' A. ROLL CALL: present: Ca missioners Kuranoff and Struthers Absent: None Staff: City Engineer/Planner John A. Carlson; Assistant Planner Pat Webb; Secretary Leslie Mullins B. CONSENT CALENDAR: 1. Confirmation of item set for public Hearing for September 14, 1983: a) Lands of Marcus MOTION SB-DNDED AND CARRIED: Moved by Struthers, seconded by Kuranoff and passed unanimously to approve setting of Public Hearing, Lands of Marcus. C. PUBLIC HEARINGS: 1. Lands of Marcus, File #VAR 6-83, 26390 Anacapa Drive, Variance request to allowa maximum encroachmmment of 39' into the front yard setback lire as per Section 9-5.504 for relocation of an existing residence. Ms. Webb referred to her staff report of September 8, 1983, noting the property has experienced landslide problems over the years, most severly in the past 1982-83 winter, due to excessive rains and soil instability the existing residence suffered substantial foundation damage and had to be moved off its foundation in order to save the house. Ms. Webb reported the property has been analyzed by geotechnic consultants including the Town Geologist and reco,,o dations for repair of the hillside have been provided. Ms. Webb noted the proposed location of the existing residence into the front yard setback is to enable the applicant to position the house on the most geologically stable portion of the property in order to avoid future problems. Staff recanrended approval of the subject request with statements and conditions as listed in the September 8, 1983 staff report along with a new condition #3 to read as follows: A Site Development Permit be issued for re -location of the residence. The Public Hearing was then opened. Ms. Rex Up, Cleary Consultants, presented photographs to commission for their review of the site from the beginning when they were first consulted for geologic investigation. Asked commission to grant approval of the proposed location as it is more suitable for the placement of the house. VARIANCE 6 PERMIT COMMISSION - SEPTEMBER 14, 1983 PAGE TWO The Public Hearing was then closed. JL V Cannissioners and staff discussed with Engineer (John Riley) the location of garage, guest parking in reference to the busy street access. Mr. Riley, informed the colmission the proposed parking deck would be built up on piers with a walkway down to the residence, noting the structure would be built over the existing driveway which needs to be reworked and would be a foot or two off the property line. MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by Struthers and passed unanimously to recalmecid approval of the Lands of Marcus, File #VAR 6-83, 26390 Anacapa Drive with conditions of approval as amended.
