Chaim Siegel called the meting to order at 7:30 p.m. in the Town Hall
Council Chambers.

Connissicner Carico requested the minutes of July 9, 1986, page four, first
paragraph include statement that the City Council requested a Joint Study
Session between the City Council and Planning Conmissfive,

regularly scheduled meeting. Carico requested on page
indicate that the lights of cars as they leave Tuan Hall do not hit the house
on Esperanza, but the front yard; and all traffic caning down Esperanza hit
the house on Concepcion, not only from Toon Hall parking lot, further noting
the current entrance is in keeping with the present policy regarding institutions
keeping a low profile.
Commissioner La honhn,ch questioned action taken on page four, first paragraph.
Cmmissioners Kaufman and Siegel briefly informed Lachenbruch on reasoning
for this motion as a policy for Chairman and Vice -Chairman positions to the
Planning o3mTdssion. iachenbruch questioned if the Tuan has a policy regarding
excused and unexcused absences from coi ission meetings. Chairman Siegel asked
that Commissioners please notify Leslie in advance if they will not be attending.
MOTION SECaUED AND CARRIED: Moved by Kaufman, seconded by Carico and passed
unanimously to approve the minutes of July 9, 1986 as amended.
C. REPORT FROM CITY COMCIL DOTTING OF JULY 16, 1986:
Caanissioner Emling reported the City Council concurred with approval of ti'te
Conditional Use permit for Lands of Cabak secondary dwelling unit; discussed
E1 Monte Road Median, noting concerned residents presented petition to Council
regarding safety of the children who use the path and of t,- difficulty in
landscaping area successfully; Council voted to award contract to Chrisp Co.,
for Guardrail Project. Emling informed comission the Council is concerned
over the progress of the Zoning Ordinance Amendwmts; Emaing informed Council
Commdssion is ready to go ahead with public hearings and Council indicated to
proceed without Joint Study Session.
D. PUBLIC HEARINGS:
1. LXgW OF BAUMGARINER, FILE #VAR 3-86, 24292 Elise Court, Request for approval
of Variance to allow an increase of roof height for an existing non -conforming
structure, from 10 feet to 13.6 feet within the setback area
Ms. Scott referred to Staff Report dated July 17, 1986, informing Cc mission the
proposed project is to raise the roof over the existing residence by approximately
3y, noting the applicant maintains that the original house design while aesthetically
pleasing has not proven functional; purpose is to improve the condition by increasing
the pitch of the flat roof. Ms. Scott indicated the findings in Municipal Code
Section 9-5.1107 (b), necessary to grant a variance are supported as defined in
July 17, 1986 Staff Report, thereby recamrending that Planning Commission grant
the requested variance.
The Public Hearing was then opened.
Mr. John Baamaartner, 24292 Elise Court. asked Camrission to grant aporoval of the
variance.

by the following roll call vote to approve the Lands of Baumgartner, File
#VAR 3-86, to allow increase in roof height to 13'6" within the setback area.

2. LANDS OF UUIE, FILE #VAR 6-86, 29970 O'Keefe Lane, Request for Variance
to allow two existing non-confoou g accessory structures to remain
on Int #1
Ms. Scott referred to Staff Report dated July 17, 1986, informing Commission
at the titre of the Tentative Map review, staff recommended that all non-ccnfornIng
structures on both lots be removed, it was recommended that the structures were
too close to both the creek and roadway by current standards, although the Commission
modified the condition to allow that those structures on lot #1 could be
retained, with a variance, based on their rural and aesthetic value. Staff
recommends that the findings in Municipal Cade Section 9-5.1107 (b) necessary
to grant a variance, are supported by evidence as listed in the July 17, 1986
Staff Report, thereby recommending that the Planning Conmssim grant the variance
requested.
kW Commission and Staff discussed which buildings are to remain and the necessity
of encroachment permits; Cru asiomersquestioned the allowed development area
and building coverage for lots 1 and 2, staff indicated both lots are within
their allowed coverage with the mad right -of -xray being taken and proposed
buildings to remain.
MOIT(N SECONDED AND CARRIED: Moved by Kauffman, seconded by Strutters and passed
unanimously to recommend approval to City Council of Encroachment Permit required
to keep existing non -conforming accessory structures within the road right-of-way.
MCTICN SEOCNDED ASID CARRIED: Moved by Carico, seconded by Yanez and passed
unanimously to approve Lands of Ugie, File #VAR 6-86, to allow two existing
nonconforming accessory structures to remain on Dot #1.
3. LANDS OF ALHOUSE, FILE #COP 1-83, 26173 Rancho Manuella Tare, Request for
amendment to existing Conditional Use Permit
Applicant requested continuance of the public hearing to the August 13, 1986
Planning Commission Agenda.
E. NEW BUSINESS:
1. Commissioner Struthers reported on Newspaper Article regarding Stanford, noting
meeting is caning up in San Jose for those who are interested in the. future
LW plans at the University and surrounding grounds.
Commissioner Kaufman and Chairman Siegel noted that staff has informed Cammission
by memo dated July 17, 1986 that the Town has received a copy of the Draft
Environmental Impact Report for the Stanford University Land Use Pernit
Modification and that the report is on file at the Planning Office at Town Hall
for those interested in reviewing the document.

F. OIL BUSINESS:
1. Zoning Ordinance Pmendmnts - Lori Scott - July 18, 1986 Report
Ms. Scott referred to Report dated July 18, 1986, referring to updated
copy of the proposed zoning revisions, noting the draft includes ccmrtpsnts
and changes that were noted at the Study Sessions of June 25th and July 9th,
as this item is scheduled for public hearing at the August 13, 1986, Ms.
Scott recomrended that Commission review the ants and note any
additional concerns there may be or changes camdssioners world like to
see. Ms. Scott briefly highlighted changes which were incorporated into
the Draft. Ms. Scott also referred to Report dated July 23, 1986, which
is to update that staff has met with the City .Attorney to review the
proposed amenanents and language with him, noting there will be sore
minor changes and perhaps sorts additional renumbering, but no major changes
were identified at the meeting, Mr. Gillio will have further comments
after a more thorough review by the time this Draft cares back for
public hearing. Ms. Scott indicated there are changes which need to be
amended as part of ordinance #291 relating to secondary dwelling units;
and projects requiring Conditional Developarent Permits which would be con-
current with the Site Development Permit processing through the Planning
Commission. Ms. Seott inforaed Cortmission the Subdivision Ordinance
has been requested to be arended for clarification and concurrance with
the proposed zoning ordinance revisions. Ms. Scott further noted the
Site Development Ordinance also needs amendment to ensure compatibility
between all ordinance revisions.
Oonnission and Ms. Scott reviewed and discussed proposed amendments for
clarity of zoning, site developarent and subdivision ordinance arrendrents,
recoumnding proposal move on to August 13, 1986 Public Hearing.
