Chairman Yjuranoff called the meeting to order at 7:05 p.m. in the Town Hall
Council Chambers.

1. Approval of Minutes from the planning Ommission meeting of March 13, 1985
was cont:inued to the Consent Calendar for the April 10, 1985 agenda as scme
of the Cournissioners stated they had cc�ents regarding the Lands of
Bellucci, Conditional use Permit, Pile #CUP 7-84, on page seven. Mr. Scarborough
indicated the Commissioners who wished to make ccuments should put their
concerns in writing and they will be incorporated into the minutes at the
April 10, 1985 meeting.
MOTION SECOMED AND cApRIM: Moved by Siegel, seconded by Yanez and
passed unanimously to oontinue the approval of the March 13, 1985 Planning
Comnission minutes to April 10, 1985, which will allow the Counissioners
time to correct their connents.
MOTION SBCONDED AND CAFRIED: Moved by Struthers, seconded by Siegel and
passed unanimously to approve the remainder of the Consent Calendar, specifically:
1. Setting Public Hearings for April 10, 1985:

C. REPORT FROM CITy COONcTL =ING OF VARCH 20, 1985:
Ommissioner Yanez reported the City Council received a withdrawl of Lands of
Bellucei CUP for the 300 mffobership; approved a Site Development Permit Extension
kw for the Lands of Keenan; approved Special Land Use Permit for Lands of Webster
pool house; approved Lands of Fenwick Tentative Mzp; held public hearing on
mailboxes and manuments within Town right of way. Mr. yanez informed the Comis-
sion the Site Development Ordinance will be coming back to Oxmission for review
very shortly; as will the Housing Element Draft from Connerly & Associates.

Mr. Enright referred to his staff report dated March 20, 1985, noting this
application predates the requireaunts of Ordinance #292, and #295, Special
land Use Permits. Mr. Enright infonned the Cmmission the applicant first
suhnitted plans for a new residence which required a building pad to be
created that would haw resulted in a nkodmant of 111 cut, noting the Site
De�elopment Corrattee continued the hearing on January 22, 1985 to allow the
applicant to redesign the house to better fit the sloping terrain; noting
the new 9_ihnittal ra�sed the pad elevation 2', but did little else to miti-
gate the impact of the house on the site, informing the Cannission the
Site Development Comnittee on March 5, 1985 referred the proposed residence
to the full Coamission for review. Mr. Enright indicated the applicant was
given the option of retaining the original design or presenting a new, design
to the Comnission, noting a new design was submitted for review which requires
less of a physical alteration to the terrain. Mr. Enright reviewed the zoning
data on the subject lot, grading and drainage concerns and the suggested
conditions of appzrwal as listed in the March 20, 1985 staff report.
Conudssioners and staff discussed the size of the proposed residence in rela-
tion to ex�sting ha�es on Moody Spr�ngs Court, the Pathway Coamittee 's request
for a Type IIB pathway, which the applicant has agreed to construct; and the
culvert existing for drainage concerns.

Mr. Gay Pang, 12025 Moody Springs Court, Mrs. Carol Phy, 25616 Moody Road, Mr.
David Proft, 26271 Moody Pzud, Mr. Steven Hunbon, 11911 Ylarietta Lane, Mr. Ed-
ward 11pling, 11853 Yfurietta, Lane, Mr. Hassain, 12014 Moody Springs Court, all
spoke urging Convdssion to deny the Site Developtent Permit based on the fol-
lowing reasons: proposed resider�ce is out of character with the existing
neighborhood, size, bulk, and height concerns, Preservation of views from other
properties, and grading and drainage concern s over the ex�sting culverts and
nore drainage from the proposed residence nuking more of an impact upon Moody
Poad.
Mr. Richard Shockley, 2577 Westford Way, Mountain view, Omner/D�loper, inforned
cogmission they have carefully gone over the regulations they received from the
Town and based their house design upon that information, noting the latest prop-
osal is 1,200 square feet less than original submittal, also indicating they
have reduced the dewlop�t area to allow a swinoing pool site. Mr. Shockley
indicated he did not understand what is mant by "house is out of character",
noting it is just larger than those houses existing. Mr. Shockley asked the
conmission to gi� specific reasons as to why they did not approve this proposal
if they do decide to vote against this design.
The Public Hearing was then closed.
cmTnissioners discussed the proposed residence, noting the closeness to a scenic
roadway, i.e., M�cdy Road, obtrusiveness of the size, height and bulk of this
kw proposal in relation to existing residences on the cul-de-sac.
Yr. Jerry Clenents, Engineer, asked carmission if they would fawr a proposal
that cut down more into the land, (i.e., Anderson property on Moody Road),
thereby creating a bank upon which they would plant pine trees for screening
of the residence from Moody Road?

MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Yanez and passed
unanimously to deny without prejudice the Site DevelOpMont Permit for the
lands of Shockley, as the proposed residence is inappropriate for the site,
(i.e., size and bulk of structure is not in harmany with the neighborhood),
and that this proposed residence is located adjacent to an interconmanity
scenic roadway.
Guidelines were suggested to the applIcantj 1) drainage: the proposed structure
will exacerbate an existing drainage probim; and 2) the size of the driv,�Y
should be reduced.
2. LANDS OF ONLMOD FARMS, FILE #CUP 8007-75, 24970 O'Xeefe Lane, Annual
Review of Conditional Use Permit and amendment thereof, (continued from
February 13, 1985 meeting)
Ms. Lytle referred to her staff report dated March 21, 1985, noting this item
,was before the Conatissim at the Februaryl3, 1985 meeting, at that tine it
was noted owlwood Farms was not in ccnpliance with conditions 5 and 7.c.; and
that condition 7.a. seemed inappropriate for this facility. Ms. Lytle indi-
cated Ow1wood is now in compliance with mnditicn 5 and 7.c.; with regard to
condition 7.a., the Health DeparbTent was contacted for comments, and was
acknowledged that the condition was inappropriate for this facility because
the historic use of the stables preceeded current environmental health regula�
tions regarding drainage into creeks, thereby suggesting the condition be
4W amended (as in staff report dated March 21, 1985) and a new condition be
added (7.d.) regarding a backflow Prevention device. Staff recommended that
the planning Cminission approve the renewal of the Conditional Use Permit with
amendments as listed in the March 21, 1985 staff report.
The Public Hearing Was then opened and closed with no one speaking for or
against this item.
MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by Gottlieb and
passed unanimously to approve the Annual Review for Lands of Gw1wood Farmst
File #CDP 8007-75 with amandVents as follows: Condition 7.a. to be amended
to read as follows: All drainage from stables, carrals, pens, barns, etc-,
into a natural drainage course shall be minimized. No additional facilities
my be added to the property that will increase the existing level of drainage
into the creek. Condition 7.d. be added as follows: A backflow prevention
device (pressure type vacuum breaker) shall be installed at the high point
of the water line feeding the barns upstream of the point at which the line
enters the first burn.
3. LANDS OF EASTWICK, FILE #CUP 8029-78, 25231 La Rena Lane, Annual Review
of Conditional Use Permit (continued from February 13, 1985 meting)
Me. Lytle referred to her staff report dated March 21, 1985, informing COUnlissim
this annual review was brought before the Commission on jmsry 9, 1985 and
continued to the February 13, 1985 meeting in order to allow the new owners
an opportunity to meet with staff and review options available to them. A
copy of the notice sent to the tennant was forwarded to conTaission for the
tennant to vacate the prem:Lses by July 1, 1985. Ms. Lytle indicated the
owners met with staff on February 19, 1985 and reviewed the options available
regarding this Use Permit, noting Yx. East�wick chose Option #3 as described
in the staff report, which is revocation of the existing Use Permit and
termination of the structure as a secondary dwelling.

MTr. Eastwick, 25231 la Rena Lane,informed commission he is in total agreement
with staff report, and requested a copy of definition of an accessory structure.

passed unanimously to recommend to the City Council revocation of the lands
Of EaStWiCk, Conditional Use Permit, File #CUP 8029-78.
4. LANDS CF BERRY HILL, UNIT II, FILE #TA 9-84, (Dexter Ahlgren, Engineer)
Request for recommendation of approval of Tentative Map, 7 lots (continued
from December 12, 1984 meeting)
Ms. Lytle referred to her staff report dated March 22, 1985, noting this
tentative map was before the commission on Decen�ber 12, 1984 for an eight
lot subdivision, a consensus was reached at that meeting that the road right-
of-way should be increased for Berry Hill lane, bringing it into conformance
with subdivision ordinance standards and reducing the number of lots allowed
in the subdivision, it was also recomended that the lots be redesigned so
all lots would be served from a single public cul-de-sac, thereby reducing
the impacts to Berry Hill Ime. Ms. Lytle indicated the applicant submitted
a rev�sed tentative map for a 7 lot subdivision on January 24, 1985, noting
4W the proposal is designed to serve all lots from a single public cul-de-sac,
and the applicant has requested a wa�ver from the req t for the 60'
right-of-way on Berry Hill Lane. Ms. Lytle reviewed visual concerns with
the proposed subdivision and grading concerns over proposed grading as part
of the subdivision improvements. Staff recommended the Planning Commission
take one of the following actions: 1) continue the public hearing and req=e
the applicant to redesign the subdivision to include 60' right-of-way; or
2) adopt a mDtion recommending the City Council waive the requirement for
a 60' riqht-of-way and re commen d approval of the Tentative Map subject to
conditions of approval in the March 22, 1985 staff report.
Commissioners questioned staff over concerns of stockpiling and siting control
of all 7 lots, asking if the City Engineer was comfortable with the amount of
grading proposed? Mir. Enright indicated the terram has been drastically
altered by the use of property as farm, noting the applicant has indicated
a waiver in terms of measuring height of the proposed residences.

Yx. Lorin Nelson, Gerard & Lambert, Inc., read a letter dated March 26, 1985
addressed to the Ch of the Planning Commission from Alm G. Lambert,
President of Gerard & Lambert, Inc., with respect to the March 22, 1985 staff
report and the conditions of approval.

Mr. Enright suggested the Comnission disc�uss the matter of the 601 road right-
of-way prior to discussion of the subject tentative map and conditions of
approval.

taw CaTmissioners discussed the need to bring Berry Hill Lane up to standards,
as this is a very intense develcFment and wry visible from off site,
suggesting the applicant redesign the subdivision to include the 60' right-
of-way. Comissioner Lachenbruch suggested in the re -design that the
patl�y be separated from the traveled roadway by 10'.
Mr. Dexter Ahlgren, Ehgmeer, requested the CmTnission make a decision this
evening on the subdivision, as they will appeal the decision to the City
Council.

passed unanimously to deny the Lands of Berry Hill, Unit II, Tentative Map
File 41M 9-84, because of inadequate road right-of-way for Berry Hill Lane
as per Los Altos Hills Municipal Code Section 9-4.703 (a).
5. LANDS oF amwoci, FILE #CUP 3-80, 26220 Moody Pzad, Annual Review of
Conditional Use Permit, Secondary Dwelling
M. Lytle referred to her staff report dated March 21, 1985, recommending
that the Planning Ccnmission take me of the following actions: 1) Continue
this hearing for 30 days to allow the owner time to ccrrply with the terms of
the Use Permit; or modify the conditions of the Use Permi-t to allow for
occupancy by relatives and caretakers, and allow the kitchen facilities.
Ms. Lytle also mccnTrended that ccmission should determine if condition 10.d.
was necessary. M. Lytle informed Comnission ordinances that were in effect
40 at the time of granting of this Use Permit did not allow secondary units on
non-subdividable lots to have kitchen facilities, or to be occupied by more
than one family. Ms. Lytle indicated at the time of this review, staff
found that the second unit contains kitchen facilities and is occupied by
two couples. Ms. Lytle also noted staff found that the owner is not in
conpliance with condition JO.d which requires a Site Development Conmittee
approved landscape Plan, noting a plan has not been submitted to the Town.
The Public Hearing was then opened.
W. David Bellucci, 26220 Moody Road, gave comnission a brief background
noting the property was built in 1932 as a private estate which was comprised
of several buildings for caretakers, etc., also indicated the property is a
historical site, #17 Los Altos Hills. Mr. Bellucci asked camnission to grant
condition #2 in the March 21, 1985 staff report, noting the occupants of the
cottage are his son and daughter and a caretaker for caring for and watching
the property m his absence, noting as them are 62 acres he can't handle
without assistance on the property.
Mrs. zurbriggen, 11800 M�rietta Lane, Mr. David Proft, 26271 Moody Road,
Mr. Steven Hunton, llqll Ylurietta Lane, Yr. Gone Smith, Moody Court, all
spoke to Counission with concerns over the nunber of occupants and use
of kitchen facilities; concerns of condition regarding landscapingr noting
it is necessary and carpletim of existing fenoe.

and passed by the following roll call vote to amend the Condit�onal Use Permi-t,
Lands of Bellucci, File #CUP 3-80, that this Use Permit be modified subject
to condition that fence be completed and landscape screenmg be provided

between the cottage and fence to soften the impact as viewed from Property
to the wast. The Landscape Plan proposed is to be reviewed by the Site
Development Committee. This Use Permit is continued for review by the
Planning Commission for thirty (30) days; these conditions shall be cam -
plated prior to granting approval of the Use Permit.

6. LANDS OF SMiNI/KEENAN, FILE #FM 2-85, Lot Line Adjustment, Lots 16 and 17
Saddle Court, Tract 6297
Ms. Lytle referred to her staff report dated March 21, 1985, noting the
proposed Lot Line Adjustnent is between two lots located on Saddle Court,
Lots 16 and 17, 'Tract 6297, noting lot 16 is developed with a single family
residence, while Lot 17 is currently undeveloped. Ms. Lytle informed the
ccavLission the request is to adjust a lot line between the subject lots in
order to correct a zoning violation which resulted from the construction of
a covered pool addition to Salm's residence, the error was discovered during
the final construction phase, and a survey revealed that the covered pool
under construction encroaches into the setback by approximately 10 feet.
Ms. Lytle indicated the lot line will haw only a minor effect on the slope
density and maxim= development area requixarents of each lot, noting the
tentative map for lot line adjustment submitted conforms with local subdivi-
sion ordinancs� requirements, and no issues of canoern were identified by
staff in the review of this application. Ms. Lytle reccnTnended that the
Planning Commission adopt a =tion approving the Tentative Lot Line Adjust-
ment for the Lands of Sanhi/Keenan subject to the conditions in the Mbrch 21,
1985 staff report.
The Public Hearing was then opened.
Mr. Alan Huntzinger, Civil Engineer, asked cmTaission to approve the subject
lot line adjustment.

Committs,e, it was indicated the Chairman of PatlDay Committee, City Engineer
and applicants meet to resolve the concerns of location of pathway.

E. DID BUSINESS:
1. Interpretation of Site Approval ordinance, Section 9-2.09
46W Ms. Scarborough referred to his staff report dated March 22, 1985, indicating
the Town 's Site Approval ordinance provides that the develorment of an existing
lot created more than ten years ago must receive site approval, noting our Site
Approval process is basically the same as our subdivision process and therefore

1. Interpretation - Site Approval (continued)
%211 is expensive, time consuming and requires detailed engineering and geotechnical
work. Ms. Scarborough noted the ordinance does not define the term "alterations",
asking the Commission to provide an interpretation to staff so that the ord inance
will be administered consistent with the CmTnissim's views. Mr. Scarborough
indicated the CmTnissian should state the term if desired, alteration applies
only when less than "x" percentage of the existing house total floor area is
altered or when the structure is increased by less than "y" percentage of the
existing house.
Cannission and staff discussed if the new Site Development Ordinance would
address alterations with regard to off site improvements, (i.e., fire hydrants,
Conservation Easements, pathway dedicatians, any aspects regarding health and
safety, preservation of trees, and control of building siting) at the Site
Development process.
COURissimer Kurmoff indicated he felt a need for Site Approval as the older
lots in Town are much less restrictive.
Mr. Kenneth Pastzof, 13015 Robleda Read, informed Camnissica historically staff
has treated alterations strictly through site Development process and on an
alteration which does not alter the perimeter staff handled at building department
stage. Mr. Pastrof noted perhaps the Camdssion would want to reconnand to the
City Council an urgency ordinance in the interim of Preparing a new ordinance
which would allow Site Approvals to be reviewed at the Site Development stage.
MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by Gottlieb and
4W passed by the following roll call vote to request the City Council adopt an
urgency ordinance which would allow site Approval requi rements to be handled
through the Town's Site Development Process, powers of Site Approval would
thereby be given to the Site Development Committee.

unanimously to define "x" as 50% and "y" as 50%.
MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Lachenbruch and passed
unanimously to rescind two previous motions and approve an interpretation of the
Site Approval term "alteration" as per the City Manager's reeammaadation, i.e.,
When less than 25% of the existing house total floor area is altered or when
the structure is increased by less than 25% of the existing house it uould require
Site Development Process approval. All new residences on lots over 10 years old
would still require Site App rov al p roc ess.
MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by K=anoff and passed
unanimously to direct staff to review the Site Approval process and prepare neces-
-sary amendments to the existing ordinance.
