A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Carico, Gottlieb, Struthers, Yanez & Chairman Kurano£f Absent: Coanissioners Lacffinbruch and Siegel Staff: George Scarborough, City Manager; Michael Enright, City Engineer; Nancy Lytle, Staff Planner; Leslie Mullins, Secretary Item Panoved - B.1. Lands of South Fork Associates, File #SA 6-84 Cmudssioner Gottlieb requested the minutes of April 10, 1985 page eight include the roll call for item F.3. MOTION SECONDED AND CARRIED: Moved by Gottlieb, seconded by Yanez and passed unanimously to adopt minutes of April 10, 1985 as amended. Connissioners Carico and Struthers abstained from approval of minutes, as they were not present at that meeting. C. REPORT FROM CITY COUNCIL MEETING OF APRIL 17, 1985: Continued as Camiissicner Lachenhn,ch was not present to give report. 1. LANDS OF PALO ALTO UNIFIED SCHOOL DISTRICT, FILE #TM 7-83, Arastradero and Page Mill Roads, Request for selection of Pathway Bridge Design Mr. Enright referred to his memo of April 16, 1985, indicating after the writing of his mend a field trip was made with Mr- Lynch, Cannissioner Gottlieb and City Engineer to review the proposed location of the bridge, noting staff recommends the extension and widening of the existing box culvert on Page Mill Road to allow %W for pedestrian/equestrian traffic. Mr. Enright indicated there may be a need to require a guard rail for safety purposes. planning Ccnmissim Minutes - April 24, 1985 Page Two D. PUBLIC HEARINGS: 1. LANDS OF PAUSD (cautdnued) The Public Hearing was then opened - Nr. Yoshida, 13875 Page Mill Road, infoumed commission he did not like the location of the proposed bridge and could very much like the recammeudation mode by Mr. Enright, noting it would preserve existing oak tree and his privacy. Ms. Lytle indicated the discussion of the proposed bridge during the public hearing for the subdivisim, was to keep Yoshidas privacy, noting the intent of the bridge was for safe usage of the roadway. Mr. Jm Lynch, Sandia & Associates, informed Commission the City Engineer has summarized findings to their preference of extending the box culvert, asking approval by the Planning Commission. The Public Hearing was then closed. M NON SECONDED AND cARR2ED: Moved by Struthers, seconded by Gottlieb and passed unanimously to widen existing culvert and gut up rustic bridge guard rail. 2. LANDS OF BLUUq RT/ZAPPELSA, FILE #PM 8-84, la Pala Road, Request for approval of lot Line Adjustment Nls. Lytle referred to her staff report of April 18, 1985, noting the proposed lot line is between two lots located at 13975 La Paloma Road, noting one lot is .23 acre in size and the other measures 2.23 acres. The .23 acre lot has a single family residence, and portions of a shed and deck, the larger 2.23 acre lot contains a barn and portions of the same shed and deck, noting the majority of the lot is planted in orchard and vineyard. Ms. Lytle indicated all structures on the two lots are nm-omformiog in ternms of setback compliance. Ms. Lytle indicated the applicant proposes to adjust the existing lot line to create two lots which conform with the 'ltuvau's su bdivisim ordinance require- ments, noting the adjustment could create two standard size parcels, one measur- ing 1.14 net acres and the other measuring 1.00 net acre. Ms. Lytle indicated the staff recammendatims are: 1) That the Planning Commission grant a condi- timal exception to the requirement of a coded slope classification map, Sectim 9-4.506 (37), and to the reguirece t for showing properties on all sides of the right-of-way including topographic features and all improvements, Section 9-4.506 (3); and 2) That the Planning Commission adopt a motion approving the Tentative lot Line Adjustment, lands of zappella/Burkhart, File #PM 8-64, subject to conditions of approval attached to the April 18, 1985 staff report. Two letters were received by oo mmissim for their review at the meeting: one from Noack & Associates, dated April 24, 1985, requesting the conditions of approval be amended to include a waiver of fees for the variance; and one letter from Mr. Nevin K. Hiester, dated April 24, 1985, regarding drainage concerns in the area. The Public Hearing was then opened. LANDS OF BURJgLMU/ZAPPFT1A (continued) Mr. Marc Kaufman, 14100 Dcnelson Place, informed cmwLission of past problems taw with drainage in the vicinity, noting the water during the 1982-83 stone was sheeting across Fremont Road. The Public Hearing was then closed. commissioner Gottlieb indicated a need for Obtai,,;ng Pathway along La Paloma in this locatim during lot line adjustment and not at site development time. Commissioner Carico suggested a new condition be added to the conditions of approval which would read: When parcel "A" is developed, drainage must be diverted that it will not further impact the Hiester property. MOTION FAILED DUE To LACK OF SECOND: Moved by Gottlieb to require a Type IIB pathway along both properties on La Paloma Road between roadway and fence. MOTION FAILED DUE TO LACK OF SECOND: Moved by Struthers to require that the owner of Parcel 'B" shall remove any obstructions in area hetween pavement and fence to allow for pathway use, (i.e., mailbox). MOTION SECONDED AND CARRIED: Moved by Carico, seconded by Struthers and passed unanimously to approve the Lands of Zappella/Burkhart Tentative Lot Line Adjust- ment, File #PM 8-84, subject to cmditions of approval as amended. Condition #3 to include at end, "with waiver of fees for variance". Condition #5 to be added to read as follows: "When Parcel "A" is developed, drainage v must be diverted so as not to further impact the Hiester and Maurer properties". 3. LANDS Op TALLY HO SUBDIVISION, FILE #TM 6-84, 26220 Moody Road, Request for approval of Negative Declaration and Tentative Map, 3 Lots Ms. Lytle referred to her staff report dated April 18, 1985, noting this is a public hearing to consider the negative declaration and tentative map for the Lands of Bellucci, File #TM 6-84, for a three lot subdivision. Ms. Lytle gave conmissim a brief site description and project description of the subject property, noting issues related to the subdivision include: 1. Floodplain; 2). Geotechnical Constraints; 3) Fire Protectim; and 4), Conservation Easement. Ms. Lytle recranmended that the Planning Comnissim: 1) adopt a motion recommnd- ing the granting of a conditional exception to the requirement for contour intervals, Section 9-4.506 (9) and (36), Ultimate Development of the property; 2) adopt a motion recommending that the City Council approve the filing of the Negative Declaration for this project with the Santa Clara County Clerk; and 3) adopt a motion recamiending that the City Council approve the Lands of Bellucci, File #TM 6-84, Tally Ho Subdivision subject to the Conditions of Approval attached to the April 18, 1985 Staff Report. Crnmissimer Carico indicated some concerns have been brought to her attention over preserving redwood grove located on the subject property, noting she would like a condition to be added that these will be preserved. Mr. Bellucci informed amnissim he has no intent to remove any trees, noting he recently removed some cedars that were diseased. The Public Hearing was then opened. Mr. David Bellucci, 26220 MDody Road, referred to his memo dated April 24, 1985 requesting a waiver of modification to the following conditions: 3.A., 3.B., 5.A., 5.D., and 4.A. planning commission Minutes - April 24, 1985 Page Four D. The Public Hearing was then closed. MOTION SECONDED AND CARRIED: Moved by Gottlieb, seconded by Struthers and passed by the following roll call vote to recommend that the City Council approve the filing of the Negative Declaration. CONDITIONS OF APPROVAL TO BE AMENDED AND/OR ADDED: 3.A. Parcel "B" residence shall be connected to the sanitary sewer. 3.B. Parcel "B" septic tank shall be pumped and filled to the satisfaction of the Environmental Health Department and the City Engineer. 3.D. The owrner shall enter into an agreement with the Town to require existing septic tank system for remainder of the subdivision can be utilized until evidence of failure, at which time dwellings monist be corrected to the sewer. 4.E. The owner shall enter into an agreement with the Town to preserve redwood trees not within the Conservation Easement, in excess of 30" in circumference. Conditions 5.A. and 5.D. were deleted. ROLL. LANCE CF TatN OF lAS ALTOS HILLS, FILE #CUP 3-85, Fremont Road (Historical Preserve Area) Request for approval of Conditional Use Permit for Administrative Facilities Ms. Lytle referred to her staff report dated April 19, 1985, informing Commission the Trnm Hall facilities are located on two lots at 26379 Fremont Road, noting these lots are presently in the process of being consolidated to create one 2.72 acre lot. Ms. Lytle referred to the Conditional Use Permit issued in 1977 for the existing Town Hall facilities which consist of the Town Hall, Council Chambers, a storage shed, Purissima Hills Water District building and two parking areas. Ms. Lytle indicated the Tom is proposing to anend that permit by relocating a historic home from the City of Ins Altos to the Tuan Hall property, the house is approximately 1,150 square feet in size and would be used for administrative purposes. Ms. Lytle informed Commission the house would conform with all the zoning requirements, including height and setbacks, noting however, the improvements on the Tom Hall property presently exoeed the NIDA and therefore considered to be non -conforming, noting it is proposed to remove 1,150 sq.ft. of graveled parking area behind Tom Hall to conform with the requirements. Ms. Lytle indicated staff has determined that the findings as set forth in Section 9-5.1107 (a) can be met in order to grant a Conditional Use Permit to allow an administrative use building. Ms. Lytle recomended that the Commission adopt a motion granting an amenchment to the existing Conditional Use Permit to allow for the placement of the historic structure for ad- ministrative use in a Residential -Agricultural District per M nicipal Nce Section 9-5.703 (6), subject to Conditions of Approval as recommended by staff in the April 19, 1985 staff report. The Public Hearing was then opened. The following residents addressed the commission in opposition to the proposed request for Conditional Use Permit for Administrative Facilities at Town Hall. The residents expressed their concerns regarding the follow- ing issues: traffic generation, types of uses to be allowed in proposed structure, cost of maintenance and upkeep, lighting proposed, color, land- scaping, location if used for files is too far from Tom Hall facilities, and indicated they preferred the property be left in open space with farming implements and apricot orchard. Mr. & Mrs. Marc Kaufman, 14100 Donelson Place; Mrs. Millie Gallo, 25720 Ia Larne Court; Mrs. Alma Food, 12151 Stonebrook Drive; Mrs. Luella Cox, 26530 Conejo Court; Mr. Maurer, 26170 Fremont Road. Mrs. Cox referred commission to letter addressed to the City Council dated April 2, 1985 which included a petition against the placement of the house by neighbors adjacent to Town Hall property. Mr. Edward BarnesChairman Community Relations Committee, gave Cammdssion a brief background` on the Eschenbruescher House which is currently located in los Altos and the moving of the house to Town Hall property. Mr. Barnes addressed fund raising plans for upgrading of the house, and noted he has requested that the Environmental Design Committee prepare a landscape plan in native plants for screening of the structure. Mr. Scarborough informed commission and audience that Town Hall staff will not be moving into time new building, but will be used for Council office and meetings. MOTION SECONDED AND CARRIED: Moved by Yanez, seconded by Struthers and passed unanimously to approve the Conditional Use Permit, Lands of the Town of Los Altos Hills, File #CUP 3-85 subject to Conditions of Approval as amended. ADDED CONDTIONS: A Landscape Plan to be reviewed arra approved by the Site Development Committee to mitigate structure from off site views. The structure shall be subject to Site DevelopMcnt COMMIttee review. E. STUDY SESSION: 1.
