MINUTES OF A REGUTAR MEETING
Wednesday, November 9, 1983

Chairman Kuranoff called the meeting to order at 7:00 p.m. in the Town Hall
Council Chambers.
A. ROLL CALL:
Present: Carmissioners Kuranoff, Lachenbruch, and Struthers
Absent: None
Staff: City Engineer/Planner John A. Carlson; Assistant Planner Pat Webb;
Secretary Leslie Mullins
B. PUBLIC HEARINGS:
1. Lands of Marcus, File #VAR 9-63, 26390 Anacapa Drive, Variance
request to allow naximumn building coverage in excess of the allowed
by 440 square feet as per Section 9-5.502 of the MInicipal Code
V Ms. Webb referred to her staff report of November 3, 1983, giving a brief
background of the property and the recent variance request for relocation
of the residence due to landslides on the property during the winter of
1982/83. Ms. Webb noted since that approval, the applicant has decided
they would like to increase the living area of the here by approximately
480 sq.ft. and eliminate the parking deck. Ms. Webb indicated the total
development area is less ttan the allowed and is substantially less than
the previous development area, noting the increase in building coverage
could be permitted and shall meet the intent of Ordinance #268. Ms. Webb
informed conmission there have been no verbal or written objections to
this request, therefore, staff recamends approval of the variance request
with conditions of approval and statements as written in staff report
dated November 3, 1983, with amendment to Condition #3 as follows: "A
new variance agreement shall be executed between the 'loon and the property
owners for the subject variance."
The Public Hearing was then opened and closed with no one speaking for or
against this item.
Connissioner Struthers questioned Mr. Riley, applicant's engineer, on the
parking for the property, noting she felt it is inadequate and could be
a hazard by being so close to the street -right-of-way.
Mr. Riley indicated there are 4 parking spaces on the site, which meets
the ordinance requirements; i.e. 3 in garage, one on site.
Commissioners Kuranoff and Iachenbruch indicated the code requirement of
4 parking spaces has been net.

M7rICN SECUNDED AND CARRIED: Moved by Iachenbruch, seconded by Struthers
and passed unanimously to recommend approval of the Lands of Marcus,
File #vAR 9-83, with amendments to Statements 1 & 2 and Condition #3
as follows:

1. Exceptional or extraordinary circumstances exist due to the property's
history of landslide damage and unstable soil conditions.
2. The normal means of attaining this small additional area would be a
second story addition, due to the exceptimal circumstances relating
to the foundation conditions and the reduced front setback the
variance avoids practical difficulties that would be imposed by strict
code enforcement.
COMITICNS:
3. A new Variance Agreement shall be executed between the Town and the
property owners for the subject variance.
