A. Carico - Commissioner Carico removed the minutes to correct gage one, last paragraph to add "Planning,CmTnission had previously approved an ordinance". MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by Iachenbruch and passed unanimously to approve the Consent Calendar, specifically: 1. Minutes of April 23, 1986 as amended 2. Setting items for the May 28, 1986 Agenda: a. Lands of Scarff, Preliminary Review of Variance Request b. Study Session - Site Development Ordinance Procedures (Camdssioners Kaufman and Siegel abstained from approval of minutes) C. REPORT FROM CITY COUNCIL MEETING OF MAY 7, 1986: Commissioner Gottlieb reported the City Council approved Special Land Use Permits for Nby on Dawson Drive and Nakajima on Horseshoe Court; approved ordinance regulating signs and advertising signs; approved antenna ordinance with change, eliminating weight front the criteria on antennas which would go on to Site Development Camuttee; Council heard a request from Mr. Green on Three Forks to allow minimum require- ment for septic system, noting Council approved the waiver; (Mr. Enright informed Co ssicn the request Was to not construct the 1008 expansion %. drainfield); Council held discussion over local incentive program with regard to safety; approve the contract in principle for the S -Curve Project, allowing staff to negotiate with bidder to reduce costs to closer match budgeted amount; to proceed with condemnation procedures planning Co mission Minutes - May 14, 1986 Page Two C. REPORT FROM CITY COUNCIL: (continued) with Miller property for S -Curve Project; discussed proposal regarding Height and Design Review as approved by Cmutission, noting a Draft ordinance is to be prepared; discussion over the inadequacy of report on Neary Quarry property; and Council asked that at next Study Session for Site Development that Camdssion look into how Pathway, Environmental Design and Roads & Drainage Committees are involved and the materials they are supplied. Carico noted she would like the Committees to all be invited to attend the next Study Session. Gottlieb noted a co mittee was appointed to work on "Noise Abatement Camiittee" - Gottlieb, Mary van Tamelen and Louise Drmkert. D. PDBLIC HEARINGS: 1. LANDS Cr WJNG, 13456 Mandoli Drive, Continued consideration of the Appeal of March 19, 1986 Site Development Camtittee approval of pennit for dish antenna - Review of Landscape Plan Ms. Lytle referred to her Staff Report dated May 7, 1986, noting at the April 9, 1986 meeting, the Camdssion held a public hearing and continued consideration of the Ferrari appeal in order to allow the Wong's to develop a landscape plan which mitigates the visual impacts of the dish antenna as viewed from the Ferrari's property. Ms. Lytle noted the Wangs have developed a landscape plan for C=issioners review. Ms. Lytle recd miended the Cautdssim grant the appeal requested kaw by the Ferrari's, and issue a revised Site Development Permit which includes the condition that the landscaping proposed in the plan dated "Received, May 5, 1986" be required prior to final of building permit. The Public Hearing was then opened. Mr. Wong, 13456 Mandoli Drive, explained to Commission the eventual height of the proposed plantings and maintenance of existing trees. Mr. Ferrari, 13434 Mandoli Drive, questioned who would be the final of judge of what is going to be planted and how do we know that it is adequate? Ms. Lytle noted either staff or environmental design co mdttee would be responsible to see that the plantings shown on the May 5, 1986 sub- mittal would be planted prior to final inspection. Mrs. Ferrari, 13434. Mandoli Drive, referred Con nission to CC&R's for the subdivision, noting existing trees are blocking their views, questioned if eucalyptus trees on property line could be trimmed back by the Town? Camussimers assured Ferrari's that the plantings shown on the plan will eventually help mitigate the view of the dish antenna, noting staff ( will ensure the plantings are planted according to the plan prior to final inspection of the building pelmdt. LANDS OF W NG MTBE SECONDED AND CARRIED: Moved by Iachenbruch, seconded by Gottlieb and passed unanimously to approve revised Site Developrent Permit for the Lands of Wong, 13456 Mandoli Drive for Satellite Antenna, with condition that Landscaping proposed on the Landscape Plan dated "Received, May 5, 1986" be required prior to final of building permit. Staff was directed to inspect for implementation of lanscape plan when planted prior to final inspection. 2. LANDS OF EORRALL, FILE CUP 1-86, 27800 Central Drive, Request for approval of Conditional Use Permit for secondary dwelling unit. Commissioner Lachenbruch excused himself from this item as he is a neighbor. Ms. Lytle referred to her Staff Report dated May 81 1986, informing Ca ssion the applicant received zoning permit approval on February 26, 1986 and Site Development Permit on March 12, 1986, noting the project did not require a Special Land Use Permit under Urgency Ordinance #300 because the structure as ncdi£ied does not exceed 15' in height. Ms. Lytle gave Camnission a description of the property and proposed project in terms of the subdivision and zoning ordinance criteria. Ms. Lytle noted in staff's opinion, the findings in Section 9-5.1107 (a) i -iv, necessary to grant a Conditional Use Permit can be made, further noting all requirements of Section 9-5.703 (k) can be met with the proposal. Ms. Lytle recamianded the Planning Camussion adopt a motion to approve the subject Conditional Use Permit subject to conditions of approval attached to the May 8, 1986 Staff Report. Cacmissioner Struthers questioned if a condition should be added to require landscaping? Ms. Lytle informed CcnTrdssial a condition to this regard is included in the Conditions of Approval of the Site Development Permit. The Public Hearing was then opened. Mr. Hillard Reiser, 27660 Red Rick load, expressed concerns over drainage runoff, noting in the past there have been problems; visual and noise impacts frau the proposed use. Mr. Lachenbruch, 11820 Buena Vista Drive, indicated very careful considera- tion should be taken with regard to vantage points when landscape plan conies throughfor approval as the site is very conspicuous as well as the Proposed structure. Mr. Keith Borrall, 27800 Central Drive, informed Cc mission he would like to see law dense screening (noting pines and eucalyptus trees are not correct) , noting he would like to get together with Mr. Reiser to settle the landscape issue. The Public Hearing was then closed. �y MOTION SECONDED AND CARRIED: Moved by Kaufman, seconded by Struthers and passed unanimously to approve the Lands of Borrall, File #CUP 1-86, Conditional Use Permit subject to Conditions of Approval attached to the May 8, 1986 Staff Report. LANDS OF PRODRCMMU, FILE CUP 8-85, 14975 Page Mill Road, Request by applicant for Preliminary consideration of the siting of the proposed secondary dwelling unit Ms. Lytle referred to her Staff Report dated May 7, 1986, noting in a letter dated April 23, 1986 from Martin Kamph, the Prodraoou's are requesting the Commission to consider the siting of the proposed secondary dwelling unit prior to formal consideration of the Conditional Use Permit. Ms. Lytle noted the reason for this request was in previous review of this site, consideration concern was raised regarding the siting of proposed structures. Ms. Lytle reconre_nded that the Planning Commission discuss the siting and whether the Treasures proposed are sufficient to support the necessary findings for granting of Conditional Use Permit, noting the discussion is for the benefit of the applicant in designing their plans and proceeding with their application. Commission questioned if the NDA and Building Coverage conformed with new formula guidelines; Ms. Lytle informed Commission yes this proposal conforms. The Public Hearing was then opened. Mr. Martin Kamph, 303 First Street, Los Altos, informed Commission they have redesigned the structure to move it as close to the house as possible and back away from Page Mill Road, noting they have tried to keep close to finished floor of the existing house for compatibility of the two structures. Mr. Kamph noted the structures use is mostly for the owners, and will be a sound wall for backyard, noting why this location would be more desirable for the secondary unit rather than the swinming pool. Mr. Kamph informed Cmmission the berm along Page Mill Road is not to increase in height, but will widen and landscape to help mitigate the proposed structure. Mrs. Prodromou, 14975 Page Mill Pbad, informed Caanission the existing residence has 2 bedrooms on the street side, and have never had a problem with noise from the roadway, noting use of the cottage is for them. The Public Hearing was then closed. Comm, ssioner Gottlieb expressed concern over two dwellings located along Page Mill Road, as previously mentioned during last review, noting a better location would be in the back of existing residence and placing the pool in the location proposed for the secondary dwelling unit. Gottlieb further noted that by use of a breezeway, it would better mitigate the feeling of two separate structures. Commissioner Kaufman noted with proper landscaping for screening of the structure and use of the berm with landscaping, the structure could he very easily screened fon view of Page Mill Road, noting there is a difficult design problem caused by the steepness of the lot, and mentioned some reservations to placement of the swimming pool next to Page Mill Road, for privacy reasons. Kaufman questioned the timing on discussion over t siting at the Use Permit process? Commissioner Siegel expressed no objections to the proposed siting of the secondary dwelling, also feeling the landscape screening and berm would help mitigate views of the structure. LANDS OF PRODFa U (continued) Chairman Carico indicated she agreed with Commissioner Gottlieb regarding the siting of two structures along Page Null Road, noting lover with proper screening as indicated by Commissioner Kaufman and Siegel that it could be mitigated. Commissioner Struthers expressed concern over the location of the structure in relation to roadway and noise factor. Struthers questioned if the breezeway Mould add square footage to the dwelling? Ms. Lytle informed Commission a breezewav would he considered in the calculations for Building Coverage. Commissioner Lschenbruch indicated the most intrusion of the structure Proposed is to the south west corner of the property, noting perhaps the structure could be shifted so as to keep the same orientation, but offset towardsthepatio and -not the street, thereby increasing the open space by approximately 10' from roadway. Ms. Lytle informed 0mdssioners there is a finding in the Conditional Use Permit findings that Commission must find that the structure is appropriately sited, noting that previously on this application the Site Development Committee felt it was appropriately sited, and then when the item came through to Commission for the Use Permit, the Commission did not feel it was appropriately sited, noting to alleviate this from happening in the future, staff would like to have both the Site Develop - rent Permit and Conditional Use Permit processed simultaneously and heard through public hearings on the same Commission Agenda. (To discuss further under New Business). 4. LANDS OF Ct UZ O FARMS, FILE #CUP 8007-75, 24970 O'Keefe Lane, Request for approval of Annual Review - Conditional Use Permit, (cantinued from April 9, 1986 meeting) Chairman Carico informed Commission a letter has been received from the Santa Clara County Enviromental Health Services stating that Owlwood Fames is now in cunpliance. Ms. Lytle referred to her: Staff Report da ted May 8, 1986, noting that as the applicant is now in compliance with the requirements of the Health Department, Commission should adopt a motion to approve the Annual Review with amendment to Condition 1, which reads as follows: 1. This Use Permit shall be issued in the name of the above and after the subdivision of Parcel #175-39-002, the Use Permit shall be voluntarily surrendered by the permittee or revoked by the Tuan 90 days after the sale of future Lot #2. The Public Hearing was then opened and closed with no one speaking for or against this item. NOTION SECCNDED AND CARRIED: Moved by Siegel, seconded by Lachenbruch and passed unanimously to approve the Lands of Oalwood Farms, Annual Review - Conditional Use Permit, File #CUP 8007-75, with a ndnent to Condition 1 as proposed by staff. LANDS OF BELI=I, FILE #TM 1-86, 26220 Moody Road, Preliminary Review of Proposed 7pntative Nap, 11 lots Ms. Lytle informed Commission and public, staff received a telephone call from Mr. Bellucci earlier in the day, noting that he did not ask for this review and would not be present. Ms. Lytle noted Mr. Paul Nowack, Engineer, was in attendance. Ms. Lytle noted the public was noticed as a courtesy. Mr. Nowack indicated he felt this review would be very beneficial to get some input as the Adobe Creek property is very controversial. PASSED BY CCNSENSUS to withdraw the Lands of Bellucci, File #'IM 1-86, from the Agenda. 6. LANDS OF SCARFF, 26026 Scarff Way, Request by applicant for preliminary review of Variance request by John R. De eter (Applicant has not completed submittal, continue to May 28, 1986 Agenda) E. OLD BUSINESS: 1. Chairran Carico expressed the need for another Study Session to continue discussion over the Site Development Caumittee process. Commissioner Gottlieb indicated that if Site Development feels site coloring and materials are inportant, the applicants should make it available for part of the OmTdttee's review. 2. Comnissioner Struthers reminded Commissioners of the Forum to be held Thursday, May 22nd, asking that all Cwunissioners cane, so there is good representation by Los Altos Hills. F. NEW BUSINESS: 1. APPOLNIM= OF CHiAIRMW AND VICE-CHAIRMAN TO THE PLANNING COMMISSION Camussioners felt the appointments should wait until after selection of the three C:onmission vacancies, to be appointed by Council in June 1986. Ms. Lytle indicated according to the Planning Commissioners handbook, that if the Comussion has a very strong Chairman, it should keep them on for a longer time period than one year. Chairman Carico noted it is good experience and would hope that all Commissioners are given a chance for Chairman and would encourage all to tryl MYIrICN SECOLIDED AND CARRIED: Moved by Siegel, seconded by Gottlieb and passed unanimously to move appointments of Chairman and Vice -Chairman to the first neeting in July, annually. 2. Commission questioned the Planning Commission Seminar, who would be attending and if the seminars are useful? Ms. Lytle noted she would be attending. Carico and Lachenbruch expressed their interest in attending. Cammission asked Staff to investigate the amnmut of funds budgeted in the 1985/86 Budget, if there is enough funds and how many Commissioners world be able to attend the seminar, this will be placed on the next Agenda for further discussion. Camdssion and staff discussed handling of Site Development Permits and Use Permits at the same tine, combine at the Planning Commission level for ease of administration.. Passed by Consensus to hold public hearings for:Site Development and Conditional Use Permits at the Planning Conndssion level. 4. Ms. Lytle informed Connission the City Manager would like to investigate the issue of Landscape Bonds, noting she would like to agendize this on the next Agenda. 5. Ms. Lytle informed Cmmmission of actions recently taken on the Neary Quarry property, noting the County has provided staff with a Mining ReclaMatim Packet, noting the County has determined it to be incomplete and referred the applicant to ins Altos Hills for further review and d ocumentation. Ms. Lytle noted staff has recently met with a developer who is interested in annexation of portions of this property to Los Altos Hills. 6. With regard to discussion over color and material use at Site Development, Commission felt it necessary for the applicant to provide this informa- tion to (mmittee for their review. Cammussion suggested staff review the Matadero Creek CC&R's for appropriate wording. 7. Commissioner Struthers raised concern over property next to the Quarry, off of La Loma in the County, noting she and Mary Stutz while on Site Inspections found a road which goes through the property, which is a very important path link, as this is within our Urban Service Area, we should take in all those properties near us. 8. Commissioner Lachenbruch expressed concerns over judging whether certain structures are appropriate to area, especially after our review of Gigli Court and Accola property, asking for sole legal advice, noting Commission needs to be legal, fair and consistent, noting he recently saw an article on Ins Altos and suggested staff get in touch with than to see what they are doing with this regard. Commission suggested this be agendized for the next meeting and would like copies of the news- paper article Iachenbruch referred to. 9, Planning Commission Representative to next City Council Meeting - Cammissioner Yanez was to attend, as he is not present Chairman Carico volunteered.
