A. Lacbenbruch Commissioner Lachenbruch requested the October 9, 1985 minutes be amended as follows, on page two, item 01 under Public Hearings be worded as follows: ... to allow 31'h' front yard setback encroachment and height envelope encroachment... MOTION SECYNDED AND CARRIED: Moved by Gottlieb, seconded by Struthers and passed unanimously to approve the minutes of October 9, 1985 as amended. At the time of this meeting, there were no items to be scheduled for public hearings for the November 13, 1985 agenda. C. REPORT FROM CITY COUNCIL MEETING OF OCTOBER 16, 1985: Conmissioner Gottlieb reported the City Council approved Special Land Use Pennit for Lisac; first reading of Site Developnent Ordinance Anendmment; discussed during Site Developre t Ordinance review - pathways and emergency access easements; approved Final Map for Zappella/Burkhart and Wubbels/Alvarez; discussed fire retardant roof ing, noting the Council would like Site Development committee to mention the Town is in favor of. Councilman Allison directed a letter to Commission regarding Hamilton variance and has requested a response from the Commission. V Planning Camnission Minutes - October 23, 1985 Page Two D. PUBLIC EIEARINGS: 4 1. LANDS OF SOLCMN/GRAY, FILE #VAR 2-85, 13750 Robleda Road, Request for approval of variance to allow pool house to encroach 15' into setback Ms. Scott referred to her staff report dated August 22, 1985 for a request to consider a variance request to encroach into the side yard setback by a maximum of fifteen feet for a pool house approximately 256 square feet. Ms. Scott gave commission background information on the subject property with regard to zoning and subdivision ordinance criteria. Ms. Scott informed Carmission the applicant has submitted written findings which they feel support requirements of Section 9-5.1107 (b), noting in staff's opinion, findings (b) 1 and 5 are supported by the following facts: The lot is substandard in width, ranging £ran 118' to 150' and the existing structures and amenities are awkwardly sited on the property. However, Ms. Scott indicated it is staff's opinion that required findings (b) 2,3,4, and 6 are not adequately supported, considering the nature of the building being requested for development, staff does not believe that enforcement of setback regulations mould result in practical difficulties or would deprive the property of privileges enjoyed by surrounding properties (findings (b) 2 and 3). With regard to (b) 4 and 6, Ms. Scott indicated any additional overdevelopment of the setback areas could be materially detrimental to the public welfare or injurious to the properties in the immediate vicinity. Staff reconuended that the Planning CmFniSsion deny the variance request to encroach into the side yard setback by a maximmi of fifteen feet. The Public Hearing was then opened. Mr. Fritz Johnson, Designer, informed commission because of the location of the septic drarnfield, and lot slope it is a very difficult site to develop, noting there will be no visibility of the proposed structure from neighbors. Mrs. Mary Stutz, 253U Elena Iniad, informed commission this property already has two variances, noting the proposed structure can be placed upon the property without requiring a variance. Mr. Steve LaLonde, 13770 Pbbleda Road, indicated there are many trees surrounding stfii property that will screen the structure, noting he does not object to the request as he did not believe it would be visible from his property. The Public Hearing was then closed. Camnissioner Gottlieb indicated she did not feel that all 6 guidelines from 9-5.1107 (b) could be net, specifically #3. Commissioner lachenbruch indicated he was in agreement with Gottlieb and commnts in the Staff Report, noting the key statement is the 30' side and rear setbacks were established to maintain rural character, and although there is an exceptional circumstance due to the lots long and narrow, shape, I could not vote in favor of this variance request. Ca ssicner Kuranoff indicated he also agreed with Gottlieb and Iachwnbruch, as #3 could not be met. Planning Comdssion Minutes - October 23, 1985 Page Three D. PUBLIC HEARINGS: (continued) 1. lands of Sola cn/Gray (variance) Chairman Carico indicated she did not feel that #4 and 6 could be met, noting there are other locations on the property that the proposed structure could be placed. MOTION SECCNDED AND CARRIED: Moved by Tachenhr,ch, seconded by Gottlieb and passed unanimously to deny I__a_ of Solamcn/Gray, File #VAR 2-85, for a variance to allow pool house to encroach 15' into setback, based upon findings in Staff Report dated August 22, 1985 and comments by individual Planning Cmmissicners. 2. IANDS OF SQUJI V/GRAY, FILE #CUP 6-85, 13750 Robleda Road, bequest for approval of Conditional Use Permit for secondary dwelling Ms. Scott referred to her staff report dated August 22, 1985, noting this is a public hearing to consider a request for a Conditional Use Permit to allow a secondary dwelling unit. Ms. Scott indicated this is a request for a 352 square foot unit, noting in staff's opinion, the finding in Section 9-5.1107 (a) i -iv, which are necessary to grant a Conditional Use Permit, can be made. Noting the proposed use is properly located to the community as a whole, the site is adequate to accomodate this use, the site is served by adequate roads and the useis not anticipated to adversely affect the abutting property. Staff recommends the Conmission approve the Conditional. Use Permit for a secondary dwelling unit, subject to the conditions of approval as in the h August 22, 1985 staff report. The Public Hearing was then opened. Mr, Fritz Johnson, designer, informed commission the secondary dwelling and poolpool oi�anned as relating together, although we have thought of them being combined, but it does interfere with driveway, noting they have limited to size to 1 story to keep with neighborhood. Mr. Solomon -Gray, informed Commission this design was planned around the pool, notng be -does feel there is enough room to enlarge the structure to include utility roan and bath, noting however, he isn't sure if 600 square feet is large enough. The Public Hearing was then closed. MOPICN SECONEED AND CARRIED: Moved by Ruranoff, seconded by Iache^hn,rh and passed unanimously to approve Lands of Solomon/Gray, File #CUP 6-85 with ammendmants as follows to the Conditions of Approval as in the August 22, 1985 Staff Report. Condition 44 to he deleted. Condition #4 to be amended as follows: The secondary dwelling unit shall be limited to 600 square feet of living area, single story as substantially sited on the plans referenced herein. Any revision in theuse of the structure shall be cause for review of this Conditional Use Permit. u Planning Ccmnission Minutes - October 23, 1985 Page Four D. PUBLIC BEARINGS: 3. LANDS OF VISHER, FILE #SA 3-85, 10475 Albertsworth. Lane, Request for approval of Site Approval Ms. Lytle referred to her staff report dated October 18, 1985, info=,ing Coamission the site is located in the southenmost portion of the Town, a panhandle shaped lot currently developed with a swimming pool, bath house, driveway and parking area, all of which are accessory to the Visher residence on the western adjacent lot. Ms. Lytle gave CmTnission background information with regard to zoning and subdivision ordinance requirarents. Ms. Lytle indicated issues related to this project are: Non - Conforming Structures; Vehicular Easement Dedication; Septic Tank Drainfield Approval; and Future Developability of the Lot. Staff's recomendation is: 1) adopt a motion recce Trending the granting of Condi- tional Exceptions for Sections 9-4.506 (30) for current Title Report, and 9-4.506 (36) for a coded slope classification map.; 2)a. Adopt a motion reeamending Tentative approval subject to conditions attached to the October 18, 1985 staff report and allow the illegal structures to remain.; 2)b. Adopt a motion recd mending Tentative approval subject to the conditions of approval in the October 18, 1985 staff report, which would require the applicant to obtain septic drainfield approval prior to the final approval of the City Council. Mr. Enright suggested ane_idnents to Conditions 1.B. regarding theowner dedicating driveway ease ent for the benefit of Lot #8, as proposed on the Tentative Map and subject to satisfaction of the City Engineer, and aaencLrent to Condition S.B. that the owner shall enter into an agreement for relocation and construction and maintenance for use of the driveway to be located in theeasement described in Condition I.A. Planning Cannission, Staff and applicant discussed necessity of Coded Slope Classification Maps, existing non -conforming structures on the property and the driveway location. The Public Hearing was then opened. Mr. Edward Delfs, 10505 Sundown Canyon Way, informed camoissicn of his concerns over the possibility of septic problemvs which exist presently, and his concern over the addition of another septic drainfield. Mr. Delfs also expressed concern over drainage of the structures. Mr. and Mrs. Taifert, 10490 Alhertsworth Lane, expressed concerns to the Cmudssion over existing drainage problems on their lot frau the Visher's property and their concern over the location of the septic drainfield. Mr. John Riley, i.nfonned Camussion and residents the drainage for the residence will be carried to Albertsworth Lane. The Public Hearing was then closed. There was discussion between applicant and camiission with regard to the timing and cost of percolation testing for the septic drainfield location, f and the required approval by the Health Department. Lands of Visher MOTION SA"Q,IDED AND CARRIED: Moved by Kuranoff, seconded by Lachenbruch and passed unanim sly to continue the Lands of Visher, File #SA 3-85, until the following infomatim is supplied to the Town for review: 1) Conduct percolation tests to establish drainfield requirements; 2) Develop- ment Concept Plan shown on Site Approval dated October 4, 1985 by J. Riley is to be amended to illustrate concept keeping with Zoning ordinance requirements; 3) decision on the pool and bath house location; and 4) the necessity of a coded slope classification map. Mr. Riley infonTed Camdssim the applicant approves the continuation of this item. E. OLD BUSINESS: 1. Goals of Zoning Ordinance Revision Ms. Scott referred to revised goals of the Zoning Ordinance revisions dated October 18, 1985, noting the camiissim needs to reach a consensus of this tonight, so that staff may move forward. It was passed by consensus to amend Item #e, as follows: The regulations should be designed with consideration of the great majority of lots in Torn. For those anamolons lots which the ordinance did not anticipate or consider, E the variance procedure is available. v The date set for the Study Session is 7:00 P.M., Monday, November 4, 1985. 2. cmTaissioner Lachenbruch discussed the need for further review of Building Setbacks, ie, nmicipal Cade Section 9-5.504 (c)(1), asking that a public hearing be scheduled for consideration thereof. MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by Lachenbruch and passed by the following roll call vote to schedule a public hearing for November 13, 1985 on possible ordinance amenaTmt to Mmicipal Code Section 9-5.504 (c)(1).
