Council Chambers.

C. REPORT FROM CITY COUNCIL HEELING OF MARCH 6, 1985:
Camdssioner Siegel reported the City Council waived 3' height limitation
on Machicao variance; approved guidelines for Ordinance #292; waived fees
on Lot merger for Lands of Norton; heard a new procedure relating to
deposit accounting procedures.
D. PUBLIC HEARINGS:
1. LANDS OF LACY, FILE #CUP 6-84, Lot #3, Red Rock Road, Request for
approval of Conditional Use Permit, Second Unit (attached), Continued
from February 27, 1985 meeting
Ms. Lytle referred to her staff report of March 7, 1985 noting at the
February 27, 1985 Commission meeting the subject application was continued
with the intent of approving the Conditional Use Permit, to allow staff
to omplelerecamended conditions of approval. It was asked at that meeting
that staff further look into traffic concerns and potential expansion of
the proposed use, conditions considered to be placed on the use permit which
would limit the number of permanent vehicles allowed on the property
and the number of bedrooms allowed. Ms. Lytle informed cmudssion that
enforcement of these conditions will be difficult or inpracticable.
Commissioners indicated the concern was over the number of cars not the
number of bedrooms. Mr. Gillio indicated there would be a problem with
enforce t and limiting the number of people is thin ground, noting the
Use Permit can expire upon transfer of the property.
The Public Hearing was then opened.
Dr. Lacy, 2420 Bryant Street, Palo Alto, indicated limiting the number
of vehicles to 4 would be adequate for their needs and limiting the
number of bedrooms to 5 is no problem.
The Public Hearing was then closed.
Y0rICN SECONDED AND CARRIED: Mmd by Siegel, seconded by Yanez and
passed by the following roll call vote to grant approval of the Lands of
Lacy, File #CUP 6-84 subject to conditions of approval in the March 7,
1985 staff report as amended. Delete Condition #2 under staff recomrended
conditions and add a new condition which reads as follows: This Use
Permit shall terminate at the time the Lacy's ownership ceases, unless
otherwise renewed by the Town of Los Altos Hills.

4 approval of Conditional Use Permit, Second Unit (attached)
Ms. Lytle referred to her staff report dated March 7, 1985 informing the
commission that the Ctsmiissicn make a :ration to continue the subject Use
Permit application until the applicant is either: 1) granted a variance
to allow for a second unit in excess of 600 square feet; or 2) decreases
the gross floor area of the proposed second unit. Ms. Lytle informed
commission Mr. Davis has indicated that the plans on file may not be accurate.
The Public Hearing was then Opened.
Mr. Davis, 28545 Matadero Creek Lane, informed commission the measurement
of the plans is accurate, noting a solution would be to make part of the
room a closet and not livable area, asking ccmnission to grant approval of
the Use Permit this evening.
The Public Hearing was then closed.
MMCN SFM\TDED AND CARRIED: Moved by Iachenbruch, seconded by Gottlieb
and passed by the following roll call vote to continue the Lands of Davis,
File #CUP 1-85, to allow the applicant and staff to meet and review the
requirements for an attached second unit, so that staff may prepare an
appropriate staff report on the subject application.

3. LANDS OF PLOUGH, FILE #VAR 8-84, 24692 Olive Tree Court, Request for
approval of variance for garage to encroach into front and side yard
setbacks.
Ms. Lytle referred to her staff report dated March 7, 1985, informing the
commission this is a variance request to encroach into the front yard setback
by a maximum of ten feet and side yard setbacks by a maximum of six and one-
half feet. Ms. Lytle gave commission a brief background on the subject
property and the applicant's request.
The Public Hearing was then opened.
Mr. Kenneth Plough, 24692 Olive Tree Court, inforned commission he needed
guidance in that the remodeling construction will also need a variance for
an encroachent into the setback for the roofline, asking commission if they
could also grant approval for that portion with the current application on
file?
Ms. Lytle informed commission it would be advisable to continue this application
to allow staff and applicant time to go over their proposal and care back to
camdssion with an appropriate staff report and conditions.

4. LANDS OF BIIUKCI, FILE #CUP 7-84, 26220 Moody Road, Request for
approval of Conditional Use Permit for operation of a non-profit
recreation facility at Adobe Creek cadge Property for 300 member-
ship (Referred back to Conmission from City Council at their
February 20, 1985 meeting)
Commissioner Carico informed commission and audience five letter were
received today with regard to this application; 1 in favor; 4 against,
noting due to the length of the letters and the number of people in
attendance this evening, the letters will not be read aloud, they will
be noted into the record.
Letters received: March 12, 1985 from Mr. & Mrs. Du , 25900 Elena Road;
in favor; March 13, 1985 from Mrs. Shirley Handley and Mrs. Mary Byrd
in opposition; March. 13, 1985 from Mr. and Mrs. Flung in opposition;
March 13, 1985 from Mr. and Mrs. Bennett in opposition; and March 13, 1985
from Mr. Richard Oliver in opposition.
Commissioner Carico requested during the public hearing that the audience
keep their discussion limited to 5 minutes, and to try.. and keep the infor-
mation new and not repeat. Commissioner Carico indicated after the public
hearing the comnissian will hold a discussion and then break to allow
staff time to prepare written recommendations.
Ms. Lytle referred to her staff report dated March 7, 1985 indicating this
is a public hearing to consider the application for Conditional Use Permit,
for operation of a non-profit recreation facility on the Adobe Creek Lodge
property. The operation of the facility will be conducted by a private
non-profit corporation, and proposed use of the facility limited to 300
licensee members. Ms. Lytle reviewed past actions, noting the Commission
at their January 23, 1985 meeting adopted a motion to require an FIR for
the project, based on environmental impacts identified in the area of
traffic and noise and continued the application until the FIR is prepared.
an January 25th the applicant filed an appeal of this decision to the City
Council, Council held a public hearing on February 20, 1985. The Council
basal partially upon a preliminary analysis contained in an Ad[Rinstrative
Draft EIR, which slowed no significant unmitigatable environmental impact
in the area of traffic and noise likely to occur as a result of the larger
1,750 membership project, the Council adopted a motion to adopt a Negative
Declaration for the subject application and directed the Commission to continue
their public hearing to consider the subject application. Ms. Lytle recommended
the Commission; 1) adopt a motion making the required findings; and 2) adopt
a motion granting the Conditional Use Permit, subject to the Conditions of
Approval attached to the March 7, 1985 staff report. Ms. Lytle indicated
if the co ndssion determined that one or more of the necessary findings
can not be node, it is recur: ended that they also find the site to be inapro
priate for recreation use.
Mr. Gillio informed commission this is an application for 300 licensee
memberships, noting the Council at their February 20, 1985 meeting adopted
a negative declaration thereby deleting the need for an EIR for this applica-
tiom. The Commission should hold the public hearing, hearing both pro and
con and then make a reammndaticn to the City Council who will make the
final decision. Mr. Gillio indicated whatever the ultimate decision is
it should be made on specific findings, noting the Use Permit may be
issued only on criteria based in the zoning chapter of the Municipal Code.
Mr. Gillio recamended opening the public hearing (hearing pro and con) and
then close the public hearing and address specific questions at that time.

V Commissioner Carico questioned the interim use permit, noting it has
been indicated prior that the 300 membership is not marketable. I£ the
Comnission recoxmmended approval of this use permit, We would like to
be sure it did not mean we would approve the 1,750 membership.
Mr. Gillio indicated the use permit would be limited duration, and should
reconvend a time limitation be placed upon the use permit, and that each
licensee member be given a note regarding such. It is reccma ded that
the Cmmission consider issues raised by the public, look at facts as
they relate to property and how they relate to this application.
Mr. Scarborough indicated if this is perceived as an interim use permit
it does not guarantee that it would lead to the larger 1,750 membership,
noting it does not give the riot or privelege to go ahead.
The Public Hearing was then opened.
Mr. Paul Meyers, Attorney representing Mr. Bellucci informed commission
this is a stand alone application, noting this use is loo intensity
conforms to the General Plan as it is recreation use. Mr. Meyers indicated
the use is different from that in the past, noting there would be no
alcoholic beverages, however we would like to have a snack bar on the
premises. Mr. Meyers referred to the recommended conditions of approval,
noting they would like to have changed conditions 6.B.1., change to 10;
6.B.2., change to allow snack bar with no alcoholic beverages; B.B., prior
to recordation to placement of pathway be inspection by the City Engineer;
9.B., geotechnical report has been prepared and submitted and ask that
this condition be made 160 days after use permit is granted; 10.A., a
connection already exists, we'd like 180 days to seperate buildings;
10.B., no sealing of wells; 10.C., if required by Health Department only;
ll.A., plan has been submitted for creek change to 180 days; ll.B., before
use permit be granted. Mr. Meyers indicated he felt the necessary findings
could be met and asked comission make a recamendation to City Council in
favor of granting Use Permit for 300 membership.
Mr. David Proft, 26271 Moody Road, gave commission a brief background review
of the Adobe Creek Lodge property, referring to Resolution #1166 ordering
the clubs closure in December, 1978. With regard to the General Plan Mr. Proft
indicated the map is dated 1976 and is past due in updating, asking cmmission
not to take any action until the General Plan is reviewed and general aspects
of this request be reviewed at public hearings. Mr. Proft also spoke on
concerns over the amount of traffic on Moody Road, with respect to the area
where slide occurred in storm of 1982/83 winter. mr. Proft further spoke over
concerns of noise generated by the use of the club, noting this is a very
sensitive canyon, where noise will adversely effect the adjacent neighboring
properties, indicating a subdivision would create less of a nuisance with
regard to noise levels. Mr. Proft asked that the camassion deny the subject
use permit based on these concerns.

♦: The following residents and their representatives addressed the Commission
in opposition to the proposed recreation facility at Adobe Creek lodge
for the 300 mambership Use Permit. The residents and their representatives
expressed their concerns regarding the following issues: traffic, noise,
flood plan, safety, non-conformance with the 7twm's philosophy on rural
character, amount of allowed and existing development area with regard to
tennis courts, paving, etc., and potential increase in police problems.
Some of the residents felt the property be re -zoned to be residential
instead of recreational use.
Mrs. Judy Zubriggen, 11811 M,rietta Lane; Mr. Bob Poole, 26041 Chapparal
Way; Mrs. Linda Sollers, 12345 Murrietta Lane; Mr. Murray Horton, 26000
Alicante Lane; Mrs. Elise Wilson, Moody Road; Mr. James McCleery, Moody Road;
Mr. Fred Pilster, 12002 Old Snakey Iniad; Mrs. Maydan, 12000 M,rietta Lane;
Mr. Gene Smith, 26950 Moody Court; and Mr. Steven Hunton, 11911 Marietta Lane;
Mr. Tun Oxman, Attorney, 650 California Street, San Francisco; and Mr.
Malcolm McCord, Attorney, 30 E1 Portal, Sausalito.
Mr. Gay Pang, 12025 Moody Springs Court, expressed concerns over traffic
and drainage issues, referring to data that he had prepared which doesn't
mesh with that of the Draft EIR prepared for the 1,750 membership Use
Permit. Mr. Pang informed Co mnission he is a Traffic Consultant and Engineer.
Mr. Pang indicated he had performed a report in 1983 for the Town with
regard to realignment of Moody Road and E1 Monte , referring to accidents
and safety. Mr. Pang questioned if actual field counts were performed?
Mrs. Mari' Steers, 11641 Buena Vista Drive, spoke in favor of the proposed
re -opening of the property, noting a comparison to that of the Palo Alto
Country Club.
Mrs. Irma Goldsmith, 27830 Elena Road, informed Commission of the importance
of the grave of redwood trees and the preservation thereof, asking that
Commission see that each of these special trees be protected.
Commissioner Carico questioned Mr. Meyers if the 300 nembership is one the
applicant can go ahead with and how the Town stands with regard to those
300 members. Mr. Moyers indicated the fee would be nominal for applicants,
noting it is our intent to gain time in applying for this use permit, and
it might be desirable to give the applicant a time limit and we would give
notice to the 300 members in writing.
Mr. Scarborough in .response to questions over the allowed MDA, noted staff
has not done a review of the existing and allowed MDA calculations, as it
doesn't concern this Use Permit application. Mr. Scarboraigh further noted
there is no proposal to increase drainage, no increase in development, however,
staff does have some concerns over existing facility and noted improvements
would be required. With regard to Mr. Pang's discussion regarding the traffic,
Mr. Scarborough indicated staff does have considerable concerns over the
figures in the Draft EIR, but we do think it is adequate per,the trip
generation, noting as pointed out in the staff report the traffic voLmre
( would be exacerbated.

Commissioner Siegel indicated he had come to the conclusion to vote against
the subject Use Permit, and that the Connissioners should not be impressed
by the fact that there are tennis courts and pools now not in use, noting
at one tine the Adobe Creek Indge was a very popular resort, but now
residences have encroached into the area and itis not so popular. Residences
would not impact street system as much as the club would. Mr. Siegel noted
the 300 nembership would not make a go of it, and the pressure to increase
the membership to 1,750 world be great, noting an appropriate use of the land
would be for residential. Camdssioner Siegel indicated the first finding
regarding siting can not be net.
OomAssioner lachenbruch indicated he agreed with much of what Owmissioner
Siegel said but with a different feeling, noting his concern is that the
review for the 300 m abership is difficult with the material supplied and
requested we look further into concerns over traffic. With regard to infor-
mation supplied by Mr. Pang this evening, Mr. Iachenbruch requested that
doaamntation be presented for review by the Cx ssion, noting as we do
not know what the impact is, we do not knew what to compare it with. With
r regard to specific findings, Mr. Iackenbruch indicated if the traffic study
VC natios were doubled it would be substantial, noting there is no technical
support for finding #4; noting he also is not sure that finding #1 siting is an
appropriate use and at this time don't know in detail what the residential use
immpact will be. Mr. Iachenhruch expressed concern over the fact that this
300 manbership application is not economically viable, noting this would not
be goad planning. Mr. Iachenbruch indicated he could not confidently make
finding based on information supplied for the fourth required finding.
Commissioner Yanez inforned cannission he went out and spoke with all neighbors
surrounding and adjacent to the property, my findings have been sulmiarized
by the residents this evening. Nr. Yanez indicated he felt Mr. Bellucci has
tried to clean up the property, noting we should decide whether or not
Belluoei should use the property as recreational or not.
Camdssicner Gottlieb questioned staff on time number of potential lots which
could be subdivided with this property. Staff indicated a possibility of 11.
Commissioner Gottlieb questioned applicant if they had 50 potential manbers?
Mr. Meyers indicated No. Commissioner Gottlieb questioned since there is no
more development proposed would there be an increase in water? Staff responded
No. Connissioner Gottlieb indicated she felt the property was beautiful,
indicating she felt a use such as Fremont Hills Country Club could be appropriate,
but indicated concerns over the proposed use for only a 300 membership and then
not be able to make agreeable findings for the 1,750 mabership at a later date.
Commissioner Gottlieb indicated she could like to see more figures with regard
to traffic concerns raised this evening.
Comnissiamer Struthers stated she agreed with everybody, noting with regard to
finding #1, this is an area that doesn't have recreation facility, noting the
streets have never been adequate, noting with the removal of school buses for
transportation there has been an increase in traffic on Moody Road. Commissioner
Struthers felt the proposed use would have an adverse effect on the neighbors
with regard to noise, although noting this is the least proposed use we could
tope for, however, she felt it seems to be set up for failure. Unforntunately,
Commissioner Struthers noted the applicant hasn't tried to care up with a
little larger number and a little less, which means there will be a subdivision
and no more open space.

Commissioner iacherd=h indicated he agreed with rich of what Comnissioner
Siegel said but with a different feeling, noting his concern is that the
review for the 300 membership is difficult with the naterial supplied and
requested we look further into concerns over traffic. With regard to infor-
mation supplied by Mr. Pang this evening, Mr. lachenbruch requested that
docmentation be presented for review by the C mnission, noting as we do
not know what the present traffic is, we do not ]now what to oupare the
projected traffic with. With regard to specific findings, Mr. Lachenbruch
noted there is no technical support for finding #4; he also noted that at
this time we don't know in detail what the residential use impact will be
and this would influence his finding on #1. Mr. la dwnbruch expressed
concern over the fact that this 300 �rship application is not economically
viable, noting this would not be goad planning. Mr. Iachenbruch indicated
he could not confidently make a positive finding based on information supplied
for the fourth required finding.

4/ Commissioner Carico indicated she felt there would be an impact on the
canmurity with this use, noting we have not had the kind of information
we need to make findings in favor of granting this Use Permit. Commissioner
Caricoindicated the General Plan stated this property is zoned for
recreational/residential; however, it does not state what kind of
recreation. With regard to the required findings: #1, proposed facility
is in narrow canyon surrounded by increased residents, since the clud
was last in operation (cannot be mitigated). #3, Moody Road is a narrow
winding road that would increase traffic and applicant did not prove that
increase possibility of accidents could be mitigated, therefore safety
would be a definate problem to residents and all who presently use Moody
Road (cannot be mitigated). #4, Noise cannot be mitigated satisfactorily.
Commissioner Carico indicated there is no comparison as to Palo Alto Country
Club and Adobe Creek as well as FraM nt Hills, indicating it saddens her
because Adobe Creek is a beautiful piece of property.
After each Camuissioner gave a brief statenent of their concerns and convents
on the subject application, they adjourned for staff to cmm1pose a list of
findings based upon their statements.
MOTION SECONDED AMID CARRIED: Moved by Siegel, seconded by lachenbruch
and passed by the following roll call vote to recomannd to the City Council
that this Use Permit, File #CLIP 7-84, lands of Bellucci be denied based on
the fact the applicant has not demonstrated that this application can meet
required findings specifically 1, 3 and 4. The findings are as follows:
1. As the result of residential development of the surrounding property
the proposed use is not properly located; 2. Because of numerous safety
problems on the existing roads including speeding and driveways with inade-
quate sight distance the roads are not adequate to carry the traffic pro-
jected to be generated; 3. Because of nuisances associated with public use
of property including littering, speeding, tresspassing and noise the
propose] use will adversely affect the abutting property; and 4. The proposed
use is not reasonably compatible with the low density single family
residential development of surrounding properties.

Commissioner Yanez indicated he abstained because of traffic problem,
noting we've received a recommendation for approval, and he felt he couldn't
second guess. Yanez indicated he thought this was a 300 membership that
would lead to 1,750 membership review.
Commissioner Gottlieb indicated she abstained because the site can be an
adequate recreation facility, however, she could not vote on all three
findings.
Cortnissioner Carico indicated she felt the applicant provided enough inform -
tion, however there was not adequate information on traffic and safety

Caw Mr. Gillio informed Commission they should send this motion and the vote
on to the City Council for their review, noting the applicant has a right
to have this application go on speedily, indicating the Commission has
conducted two Public hearings on this application and I recommend it now
awe on to the City Council.
The applicant and audience were informed the City Council will schedule
this item for public hearing for their April 3rd Agenda.
5. LANDS CF CREF.KSIDE COURT, FILE #'lM 11-84, Page Mill Road (Brian, Kangas,
Foulk, Fhgineers) Request for recommendation of approval of Tentative
Map and Negative Declaration, 6 lots
Ms. Lytle referred to her staff report dated March 8, 1985, noting this is
a public hearing to consider the Negative Declaration and Tentative Map
for the Lands of Creekside Count, a six lot subdivision. Ms. Lytle indicated
the applicant proposes to subdivide 9.57 acre parcel into six lots, noting
the road will require a creek crossing, all existing structures on the
property shall be removed. Ms. Lytle indicated the proposed subdivision
complies with State and Local Subdivision Ordinance requirements, issues
related to this subdivision include: 1)Geotechnical Constraints; 2) Vege-
tation and Wildlife Habitat; 3) Pathways; 4) Storm Drainage; 5) Creek
Crossing; 6) Street name; and 7) Illustrative Lot Development Plan. Staff
recommends approval of the Negative Declaration and Tentative Map subject
to conditions of approval attached to the. March 8, 1985 staff report. Ms.
Lytle indicated there is a requirement placed upon this subdivision as
a response to Department of Fish and Game for the placement of..a fifty foot
natural conservation easement along both sides of the creek, noting the
measurement would be from top of bank, due to extremely valuable riparian
habitat for the wildlife in this area.
The Public Hearing was then opened.
Mr. Robert Foulk, 27435 Natuna Road, Owner and Engineer, indicated they
agree with most of the staff suggestions, with the exception to the
conservation easaent, indicating he did not think it fair that other
subdivisions around town didn't have to do this, noting he did not think'
coyote bush is something an owner would like to have in his yard. Mr.
Foulk referred Commission to the aerial photograph of the property which
shows brush and trees in certain areas, and grass lands over much of
lots 5 and 6. With regard to the street name, Mr. Foulk requested it
be changed to Court instead of Drive. Speaking of Lot #5, Mr. Foulk
indicated he would liketo be able to have a bridge which adjoined the
lot together and the way the conditions are spelled out it would not
allow a bridge in this area to cross over the creek, noting there is an
old existing bridge in that area now.
Mr. Jitze Couperus, Page Null Road, asked commission what riparian wildlife
was, and asked if there were some way to limit the size of the proposed
hones that would be built within this subdivision.
Mr. Stark, 13686 Page Mill Road, supported Mr. Foulk in that on Int #5
there is much grass lands and brush not acceptable, spoke for a Mr. Bauer
w1m could not be present at this meeting, noting his concerns over
keeping some of the brush on Lot #6 for privacy.

Mrs. Vuci.nich, 13826 Page Mill Road, expressed concern over drainage,
informing commission their property is a catch all for water. Fie ask
for as little disturbance as possible to land along Moon Lane.
Mr. Ewald, 13830 Page Mill Road, concerned over drainage and runoff,
noting he is not quite comfortable with note that no more drainage
will be produced. Mr. Ewald also spoke for Mr. Bauer who could not
be present, over his concern with earth slide which recently happened
and asked for protection and that the area be checked for possible
slides. Mr. Ewald also spoke of drainage concerns from Lot #6, he
indicated he has pictures of water running now after small rains, and
the past winters ie, 1982/83 storm.
CmTaissioners discussed concerns over drainage and the requested amount
of land for the conservation easement. Mr. Enright indicated the
marks on the Tentative Map are a result of the Roads and Drainage
connents, shaving water flow.
Due to the late hour, the Cmvission indicated there was an awful lot
of items that still needed to be discussed and suggested that this item
be continued for further discussion.
MOIICN SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Siegel
and passed unaninmsly to continue the lands of Creekside Court, File #TM
11-84, to Friday, March 22, 1985 at 4:00 P.M. It was requested that
staff contact the Department of Fish and Game with regard to the
boundaries for the conservation easement and clarification of their
intent.
E. OLD BUSINESS:
1. Subcommittee Report on Antennas
This item was continued to the April 10, 1985 Planning Commission meeting,
those who were in attendance for this item held a study session in the
conference roan at Town Hall, to prepare for that meeting.
F. OID BUSINESS:
1. Mr. Scarborough questioned commission on the intent of the Site Approval
Ordinance, Section 9-2.09(b) what regulates whether or not an item
goes through this process?
Commissioners suggested if staff had concerns over alterations they should
have the Site Development Committee make a preliminary .review.
