REPORT FROM CITY COUNCIL MEETING OF JULY 6, 1983: Cmnnissioner Carico reported the City Council removed Lands of Melchor for acceptance of street improvements until drainage concerns are cleared up; re-cmusideration of ordinance relating to fire retardant roofing; set time and date for appoinbnents and interviews for planning coc ussion vacancies; discussion regarding landscape oamuttee. Mrs. Hinshaw added information regarding the flare retardant roofing noting the Ins Altos Fire Chief and the Fire Co mission attended the Council meeting to stress the importance of keeping the ordinance as is. Iands of Dumas, 13555 La Paloma Road, Consideration of Landscape Plan Ms. Webb informed co mission this item was scheduled for Site Development Camiittee review on 'Tuesday, July 5, 1983, and was pulled off the agenda prior to the hearing date due to neighbors concern over drainage in this specific area of the Philbrick subdivision, noting the house, grading and drainage was approved in November, 1981. co missicners and staff discussed the presence of a berm located on the north side of the property, and questioned if this was in violation of the grading ordinance within 10' of the property line. Ms. Webb indicated there was no indication of the berm on either the landscape plan or the approved grading plan. Mr. Travice Whitten gave a brief presentation of the existing drainage improvenents in the La Paloma Road area. The Public Hearing was then opened. Mr. Koon, 26065 Newbridge Drive, expressed his concern over the drainage of the area, not over the Dunes property, indicating to cannission he has had more drainage runoff this past winter than any other time due to the four new subdivisions. Mr. Kom indicated the water from the west side of the road should go dawn the west side, noting also the pathways were totally destroyed this past winter, and would like to see the 'town care up with an atlernative solution to the drainage problems in this area. Mr. Roberts, 26060 Newbridge Drive, expressed concerns over the existing drain pipe and sandbags left after last winter storms and asked that a t solution be made as soon as possible. W. Dumas, 13555 la Palona Road, indicated he has been caught in the middle of this situation regarding drainage, noting the subdivider put in the culvert. Mr. Dumas asked commission to grant approval of this landscape plan and driveway location as indicated on the plans sulanitted. Mr. Dimas referred to the berm, noting they would like to leave it as is, noting it gives them and their neighbor more privacy, (McFarland neighbor has verbally agreed to the location). WTION SECQNIDID AND CAP=: Moved by Carico, seconded by Kuranoff and passed by the following roll call vote, to consider the lands of Dumas, landscape plan this evening. ROIL CALL: AYES: Commissioners Carico, Dochnahl, Kuranoff, Lachenbruch, and Rydell NOES: Coamissioner Struthers Planning Camuission Minutes - July 13, 1983 Page Three Lands of Dramas (continued) MOTION SECONDED AMID CARRIED: Moved by Dodu ahl, seconded by Struthers and passed unanimously to set up a field trip for the La Palcna Road area, which would include participation by staff, planning commission, city council, public works committee and pathway committee and concerned residents. Notices will be mailed to residents in the area. Commissioner La henbruch indicated information for the field trip should be supplied which would include a topographic map of the problem area, including drainage improverent locations and sizes. Commission, staff and applicant discussed the types of trees and shrubs that would be planted and maintained on this site, especially in the area of the driveway. MOTION SECONDED AMID FAILED: Moved by Caries, seconded by Kuranoff, and failed by the following roll call vote to approve the Lands of Dramas landscape plan with the following conditions: 1) Divert water from all drains at the front of the property to drain along roadway to existing culvert, not across path subject to the approval of the City Engineer; 2) Cut a ditch around the top of the cut bank in the rear yard; 3) Move pillars back frau roadway or re- duce in height to conform to Ordinance #267; and 4) Grading to be inspected and to be in accordance with approved grading plan prior to final approval of the landscaping. ROLL CALL: AYES: Connissioners Carico, Doctnahl, Struthers NOES: Coamissiomers, Rydell, Kuranoff, iachenbruch MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by Dochnahl and passed by the following roll call vote to approve the Lands of Dumas landscape plan with the following conditions: 1) Divert water from all drains at the front of the property to drain along roadway to existing culvert, not across path, subject to the approval of the City Engineer; 2) Cut a ditch around the top of the cut bank in the rear yard; 3) Move pillars back from roadway or reduce in height to conform to Ordinance #267. ROLL CALL,: AYES: Commissioners Dochnahl, Kuranoff, Lachenbruch and Rydell NOES: Caanissioners Carico and Struthers City Council Referral - Review of Section 9-5.503, Building Height as it applies to aerial antennas. Ms. Webb referred to nenio dated July 8, 1983 noting a letter has been received by staff regarding the above subject. The City Manager with concurrence of the City Council has referred this item to ccumission for recommendation and report. Ms. Webb indicated in July 1981 the City Council approved Ordinance #268 which anendsd several sections, the amendments to Section 9-5.503 maintained the existing maximum height limit of 30', but established a building envelop which restricted building heights to less then 30' in the area adjacent to the setback, an exception to this envelop restriction was allowed for chinvneys, noting aerial i antennas previously nentioned in this section of the code, were not discussed in the final form of the ordinance. Planning Commission Minutes - July 13, 1983 Page Four E Ms. Webb further. noted Mr. Kaufman has received a building permit to %r install an antenna in the allowed location, but world like commission to consider an amendment to the code such as chimneys. Ommission and staff discussed the possible revision of the ordinance, noting there are a wide variety of antennas, types and sizes. Mr. Smithwick, amateur radio operator in the area as well as Mr. Kaufman who has requested this item, stressed the importance of the use of radios for emergency situation within the Town if they were to occur, noting the amateaur radio operators have been in service in State and Federal opera- tions for 60 years; noting there are probably 60-70 in this area. Mr. Smithwick indicated regarding the height of the antenna, the efficiency drops rapidly below 50', noting there are many antennas that are expandable in heights and could be kept at a 30'height when not in use. Commission and staff discussed possible wording for revision of the current ordinance to include antennas. Staff was instructed to return with draft at next meeting. Section 9-5.503 (b)(i) A chimney, or conventional tele- vision and radio fixed antennas that are attached to the building can extend above the surface... 3. commissioner Struthers informed commissioners that letters are now being prepared after site development to inform applicants of actions taken. Commissioner Struthers also noted Peter Wallace, Fhvironmental Design Com- mittee brought in a handout to go along with landscape Resolution. G.
