VARIMCE AND PERMIT COM IISSICN Town of Los Altos Hills 26379 Frenont Road Los Altos Hills, California MINUTES CF A REGULAR MEETING Wednesday, July 27, 1983 Reel 106, Side II, Tract I, 000-135 Chairman Carico called the meeting to order at 7:00 p.m. in the Toxon Hall Council Chambers. A. ROLL, CALL: present: Commissioners Carico, Lachenbruch and Struthers Absent: None Staff: Assistant Planner Pat Webb and Secretary Leslie Millin B. PUBLIC HEARINGS: 1. Lands of Moison, File #VAR 5-83, 25620 Deerfield Drive, Variance request for proposed addition to exceed allowed building coverage, and encroachment into side yard setback. Ms. Webb referred to her staff report of July 22, 1983, noting the subject property was subdivided prior to the Ttwn's incorporation and the house was constructed around 1940, noting there are no records of building permits in the Town files. Ms. Webb gave commission slope density and development area calculations relating to the subject property, noting existing de- velopment exceeds the allowed NIDA by 340 square feet (pre -dates ordinance). Ms. Webb indicated the owner proposes a single story addition, which would be less obtrusive then two story from off site, and will remove existing coverage to maintain the same development area. Ms. Webb informed commission there have been no written or verbal objections to this ap- plication, therefore staff recommends approval of the variance request with the statements and conditions as listed in the July 22, 1983 staff report. The Public Hearing was then opened. Mr. William Moison, 25620 Deerfield Drive, asked commission to recommend approval of his variance request and informed commission he has been in contact with a landscape architect for landscape screening of the property. The Public Hearing was then closed. Commission and staff discussed the six criteria for granting of a variance in relation with this request. MDTICN SELCMED AND CARRIED: Moved by Lachenbruch, seconded by Carico and passed unanimously to recommend approval of granting the variance request 44, for the Lands of Moison, File #VAR 5-83, with statements and conditions as listed in the July 22, 1983 staff report and as amended as follows: Variance & permit Co¢nission Minutes - July 27, 1983 Pace Two Statement #1 was amended unanimously as follows: �W l.a) Exceptional or extraordinary circumstances exist due to the Property's steep topography and substandard size which is further reduced by a vehicular access easamnt which predates the Town's incorporation. l.b) Since this property lies in a region in Town where lot sizes are transitional to neighboring comnmity and where develORDent patterns on this and other neighboring lots were established prior to incorp- cration with structures observing smaller setbacks than are now required.The requested departures from existing ordinances are viewed as nominal in this context and are consistent with the spirit of the ordinances.
