MINUTES OF A REGULAR MEETING

Chairman Carico called the meeting to order at 7:45 P.M. in the Town Hall
Council Chambers.

B. CONSENT CALENDAR:

Carico requested the Planning Co mission minutes of February 13, 1985, under
the Lands of Eastw ck, on Page Two the following be added: Commissioner Carico
asked Mr. Eastwick when the driveway was upgraded and improved? Mr. Eastwick
indicated it was done prior to his purchase of the property.
MOTION SECONDED AND CARRIED: Moved by Iachenbruch, seconded by Struthers and
passed unanimously to approve the minutes of February 13, 1985 as amended.
MOTION SECONDED AND CARRIED: Moved by Iachenbruch, seconded by Struthers and
passed unanimously to approve the remainder of the Consent Calendar as follows:

C. REPORT FROM CITY COUNCIL MEETING CP FEBRUARY 20, 1985:
Commissioner Iachenbruch reported the City Council approved an increase in NIDA
for Lands of Meise, lot #8, Matadero Creek Court, noting decision not in keeping
with Site Development recommendation; Bellucci appealed Ccnnussim decision of
adopting EIR for 300 membership, application referred back to Conmission for
decision on CUP; No Parking Signs to be installed on O'Keefe lane property;
and decision to proceed with the hiring of an in house staff planner.
1. LANDS OF LACY, FILE #CUP 6-84, Int #3, Red Rock Road, Request for approval
of Conditional Use Permit for second unit (attached)
Ms. Lytle referred to staff report dated February 21, 1985, noting staff
recommends denial of the CUP for a secondary dwelling unit based upon an
Liability to find sufficient information supporting the necessary findings
in Section 9-5.1107 (a) (iii) of the Municipal Code. Ms. Lytle indicated
if the Commission wished to approve the CUP, staff recommends that the item
be continued to allow staff time to compile recon ended Conditions of Approval.
Ms. Lytle gave Commission a brief background and discussion on the subject
request, noting new plans were submitted on Monday and have not yet been
reviewed by staff for conformance with zoning ordinances, indicating the
staff report was prepared prior to this submittal and it indicates the plans
do not meet zoning requirements. Ms. Lytle further indicated that in
reference to required findings for a CUP, staff feels that finding (iii)
winch states that "the site for theproposed use will be served by streets
and highways of adequate widthand pavement to carry the quantity and kind
ibr of traffic generated by the proposed use", cannot be made. Ms. Lytle noted
this parcel is within the MiCP Study Area, report prepared by Spangle & Assoc.,
in March 1970, the determination of adequacy of the roads in this area is
based on a maximr,m buildout of ore single family unit per parcel, and by
allowing an increaseof units per parcel from one to two, this study is
essentially outdated. Ms. Lytle indicated in staff's opinion, a new study
would have to be performed to determine the adequacy of roads based on
these increased assLuptions.

The Public Hearing was then opened.
Mr. Peter lacy, 2420 Bryant Street, Palo Alto, informed commission he and his
wife purchased the property last summer and have reviewed the requirements for
building carefully, noting they world like to have resident staff to maintain
grounds and house, the second kitchen would provide privacy as the staff would
not be cooking for the owners. Mr. lacy indicated the staff would also provide
security while Lacy's are on vacation. Mr. Lacy did not feel that traffic on
Central Drive would increase by this use, noting he has been in contact with
Mr. Mader who prepared the original study for this area with regard to traffic.
Mr. James Patmore, 27650 Central Drive, indicated a use such as this might
start a precedent in the area, noting the traffic now is very lou, but we should
think in longer terms.
Mrs. Jan Cowan -Lacy, 2420 Bryant Street, Palo Alto, indicated if the Cammmission
CW placed a review period on the CDP, than if a problem arises it could be
rectified during the review process by the staff and commission.

1. Lands of Lacy
Comtissioner Siegel indicated perhaps the Use Permit could have a limit on
the number cars that would use Central Drive from this parcel, as long as
the required findings for a Use Permit can be met. Commissioner Siegel indi-
cated if the kitchen facilities were not included, the Town would allow this use.
Cmmissioner Struthers indicated when this item was before the subcaumittee
there was sane concern over the number of potential people living in the
residence and the number of potential bedrooms.
Mr. Hil Reiser, 27660 Red Rock. Fuad, indicated the Commission is being
presented with a proposal for two people to have live in help in their
residence, noting this is actually a request for approval of kitchen facilities
as mentioned by Cmnissioner Siegel.
Mr. Mitch Conner, Architect for Roland Miller, informed commission it is
their concern that the structures be campatible and they work together.
The Public Hearing was then closed.
Camussicner Struthers questioned if there was a road maintenance agreement.
Mr. Reiser indicated there is one for his subdivision, Red Rock Road.
Camissioner Yanez questioned if there were other problems with regard to
this Use Permit request. Ms. Lytle indicated the only concern is over traffic.
Camdssicn and staff discussed the possibility of limiting the number of
cars allowed as per Cannissioner Siegel's suggestion.
MOTION SBCCNDED ASID CARRIED: Moved by Siegel, seconded by Struthers and
passed by the following roll call vote to continue the lands of Lacy, File
#CUP 6-84 to the March 13, 1985 meeting, with the intention to grant approval
of the Use Permit for a second unit. Staff was requested to prepare recom-
mended Conditions of Approval; and look at possible limitation on the
total regular use on bedrrooms. Commissioner Struthers requested the Use Permit
go with the owner and rat the lard.

2. LANDS OF MKHICAO, FILE #VAR 7-84, 25825 Josefa Lane, Request for approval
of Variance for exceeding height limitation as defined in Municipal Code
Section 9-5.503 by approximately three feet (3')
Ms. Lytle referred to her staff report dated February 21, 1985, noting staff
recap ends approval of the variance request to encroach into the height envelop
by approximately three feet. Ms. Lytle indicated the applicant in August, 1984,
applied for and obtained a building permit for remodeling at the subject location,
at that time plans were submitted and were approved as consistent with the height
guidelines; design within the height regulations caused one of the walls of the
addition to be only 5' in height, during construction of the remodeling, the
applicant decided the 5' wall was not functional and proceeded with a variance
application. Ms. Lytle indicated that the roof required finishing do to
weather, thersfore, the addition was Meted with the higher roof line, at
the owners risk, noting the }eight inconsistency is therefore existing at this time.

2. Lands of Machicao
Ms. Lytle indicated staff has determined that required finding 9-5.1107 (b) 1
is supported by the following facts: The existing lot appears to be awkward
in size and shape. The buildable lot area actually suitable for a residence
is approxiretely .75 acres and within this area a building site circle cannot
be inscribed. In staff's opinion, the written application produces sufficient
evidence supporting the raining criteria of the variance findings.
The Public Hearing was then opened and closed with no one speaking for or
against this item.
cannissioner Lachenbiuch indicated the finding for 9-5.1107 (b) 1 should indicate
that the lot is narrow in dimension and predates the Towns standard lot
criteria, and based upon this finding I feel the cannission could go along with
the variance request.
commissioner Struthers indicated there is also another unique factor with this
lot, noting the existing tines, as the applicant would not be allowed to build
a one story without removal of the trees.
MOTION SECCNDED AND CARRIED: Moved by Lachenbruch, seconded by Yanez and
passed unaniously to approve the Lands of Machicao, File #VAR 8-84 on the
basis of the statevent made in staff report dated February 21, 1985, and
discussion by Planninc Cmmission this evening.
3. LANDS OF FEWICK, FILE #'IDI 8-84, Elena Road (Sandis & Associates, Engineer)
4W Request for approval of Tentative Map and Negative Declaration, 2 lots
Ms. Lytle referred to her staff report dated February 21, 1985 noting this is
a public hearing to consider the Negative Declaration and Ttntative Map for a
2 lot subdilvision. Ms. Lytle indicated the applicant proposes to subdivide
the 47.32 acre parcel into a lot measuring 4.34 gross acres and a "remainder"
Parcel neasuring 42.98 gross acres, noting the intent is to create a homesite
for a new residence and the remainder to he reserved as open space under William-
son Act. Certain items related to this subdivision include: Geotechnical
Constraints; Views; Pathways; Fire Safety. Staff recoimends approval of the
Negative Declaration and Tentative Map subject to attached Conditions of Approval
to the February 21, 1985 staff report.
Them was discussion over the requested conditional exceptions as indicated
in the February 21, 1985 staff report, specifically the requirements in Section
9-4.506 (36), staff indicated they recd mend waiving of the required based upon
the intended use of the property. Mr. Scarborough indicated at previous connission
nre ting this item was discussed and it was staff's interpretation that if in the
opinion there is a problem regarding access, etc., that item #36 would be
required and if not it would not be required, noting it was a decision of the
Camnssion to discourage iter #36.
The Public Hearing was then opened.
Mr. Jon Lynch, Sardis & Associates, gave commission a brief history, noting in
June the Fenwicks contacted the City Attorney, he recamended a map be filed to
separate the have site frau the remainder lot which was to be placed in the
Williamson Act. we request the Comdission recomend approval of the Tentative
Map and the applicant be allowed to go ahead with the Site Development process
while going thtangh the recainder of the Tentative Map and Final Map process.
Mr. Lynch indicated they had no objections to the Conditions of Approval and
find the staff report acceptable.

Ca¢mission and staff discussed walking the property with regard to the
location of the pathway, it was suggested this be done prior to the
City Council consideration.
MClTICN SECCNDED AND CARRIED: Moved by Struthers, seconded by Gottlieb
and passed unanimously to recanTend approval of the Negative Declaration
for Lands of Fenwick, File #TM 8-84 to the City Council.
Conmissim and staff discussed the amount of allowed maximan develo t
area this lot would be given under the approval of the map. It ova icated
in order to limit the amxmt the zoning ordinance would need to be an�nded.
There was a consensus amo ng the cmuissim to allow the applicant to
proceed with the zoning and site developrent process prior to the recorda-
tion of the Final Map, however, the building penni.t could not be issued
until that time.
MDTICN SECCNDBD AMID CARRIED: Moved by Siegel, seconded by Gottlieb and
passed unanimously to recamend the Conditional Exceptions requested in
Section 9-4.506 (8), (22), and (36)be granted.
MDTION SECONDED AND CARRIED: Moved by Siegel, seconded by Laohenbruch and
passed unanimously to recmn d approval of the Tentative Nap, Lands of
Fenwick, File 0114 8-84 to the City Council subject to the conditions of
approval of the February 21, 1985 staff report.
MOTION SBCCNDED AND CARRIED: Moved by Siegel, seconded by Struthers and
passed unanimously to advise the City Council the Canmissim recc m rids
approval of the Tentative Map with the intention that the Pathway Committee
shall make a recamendation on the subject map prior to City Council approval.
E. OLD BUSINESS:
1. Antennas
Oamdssicner Gottlieb informed the conmission the subcomnittee has acc
plished criteria, report will be available for next agenda, (Kaufman and
Radlo are putting their own report together). Connissimer Gottlieb indicated
Mr. Padlo would like to he appointed formally to the conrdttee.
F. NEA BUSINESS:
1. Mr. Enright informed camdssion the Site Developrent Committee has made
a recamen3ation that the Landscape Bond be increased to $2,500.00, noting
if commissim feels this is valid, the request will be forwarded to the
city council.

by increasing the bond amunt to $2,500.00.

NEW BUSINESS: (continued)
y 2. Ms. Lytle referred to memo dated February 27, 1985 regarding
guidelines for implementing urgency ordinance #292, noting on
January 30, 1985 the City Council adopted Ordinance #292 as an
urgency interim zoning regulation, requiring a special land use
permit for construction or conversion of structures exceeding a
height of fifteen feet. Ms. Lytle indicated at the meeting a
working c=ittee was appointed and they met on February 26th
to develop preliminary guidelines, noting the committee is cmprised
of Mayor, Planning Commission Chairman and City Manager. Ms.
Lytle indicated the guidelines will be considered by the City C�uncil
at their March 6, 1985 meeting, it was requested that staff refer
these preliminary recmnendations to the Camvission for ccmxents
and any additional suggestions. Ms. Lytle referred to the recom-
mendations, regarding height, bulk, color and siting.
it was suggested Cmmissioners provide their individual convents
prior to the City Council meeting on March 6, 1985.
G. ADJCUF41ZE Tf:
The City Manager indicated the meeting should be adjourned to a
joi rot meeting on Saturday, March 9, 1985 at 10:00 a.m. There was
save discussion among carmissioners as to who world be nhle to
attend.
4. There being no further new or old business, the meeting was adjourned
