A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Caanissioners Gottlieb, Kuranoff, Siegel, Struthers and Chairman Carico Absent: Camnissioners Lachonbruch and Yanez Staff: Michael W. CONSENT CALENDAR; YDTICN SECONDED AND CARRIED: Moved by Gottlieb, seconded by Kuranoff and passed unanii=sly to approve the Consent Calendar, specifically: 1. Approval of Minutes - August 14, 1985 (Coamissioner Struthers abstained from approval of minutes) 2. Acceptance of Filing Tentative Map: a) Lands of Jones, File #Tm 1-84, 12600 Page Mill Road, 2 Lots 3. Setting Public Hearings for September 11, 1985: a) Lands of Jones, Tentative Map & Negative Declaration b) Lands of Robles, Site Approval c). Lands of Mozart, Site Development Referral d)_ Lands of Hamilton, Variance C. REPORT FRCM CITY COUNCIL MEETING OF AUGUST 21, 1985: Commissioner Kuranoff reported the City Council approved C.U.P. for Ford Country Day School on their Consent Calendar, approved Lands of Roscoe Site Approval; approved Special Land Use Permits for Peacock and Riches. Held a Study Session before and after City Council regular meeting for Site DeveloFment Ordinance. D. PUBLIC HEARINGS: 1. LANDS OF F12ZCNT HILLS (PIl�0O PRIVATE SCHOOL), FILE #CUP 8014-76, kw 26800 Fremont Road, Review and Amendment to Conditional Use Permit Ms. Scott referred to her staff report dated August 21, 1985, noting the previous annual review was conducted in October, 1984, at that time Conditions 7 and 8 were amended and Condition #13 was added for a new addition currently underway. Planning Commission Minutes - August 28, 1985 Page Two D. PUBLIC HEARINGS: 1. Fremont Hills (Pinewood School) (continued): ms. Scott recommended that the Planning Commission adopt a ration to approve the extension of the subject Conditional Use Permit with amendment to Condition #9 to read as follows: Evonts put on exclusively by the applicant, for the benefit of the applicant, shall be limited to twelve (12) days per calendar year and shall be concluded no later than the hour of 11:00 P.M. on weeknights, and 12:00 midnight on Friday or Saturday Evenings. The Public Hearing was then opened. Mr. Lynn Riches, Headmster Pinewood School, informed Camdssion they are in contact with Mr. Stu Farwell, Ins Altos Fire Lepartnent with regard to the school name, and will inform Town Hall when a decision is reached. The Public Hearing was then closed. YO'LTCN SECCNDED AZ CARRIED: Moved by Struthers, seconded by Yanez and passed unanimrn,sly to approve the Review and Anenftent to Lands of Fremont Hills (Pinewood Private School), File #CUP 8014-76 with amendment to Condition #9, as specified in Staff Report dated August 21, 1985. 2. LANDS OF OSBORNE, FILE #CUP 7-85, 26050 Tbrello Lane, Request for approval of Conditional Use Permit for secondary dwelling (detached) Ms. Scott referred to her staff report dated August 21, 1985, noting the subject property is located at the corner of Manuella Road and Torello Lane and is bounded on the rear property line by Fremont Road. Ms. Scott informed Commission the Osbornes received Zoning and Site Development Penmi.ts for the pool and pool house (without kitchen facilities, or 220 wiring) in May and July, 1985, noting at this time the applicant world like to use 220 wiring in the pool house, although no kitchen facilities are proposed at this time, therefore a Conditional Use Pennit is needed to allow the secondary dwelling unit. Ms. Scott indicated the findings in Nnmicipal Code Section 9-5.1107 (a) (i -iv) necessary to grant a Conditional Use Permit can be node, noting the proposed use is properly located in the can- muiity, the site is adequate to accacodate the use, the site is served by adequate roads and the use is not anticipated to adversely affect the abutting properties, noting the application was signed by most of the applicants neighbors. Ms. Scott reconnended that the Planning Ccnnussion approve the Conditional Use Permit subject to Staff Recamended Conditions of Approval attached to the August 21, 1985 Staff Report. The Public Hearing was then opened and closed with no one speaking for or against this item. MOTLCN SEIXAIDID AND CARRIED: Moved by Kuranoff, seconded by Siegel and passed imanil=sly to approve the Conditional Use Permit, Lands of Osborne, File #CUP 7-85, subject to Conditions of Approval attached to the August 21, 1985 Staff Report. 3. JAMS OF SOLLIMON/GRAY, FILE #VAR 2-85, 13750 RDbleda Road, Request for approval of Variance toallow pool house to encroach 15' in setback. 4. LANDS OF SOLCY10N/GRAY, FILE #CUP 6-85, 13750 Robleda Road, Request for approval of Conditional Use Permit for secondary dwelling (pool house - detached) Items D.3. and D.4. were continued to September 25, 1985 Planning Cormission Agenda as per request frau applicant. LANDS OF SILINS, FILE #9M 1-85, Lupine Road, (Nowack & Associates, Engineer) Request for recanrendation of approval of Tentative Map and Negative Declara- tion, 2 Lots Ms. Scott referred to her staff report dated August 21, 1985, noting this is a proposed two lot subdivision located at the end of Lupine Road, 4.17 acres in size and is surrounded by low density residential developnent. Ms. Scott indicated the property is occupied by one single family residence located in the north- western corner of the property and a small barn near the southern property line, noting both buildings are proposed to remain, and shall be conforming structures following the subdivision. Ms. Scott gave Commission background information on zoning and subdivision criteria. Ms. Scott indicated issues related to this subdivision are: 1). Geotechnical Constraints; 2) Fire Safety; 3) Pathways; 4) Sewage Disposal. Ms. Scott recamended that the Planning Commission: 1) Adopt a motion recomending that the City Council approve the filing of a Negative Declaration for this project with the Santa Clara County Clerk; and 2) Adopt a motion recmmending that the City Council approve the Lands of Silins, Tentative Map, Subject to Conditions of Approval attached to the August 21, 1985 Staff Report. There was discussion between Staff and a mission with regard to the timing of when Parcel "A" driveway would be relocated. It was suggested at the time of Site. Development for Parcel "B", the owner of Parcel "A" shall relocate the driveway. The Public Hearing was then opened. Mr. Paul Noaack, Engineer, indicated with regard to drainage, there already exists drainage problems in this area, and would not suggest that water from off site be diverted to this direction. with regard to the driveway relocation, Mr. NOWack suggested it be left up to the applicant. The Public Hearing was then closed. MOTION SECCNDED AND CARRIED: Moved by Kuranoff, seconded by Yanez and passed unanbmsly to recamend to the City Council that they approve the filing of a Negative Declaration for the Lands of Silins with. the Santa Clara County Clerk. MOTION SECONDED AMID CARRIED: Moved by Siegel, seconded by Yanez and passed unanimously to recoruend to the City Council that they approve the Lands of Silins, Tentative Map, File #'IDM 1-85, subject to Conditions of Approval attached to the August 21, 1985 Staff Report. V Mr. Gordy Stroud, Cal Clay, infovned Camiission the proposed court would be formed with existing adobe clay and volcanic material, which allows a much better drainage than conventional courts. Mr. Stroud indicated he would provide the Tarn with a booklet on clay courts. for review. Camiission, staff and applicant discussed the intent of the Developcent Area Ordinance with regard to drainage and intensity of development upon lots. It was indicated by Canission that the proposed clay court under current ordinances would be counted as developent area against the M� Development Area for the lot. G.
