amend Condition #5, as follows: The kitchen facilities will be permitted in the secondary dwelling only while the primary dwelling is unoccupied and being remodeled. The Conditional Use Permit should be reviewed by staff when primary dwelling is completed for compliance with Town ordinances. MOTION SBCONDED AND CARRIED: Moved by Kuranoff, seconded by Dochnahl and passed unanimously to recommend approval of the Lands of Alhouse, File #CUP 1-83, with amendments made to conditions in the June 17, 1983 staff report. E. OLD BUSINESS: 1. Resolution #1256, Landscape Policy Mr. Carlson inform camndssion at their June 8, 1983 meeting the Commission received comments from Environmental Design Committee on their suggested revisions to the Landscape Policy, Resolution #1256. Mr. Carlson referred to his June 20, 1983 staff report giving his recommendations on changes in current policy. Mr. Carlson recommended that a policy be established in which we veld issue an agreement accompanied with a bond, which world be signed by the property owner obligating the owner to install and maintain specific landscape screening. Commission and staff discussed the role the Environmental Design Committee would play in the process of inspections and site development. It was noted there is a Task Force Committee currently revising the site development chapter of the Municipal Code. Commission and staff discussed the bond procedure and suggested staff look into Condition 5.C. and return with more general information. 2. Chairman Rydell noted he, Carico, vanTamelen and City Manager met to discuss commissions input regarding the budget and that process. Chairman Rydell noted they had also discussed the City Managers plans for City organization, noting the Manager would be attending the next commission meeting to meet all commissioners and talk with the entire coamission. City Council Referral - Matadero Creek Subdivision, Building Coverage Mr. Carlson reported the subject change in Condition 7.B. of the Matadero Creek Conditions of Approval was worked on by the Task Force currently reviewing the Site Development Chapter of the Municipal. Code and a report was sent directly to the City Council for action; the City Council has referred this matter to the Planning Commission for review and report. Mr. Carlson noted the Torn originally incorporated Maximum Deve-OFuent Area for each lot in Matadero Creek (not based upon total lot, but on `, MDA for 1 LUF) and it has been brought to the attention of staff that when you take the decreased MDA and apply the current 448 formula, the number obtained is considerably laser than the number shown in Table A of the May 27, 1983 staff report. Mr. Carlson noted as it now stands Planning Commission Minutes - June 22, 1983 Page Four F. NEW BUSINESS: (continued) 4 the owners of lots in Matadero Creek are finding it difficult to design a Muse they desire within these constraints. Mr. Carlson suggested cannission recommend to the City Council amendment of Condition 7.B. of the Matadero Creek Subdivision, Conditions of Approval as written in staff reports dated May 27, 1983 and June 20, 1983. Commission and staff discussed the details of the proposed change and some discussion regarding Architectual Control. It was noted, that in no way this change would allow more development area than that al- ready allowed by current ordinances.
