A. ROLL CALL AND PLEDGE OF ALLEGIANCE' Present: CmTnissioners Gottlieb, La henhr ch, Siegel, Struthers, yanez and Chairman Carico Absent: None Staff: George Scarborough, City Manager; Michael Enright, City Engineer; Nancy Lytle, Town Planner; Leslie Mullins, Secretary maTICN SECONDED Am CARRIED: Moved by Siegel, seconded by Iachenbruch and passed unanimously to accept the Consent Calendar, specifically: 1. Approval of Minutes - January 8, 1986 2. Public Hearings for January 22, 1986: a. Lands of Cheng, File #VAR 5-85, 11651 Jessica Lane b. Lards of Berry Hill Farms, File #CUP 8028-77, Annual Review c. Lands of Frmont Hills Country Club, File #(ITP 8010-76, Annual Review d. Lands of Gerard Hanes, Int #1, Gigli Court, Site Development Referral C. REPORT FROM CITY COUNCIL MEETING OF DECEMBER 18, 1985: Ccmaissioner Strutters reported the City Council approved S.L.U.P. for Lands of Bob Owen Hares, Lot #6, Bentley Court for single story residence, (2 story residence was withdrawn); approved S.L.U.P. for Chang, Carrington Circle; S.LU.P. approved for Markoff, Central Drive; indicated a S.L.U.P. for McCain on Darling Way for Solar Panels on the roof was not necessary; There was discussion over what uses would trigger requiring a Use Permit on accessory buildings, with a recannendation that plumbing for toilets would necessitate the Use Permit process; Amended Site Approval for Korpontinos, with regard to the Conservation Easement; Hansen on Anacapa requested deletion of pathway request, his request was denied; Town Geologist directed to perform surface study on S-Ou ve - Fremont Road, Town Engineer gave presentation of four alternates for S -Curve; Status Report given or Heritage House; and Discussion of E1 Retiro project in Los Altos. LANDS OF PRODRSRID, FILE #CVP 8-85, 14975 Page Mill Road, Request for approval of Conditional Use Permit for secondary dwelling Ms. Lytle referred to Staff Report dated January 3, 1986, noting this item was previously considered at the Co mission meeting on November 13, 1985 and continued with permission of the applicant after the Commissim expressed concern over the siting of the structure and the applicant expressed a willingness to consider another site for the proposed structure. Ms. Lytle indicated the applicant decided not to resite the proposed guest house and has requested a building permit for the structure, which was issued on December 13, 1985. Ms. Lytle noted the proposed structure according to administrative definition would not require a Use Permit, however, the City Council granted a S.L.U.P. for the structure with a condition that the applicant acquire a Use Permit prior to final inspection of the Building Permit. Ms. Lytle informed Commission that if they are not able to make the necessary findings for granting of the Use Permit, that staff will appeal this item to the City Council for administrative reasons. Ms. Lytle recomended approval of the Use Permit with Conditions of Approval attached to the January 3, 1986 Staff Report. The Public Hearing was the opened and closed with no me speaking for or against this item. MOTION SECCNDED AND CARRSID: Moved by Lachmbruch, seconded by Gottlieb and passed by the following roll call vote to Deny the Conditional Use Permit for Lands of Prodromu, File #CUP 8-85, for a secondary duelling on the basis that Cmudssion was not able to make the necessary findings under Municipal Code Section 9-5.1107 (a) 1., because of it's close proximity to an entrance to the crnmun.ity on one of the four scenic roadways, and as the proposal is inconsistent with the intent of the Town's General Plan. Proposed Changes and hwndments to the Text of Chapter 1 of Title 10 of the Los Altos Hills Municipal Code, concerning Antennas and m=nendation concerning proposed Negative Declaration Commissioner Gottlieb informed Cmmissionexs of the sub-ommittee meeting held on Monday, January 6, 1986, noting most of the discussion was regarding functions of antennas and their working parts; members were fairly pleased with categories, however, they have asked that they be increased by 4' approximately to meet manufacturers specifications. Gottlieb indicated the Use Permit process mentioned in the Ordinance is not in keeping with the current Site Development Ordinance, noting this should be changed to:'review by full Planning Commission, noting this way the applicant will save $1,500 application fees. Ms. Gottlieb indicated there was also discussion over setbacks, and wind: load factors for determining size of antennas. ` Co ssioner Lachenbruch indicated information provided by Mr. Smithwick and Mr. Sneider was very helpful, however, we received so much new information that we will not be able to go through it all this evening, suggesting that staff review all new information provided, and compile it for a later date. Planning Commission Minutes of January 8, 1986 Page Three D. PUBLIC BEARINGS: 2. Antennas (continued) The Public Bearing was then opened. Mr. Bob Brown, 25830 Estacada Drive, objects to viewing antennas from windows of neighboring properties, noting antennas should be required to be somewhere on the property that the user views it and not their neighbors, and when the antenna is not in use, that it be required to be lowered. Mr. Brom indicated permits should be required, and that antennas should not interfere with T.V. reception, as his neighbors has in the past. Mr. Richard Burguillas, 25851 Estacada Drive, concerned ever antennas imposing upon neighbors view, and T.V. reception, indicating our lots are smaller than average therefore more obtrusion from antennas. Mr. Ron Cipari, Portola Valley, informed Commission he has worked with Federal Organization with regard to complaints over T.V. reception failing in areas of antennas, noting most of the equipment checked cleared all testing, noting he is willing to offer his assistance with others to work on interference problems. Mr. Robert Smithwick, Thanked the Commission for participating in the sub -committee, and indicated that comments made by Gottlieb and Lachenbruch have been forwarded correctly to the Commission. Mr. Craig Miller, informed Commission he has 5 acres, noting that his antenna is close to the property line because the acreage goes down into a canyon. Mr. Edward Radlo, 25811 Estacada Drive, informed Commission that he does not believe that his antenna causes any of his neighbors interference with their T.V.'s, I do believe that it is caused by cordless telephones. Mr. Radlo indicated that he has satisfied the FCC requirements with his antenna. Mr. Robert Lewis, 14554 Le Bell Drive, thought that this evenings meeting was to do with height limitations on antennas, informing Commission of sur- rounding Town's height requirements and enforcement policies, asking for a 30' height limit and if a crank -up type of antenna that it be down when not in use. Mr. Richard Simko, 27861 Black Mountain Road, supportive of antenna operators and their use not interfering with T.V. reception. Mr. Ronald Jones, City of Campbell, informed commission that he felt the ordinance was not written in keeping with todays requirements for -antenna users. The Public Hearing was then closed. Chairman Carico thanked everyone for their participation. Commissioners requested staff to obtain what other communities similar to Los Altos Hills have in the way of ordinances and their enforcement. ` Commissioner Siegel questioned how the adopted ordinance would affect existing `r' antennas? Ms. Lytle indicated that she would need to check with the City Attorney to provide this information. =ICN SECCNDED AND CARRIED: Moved by Gottlieb, seconded by Lachenbruch and passed unanimously to continue the public hearing to February 26, 1986. Staff Report frau Imbert Schubert, City of Los Altos, regarding E1 �r Retiro Property was distributed to Co missioners for their review, Camiissioner Struthers noted a nano was prepared for the City of Ins Altos with reconnendations frau sub-caanittee and forwarded with a corer letter £ran the City council. Struthers indicated the report from Schubert does not address our concerns all together. F. NEW BUSINESS: 1. Ms. Lytle inforned Cannission there is a fifth VL-dnesday, which could be used for Study Session for Zoning Ordinance Amend ents for height and design review. Ms. Lytle discussed ideas being presented to the city Council for their review of S.L.U.P. at the January 15, 1986 meeting. MOriCN SECONDED AND CARRIED: Moved by Siegel, seconded by Yanez and passed unaninmsly to hold the Study Session on January 29, 1966 at 5:30 P.M. 2. Cannissicner Gottlieb questioned if the S -Curve plans will be presented to the Commission? Mr. Enright informed cmmission the plans are on file in the office for review by individuals but they will not be placed on an agenda for consideration. G.
