HomeMy WebLinkAbout11/30/1983VARIANCE AND PERbffT CONR'IISSION Town of Ins Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, November 30, 1983 Reel 107, Side I, Tract II, 000-125 Chairman Stewart called the meeting to order at 6:35 p.m. in the Town Hall Council Chambers. A. ROLL CALL: Present: Commissioners Dochnahl, Stewart and Struthers Absent: None Staff: Assistant Planner Fat Webb and Secretary Leslie Mullins B. PUBLIC HEARINGS: 1. Lands of Larin, File #VAR 7-83, 12720 Dianne Drive, Variance request to allow a maximum encroachn:ant of two feet into the front yard building envelop as per Section 9-5.503 (a) of the Municipal Code. Ms. Webb referred to her staff report dated November 23, 1983 and supplenent report dated November 29, 1983, noting to variance request is to consider a maximum encroachment of two feet into front yard building envelop requirements as per Section 9-5.503 (a) of the b'hnicipal Code for an addition to the existing structure. Ms. Webb gave a brief description of subject lot and adjacent properties; permits previously issued on the subject lot (including a variance for encroachment into setbacks for tennis court). Ms. Webb indicated staff could not make the required findings called out in #'s one and two of Section 9-5.1107 (b) of the Municipal Cale, noting the lot has sufficient size, suitable configuration such that here are no unusual or exceptional circumstances related to the physical properties of the lot. Ms. Webb indicated there have been no written or verbal objections to this request. Ms. Webb indicated as staff could not meet the requirements for granting of a variance, staff recxL ds denial of the variance request. The Public Hearing was then opened. Mr. Arthur Dusenberry, 25600 Olive Tree Lane, Designer of project, informed commission the request for the variance is so that the existing gable and the new addition is kept in conformance with each other, noting however, they could rake changes to the proposed addition that would not include the need for a variance. The Public Hearing was then closed. MOTION SECONDED AND CARRIED: 110ved by Dochnahl, seconded by Struthers and passed unanimously to deny without prejudice the Lands of Tarin, File #VAR 7-83. Lands of Gottlieb, File #VAR 8-83, 24290 Su— rhill Avenue, Variance request to allow a maxi= encroachu t of eleven feet (11') into the rear yard setback as per Section 9-5.504 (c)(2) of the Municipal Code Ms. Webb referred to hes staff report of November 22, 1983, noting this variance is a request to allow a ffaxinum encroachrent of 11' into rear yard setback for an addition (single story) to the existing residence. Ms. Webb gave a brief background description of the property and lot characteristics, noting due to constraints iirposed by vehicular access easements, substandard lot size and existing encroachvent of the house (predate Town incorporation) there is very little area to add an to the house without a variance; the only area possible is to the front of property which would result in disruption of living pattern and incongruous floor plan. 'there have been no written or verbal objections to this request, staff re:omrends approval of variance with six statements as in November 22, 1983 staff report. Statement #1, Ms. Webb indicated stating that the property predates the Town incorporation. The Public Hearing was then opened. Mrs. Carol Gottlieb, 24290 Summerhill Avenue, asked commission to recomrend approval of the request. The Public Hearing Was then closed. Commissioner Dochnahl indicated he felt the request net the 6 criteria and would not be detrimental to any adjacent pro_: rty owners. Camnissioners reviewod the six staterents for meeting the variance criteria. MOTION SFMOED AND CApp=: Moved by Dooloahl, seconded by Struthers and passed unanin=sly to recunend approval of the Lands of Gottlieb, File WAR 8-83, based on the six conditions as in November 22, 1983 staff report, with the amendment to Condition #1 as follows: "due to subdivision prior to Tom's incorporation".
