TOWN OF LOS ALTOS HILLS 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, January 28, 1987 cc: 126, Side I, Tract I, 875 -End; Side II, Tract I, 000-269 Chairman Struthers called the meeting of the Planning Commission to order in the Council Chambers at Town Hall. at 7:32 p.m. A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Carico (arrived 7:42), Emling, Kaufman, Patmore, Stutz (arrived 7:40), Yanez (arrived 7:38) and Chairman Struthers Absent: None Staff: George Scarborough, City Manager; Michael Enright, City Engineer; Nancy Lytle, Town Planner; Leslie Mullins, Secretary City Council Representative: William Siegel. B. CONSENT CALENDAR: MOTION SECONDED AND CARRIED: Moved by Kaufman, seconded by Patmore and passed unanimously to approve the minutes of January 14, 1987, and set public hearings for February 11, 1987, as follows: a. Lands of Adobe Creek Lodge and Country Club, File CUP 113-84, Conditional. Use Permit for 1,750 membership b. Lands of Serventi, 26884 DeZahara Way, Appeal of Site Development Decision regarding right-of-way dedication C. Zoning Ordinance Amendments - per Subcommittee recommendations C. REPORT FROM CITY COUNCIL MEETING OF JANUARY 21, 1987: Commissioner Kaufman reported the City Council has changed their meeting time to 7:00 P.M. Mr. Druyanoff on Berry Hill appointed to the Pathway Committee. Council. approved Resolution making portion of Matadero Creek Lane as a No Parking Area; approved Final Parcel Map for the Lands of Freeman on Hilltop Drive; Finney appeal for variance on Murietta Lane approved; set February 4th as public hearing date to consider certification of the EIR for Adobe Creek Lodge and Country Club; Babayan appeal denied for construction of stucco wall; held discussion over ` landscape bond policy, and sent back to committee for further review, \y noting it is an idea to hold the bond for a one (1) year period after the Planning Commission Minutes - January 28, 1987 Page Two plantings are installed; Haeckl on Blander given extension to pick up building permit due to Town Geologist's additional requirements; with regard to storage of vehicles on Carillo Lane complaint, the Council decided the vehicles are a public nuisance and must be abated within thirty days; First Annual Good design awards committee, noting there will be a slide show (pictures currently being taken by Councilman Siegel) of all structures which have been finalled in 1986; and report can be received from City Manager regarding Colinga, after the earthquake. REPORT FROM SITE DEVELOPMENT COMMITTEE MEETINGS OF JANUARY 20TH AND JANUARY 27, 9 7: Chairman Struthers reported the January 20, 1987 Agenda reviewed the resubmittal of new residence for Mr. Tam on Saddle Mountain, noting the Site Development Permit was continued for re -design. Commissioner Kaufman reported *here were no items scheduled for the January 27th Agenda. E. PRESENTATIONS FROM THE FLOOR: F. PUBLIC HEARINGS: 1. LANDS OF STURM, FILE #VAR 16-86, 27070 Snerlock Road, Request for a variance to retain an existing fence Ms. Lytle referred to Staff Report dated January 22, 1987, informing Commission the applicant is proposing to maintain an existing fence in it's current location, noting the applicant contends that the fence is necessary to keep the neigh bor's dog out oflntr. rs and ardyard byarea, the City noting the fence has been determined to be potential Engineer and for this reason staff can not recommend approval of a variance in the subject location. Staff recommends that the Planning Commission deny without prejudice the variance request to maintain the fence in its current location, based on an inability to make finding #4 of Municipal Code Section 10-1.1107 (b), as supported by the City Engineer's memo of January 23, 1987. Commissioners questioned if they could approve a variance for less of an encroachment? Why does City Engineer feel the location is unsafe? Why do people hit fence? Why does Staff Report say fence is located within Road right-of-way? The Public Hearing was then opened. Mr. Sturm, 27070 Sherlock Road, referred to Staff Report, informing*o Commission that his neighbor hitt fence and that he had to take him court to pay for repair costs; and informed Commission of the necessity to maintain fence in order to keep neighbors dogs out of his yard. Planning Commission Minutes - January 28, 1987 Page Three kw Mr. Smith, 26950 Moody Court, drew Commission a diagram of how Sherlock Road really looks in comparison to that which was submitted with Mr. Sturms' variance application, noting objection of the location of the existing fence and variance. Mr. Smith also informed Commission of other unsafe hazards on Sherlock, i.e., concrete block placed in roadway to make vehicles slow down apparently; and metal posts which have been hammered in to roadway along edges. Mr. Boissevain, 27181 Sherlock Road, informed Commission that the existing fence makes a very unsafe condition on the roadway, requesting tnat the fence be moved back to at least the trees as recommended by the City Engineer. Staff informed Mr. Smith and Commission that a nuisance complaint should be filed with regard to the concrete block within roadway. The Public Hearing was then closed. MOTION SECONDED AND CARRIED: Moved by Kaufman, seconded by Emling and passed by the fo owing ro call vote to Deny Without Prejudice the Lands of Sturm, File #VAR 16-86, because of inability to make finding U4, of the Municipal Code Section 10-1.1107 (b), as supported in the City Engineer's memo of January 23, 1987. Certification of the Final Environmental Impact Report for the Adobe Creek Lodge and Country Club - Conditional Use Permit Application, 26220 Moody Road, 1,750 membership nd ents Ms. Lytle referred to Stainforming Comm ssiona that staff? recommends that made on January 28, 198787 , 1 that the Planning Commission recommend to the City Council that the Town approve and certify that: 1) The Final EIR has been completed in compliance with CEQA; and 2) The Final EIR was presented to the decision making body of the Lead Agency and that the decision making body reviewed and considered that the information contained in the final EIR prior to approving the project. Ms. Lytle informed Commission it is necessary tha the Commission take action on the item this evening, as the City Council has scheduled their public hearing for February 4th, and immeditaly ffollowing the Town's action on the EIR, we will be scheduling the consideration of the Conditional Use Permit, noting mee tthis the fast ast*.trackory time scheduling is necessary in order for he Town to line for processing the appiicatiuu. iI Planning Commission Minutes - January 28, 1987 Page Four The Public Hearing was then opened. Mr. Michael Hogan, Earth Metrics, informed Commission their company has prepared more than 1,100 EIR's and never challenged in court, noting the report prepared for the Adobe Creek Lodge and Country Club meets all guidelines set forth by CEQA and has incorporated into an unusual degree of resources and community input, noting disagreement between experts according to CEQA its a very healthy outcome with regard to EIR's, noting Commission and community should not be concerned. Mrs. Zurbriggen, 11800 Murietta Lane, informed Commission she has reviewed the addendum prepared by Staff, however, she felt it stilldoes not reflect the correct numbers for Hidden Villa, and noted there is no mention with regard to any increase in the Town's insurance policy. Mrs. Emling, 11853 Murietta Lane, informed Commission the EIR has been around for some time and feel its time to move along and recommend certification to the City Council. The Public Hearing was then closed. �r MOTION SECONDED AND CARRIED: Moved by Patmore, seconded by Kaufman and pas unanimously to recommend approval and certification of the Final. EIR for the Lands of Adobe Creek Lodge and Country Club to the City raft EIR, Council; included in the approval and certification shall be Final EIR, dated December 1985; Final EIR, dated August 1986; Addendum to dated January 1987; and Staff Report dated January 28, 1987. 3. Pagauu (bellucci's attorney) aareeina to continuance, and recommend that the Commission adopty a motion to continue the Environmental Impact Report, in accordance with Government Code Section X1151.5 for a length of time or date certain mutually agreed upon; and tecofalbends that this time extension place the application on hold taw starting February 7, 1987 and lasting throughout the processing of the Gaither application, yet to be filed, and then reininitiate the remaining six month time limit 90 days after the Gaither application is disposed of. Ms. Lytle noted in the event that an application is not filed by Mr. Gaither as of June 15t, the application would beeinitiated on aate or a prior date at the applicant's request, and to ocess ed within nine months. Pagano, Attorney, informing Commission the suggestion of continuance was his, in order to form some semblance of organization for what will happen to the Adobe Creek Lodge. The Public Hearing was then closed. MOTION SECONDED AND CARRIED: Moved by Carico, seconded by Kaufman and passed unanimously to Continue the Lands of Bellucci, File #TM 1-86, for the Environmental Impact Report and Tentative Map for eleven lot subdivision, as referenced in the January 22, 1987 Staff Report. G. NEW BUSINESS: 1. League of California Cities - Planning Commissioners Institute Commissioners questioned if the Town has any money budgeted to allow attendance to institute and how many members would be able to attend? It was recommended that the Planning CommissionerRepresentative ask City Council for at least two members o be able to It was noted that the Commissioner Representative be aware that the Council meetings now start at 7:00 p.m. H. OLD BUSINESS: 1. Commissioner Kaufman informed Commissioners he has a copy of the First Annual Good Design Awards from the City Council Meeting if anyone is interested. 2. Commissioner Emling informed City Engineer of a wash out with a large chuck hole on Moody Road before Moody Springs Court, noting vehicles must travel across double yellow line. The City Engineer indicated staff will fill out a service request and have this looked into. I. ADJOURNMENT: There being no further new or old business, the meeting was adjourned at 9:15 P.M.
