A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Gottlieb, Iachenbruch, Siegel, Struthers, and Chairman Carico Absent: Commissioners Kurano£f and Yanez Staff: Michael W. Enright, City Engineer; Nancy Lytle, Town Planner, Leslie Mullins, Secretary Item B.1. removed - Commissioner Struthers lkw Struthers asked that on page 5, paragraph 4 be amended to add: "more planting below the house where exposure is greatest". Carico asked that on page 5, paragraph 1, be amended to add: "less fill in steep slopes and other homes are 30"'. MOTION SE OMED AND CARRIED: Moved by Struthers, seconded by Gottlieb and passed unanimously to approve the minutes of November 13, 1985 as amended. MOTION SE.CCNDED AND CARRIED: Moved by Struthers, seconded by Siegel and passed mmaninmously to set the following public hearings for January 8, 1986, as follows: 1. Proposed changes and amendments to the text of Chapter 1 of Title 10 of the Ins Altos Hills Municipal Code, concerning Antennas and recommendation concerning a proposed Negative Declaration. 2. Lands of Prodr , Conditional Use Permit gmuejumilLORMIiij INNUN •. •a•m I: a�• Commissioner Carico reported the City Council approved Special Land Use Permit for Hayden, new residence; upheld Commission's decision on the Chug setback determination; scheduled public hearing for change in the location of the Conservation Easement on Korpontinos Site Approval; discussed continuing the Urgency Ordinance #295, discussed Central Drive Emergency Road clearing. LENDS OF LACY, FILE #CUP 6-84, Lot #3, Red Rock Poad, Minor amendment to existing Conditional Use Permit, secondary dwelling Ms. Lytle referred to her Staff Report dated December 5, 1985, noting this is a public hearing to consider a minor amendment to the existing C.U.P. to allow a secondary dwelling unit. Ms. Lytle informed Commission the C.U.P. was approved by Camiission on March 13, 1985 and Council concurred on March 20, 1985. Ms. Lytle infonmed Crn ssion an application for zoning permit was received in November 1984 and was not approved for zoning, however after many minor revisions the zoning permit was approved on November 12, 1985. Ms. Lytle indicated the Site Development Permit was issued on November 19, 1985 with Conditions, one of which was to require the C.U.P. be amended as the project was revised in the following ways: 1) a covered breezewray linking the three proposed structures has been changed to a walkway and arbor; and 2) an entrance to the staff quarters has been included at the east side of the building. Ms. Lytle gave Commission infoznation with regard to the property and project in relation to zoning and subdivision ordinance requirements. Ms. Lytle recommnded that the Commission approve the modifications to the subject C.U.P., as staff finds that these changes do not significantly effect the potential use of the structure and that they are in conformance withour second unit Ordinance provisions, Section. 9-5.703 (k).. The Public Hearing was then opened. Dr. Lacy,2420 Bryant Avenue, Palo Alto, informed Commission that the removal of the breezeway was to conform to development area and doorway was to allow privacy and separation between entrances for staff. Dr. Lacy indicated he felt these were very minor modifications and hoped the Commission would approve this C.U.P. amendment. Commissioner Gottlieb requested that the applicant submit a letter stating they are aware that the development is well within the allowed Maximum Developrent Area. Ms. Jan Cowan -Lacy, 2420 Bryant Avenue, Palo Alto, informed CanTission that she did not feel a letter was appropriate, as we are both present at this meeting and we are aware of the allowed and proposed development area requirements, and that such development is at the maximum allowed development for this property. Mr. Ken Abler, Architect for Lacy's indicated he also felt it was not appropriate for a letter to be written regarding the development area at its maximum, noting the applicants are both present and understand the r , ,; rement. Commissioner Gottlieb indicated that she could not approve the C.U.P., as the road is not in shape to take a secondary dwelling as stated during the public hearing in March 1985 when it was originally approved. mXION SBMU D ASID CAHIUM: Moved by Siegel, seconded by Carico and passed by the following roll call vote to approve the modification to Conditional Use Permit, File #CUP 6-84, for Lands of Lacy, Lot #3, Fed Pock Road, as shown on the approved Zoning Permit and Site Development Permit. ZCNING OImINANCE AMRgU mn - Municipal Code Section 9-5.504 (c)(1), Setback Lines Ms. Lytle referred to her Staff Report dated December 5, 1985, indicating at the November 11, 1985 meeting the Planning Cmmission reached a consensus that the zoning ordinance which deals with 40' setback determination needs revision, cording for the suggested revision is as follows: 9-5.504 (c). The setback line for any structure shall be: (1) Where a parcel abuts on a single street or other accessway, forty feet from the nearest such public or private street right-of-way, easement for vehicular access, or where an official plan line has been established, from such official plan line. Where a lot abuts on more than one such street, easement, or official plan line, the Site Development Committee shall normally designate the forty foot setback from the street or easement, or plan line from which the property has access provided such choice will not result in a significant environmental, visual or aesthetic impact to the adjacent properties or the public at large. Mr. Enright informed Commission, the City Council will be considering a policy with regard to setbacks at their Decamber 18, 1985 meeting. The Public Hearing was then opened and closed with no one speaking for or against this item. There was discussion between Commission and staff as to the correct wording of the section, drafting of a master reference map for those lots in Town which fall into this category, and policy of checking previously approved Site Develop- ment Files for their determination of the forty foot setback. MOTION SECCNDED AND CAMUM: Moved by Siegel, seconded by Lachenbruch and passed mnianimously to forward the following wording to the City Attorney for preparation of ordinance Amendnent as follows: Section 9-5.504 (c)(1): Where a lot abuts on more than one such street, easement, or official plan line, forty foot setback shall be from the street easement, or plan line from which the property has access, unless said authority determines that such choice will result in significantly greater environmental, visual, or aesthetic impact of the development to the adjacent properties or the public at large, in which case the alternate choice would be selected. 3. Santa Clara County - Reclamation Plan for Neary Quarry Ms. Lytle informed Commission the Santa Clara County Planning Department has forwarded plans for the Town's review, and asked that interested Commissioners care in and review plans and give comments in writing so that they may be for- warded to the County for their review. 4. Los Altos - El Retiro Property Ms. Lytle informed Commission the City of Los Altos has forwarded plans for E1 Retim - Specific Project Plans for the Town for review, asking that interested Commissioners core in and review the plans and give moments which would be forwarded to Los Altos in their review process. 5. Open Space Preservation Task Force Meeting to be held on December 12, 1985 6. Mike MCDebit, Town Crier will be doing a story on architecturally unique homes in Los Altos Hills, please contact him with any information you feel appropriate. Chairman Carico informed Commissioners that Cmmiissioner Kurano£f is resigning and moving to Japan; read a letter from the Mayor to Kuranoff and presented an appreciation certificate for all Michael Kuranoff's years of help on the Commission. 2. MOPIGN SEC(kIDm AND CARR=: Moved by Struthers, seconded by Gottlieb and passed unanimously to cancel the December 25, 1985 Planning Commussion meeting, next regular scheduled meeting is January 8, 1986. � There being no further new or old business, the meeting was adjourned at 8:90 P.M.;and the Study Session for review of the Zoning Ordinance amendments for proposed revisions to bulk regulation formila was held in the Cmmittee Roan at Ton Hall and adjourned at 9:30 P.M.
