A. ROLL CALL: AYES: Commissioners Carico, Emling, Patmore, Stutz, Struthers and Yanez NOES: None ABSTAIN: Commissioner Kaufman Chairman Yanez thanked Commissioners for the appointment as Chairman of the Los Altos Hills Planning Commission, reviewing his years of service to the Town on Commission and Roads and Drainage Committee, and congratulating Commissioner Carico on her re -appointment to the Planning Commission. Commissioner Carico expressed thanks from all Planning Commissioners to Commissioner Struthers for her term as Chairman to the Planning Commission. f Planning Commission Minutes - July 8, 1987 fiW Page Two C. REPORT FROM CITY COUNCIL MEETING OF JULY 1, 1987 Commissioner Kaufman reported the City Council re -appointed Commissioner Carico to the Planning Commission and made other Committee appointments. Kaufman reported Dave Proft attended Council meeting to discuss Hidden Villa, informing Commission a 90 day extension has been granted by the County on the CUP. Kaufman reported the public hearing was held by Council on the Draft Housing Element, noting Councilman Siegel had concerns over some portions of the language, i.e., much too broad, noting Commission has received his comments and should make their written comments and return them to Lori Scott. Kaufman reported the public hearing was set for July 15, 1987 for Riley on Stonebrook for Annexation; Mining reclamation for Neary Quarry was discussed, and noted general unhappiness with the plan and questioned the completness of the plan per Staff Report prepared; Berry Hill Unit II, for small wall installation was continued until a decision is made over who would maintain the wall; Catherine Court (Jones) continued to July 15th Agenda for encroachment permit which placed a pool house and portion on pool within the Conservation Easement; reviewed potential problems with Real Estate Review letters previously sent out on some properties, noting the MDA given at the time was prior to the change in the zoning ordinances and now some of the property owners want action on what they were told before the ordinances were amended; acceptance of private roads by the Town approved, with the exception of Francemont Road and Corbetta Lane; request for flashing yellow light continued; Study Session set for Thursday, July 23, 1987 at 4:00 P.M. for Quarry Hills Development; and informed Commissioners of seminar on inverse condemnation in Oakland on Thursday. July 16th, noting Bill Siegel, Nancy Lytle and Mike Enright will be attending. Planning Commission Minutes - July 8, 1987 4W Page Three REPORT FROM SITE DEVELOPMENT COMMITTEE MEETINGS OF JUNE 30, 1987 AND JULY 7, 1987: Commissioner Carico reported the Site Development Committee on June 30, 1987 approved retaining wall modification for Chantalat on Dawson Drive; approved addition, driveway and parking area for Petrick on Burke Road; approved gazebo, carport and parking area for Collinson on Edgerton Road; approved addition for Wolff on Elena Road; approved trellis for Neely on Elena Road. Commissioner Emling reported the Site Development Committee on July 7, 1987 approved pool, trellis and pool house for Packard on La Vida Real; approved fill and underpinning of foundation to existing residence for Fuller on Vista Del Valle continued hearing on Moy, Dawson Drive for landscape plan to include grading modification; approved new residence and pool for Hopkins on Elena Road; approved addition/remodel for Pratt on Garth Lane. Commissioner Patmore informed Commissioners landscape architect provided us with a list of deer proof plantings. Ms. Lytle explained to Commissioners how turf block counts towards development area: if used for driveway and parking it is counted 100%; if used for other purposes, then it is counted as per the manufacturers specifications. f4wF. PRESENTATIONS FROM THE FLOOR: G. PUBLIC HEARINGS: 1. Lands of Cook, 11471 Page Mill Road, Request for reconsideration of request to relocate a portion of Buena Vista Drive Ms. Lytle informed Commission and public that the applicant's agent has withdrawn their request and will return with Site Development Permit request for new residence and relocation of roadway with that application. Lands of Clausen, File #TM 2-66, E1 Monte Road/I-280/Voorhees Drive, Request for consideration of Tentative Map for seven lot subdivision Ms. Lytle referred to Staff Report dated July 1, 1987 informing Commission the applicant proposes to subdivide the subject property into sevond lots as describved in Table "A" of the Staff Report, noting the Tentative Map does not meet the Subdivision Ordinance minimum lot size requirements and does not propose to dedicate right-of-way to Town Standards for either Voorhees Drive or the private cul-de-sac proposed. Ms. Lytle informed Commission items of concern over the proposed subdivision are: 1) Noise; 2) Visual and Aesthetics; 3) Fire Safety; 4) Drainage and Circulation; and 5) Geotechnical Constraints. Ms. Lytle informed Commission the City Attorney has prepared a memo dated July 6, 1987 to the Planning Commission with regard to the requested approval of the proposed tentative map by Mr. Clausen. Ms. Lytle noted as per Municipal Code Section 9-1.515(e) states that the Planning Commission shall recommend denial of the tentative map if it makes any of the findings listed therein, noting staff concludes that these findings are supported as written in the July 1, 1987 Staff Report, and for these reasons, staff recommends that the Planning Commission adopt a motion to recommend that the City Council deny the Lands of Clausen, File #TM 2-86, based on the required findings per Municipal Code Section 9-1.515 (e). The Public Hearing was then opened. Mr. Clausen, 234 Van Ness Avenue San Francisco, informed Planning Commission that he has owned the subject lot since World War II, referring to when I-280 was constructed a slice was taken away from his lot and a map was submitted by Charles McCandless during legal proceedings in 1965 that he had a seven lot subdivision. Ms. Clausen informed Commission he has just received a copy of the City Attorney's memo and received a copy of the Staff Report on Monday, noting there are two omissions from these documents, referring to the June 9, 1987 and June 13, 1987 Supreme Court decisions, asking that the Planning Commission pay some heed to these monumental decisions. Mr. Clausen referred to an analysis he prepared dated July 6. 1987 with regard to Staff Report, referring to Supreme Court decisions; contention of legal implications from testimony and a map prepared by Charles McCandless the City Engineer in 1965; right-of-way dedications for Voorhees Drive and cul-de-sac and fire access roadway from Barley Hill Road, asking that the City Attorney and Town Planner address these concerns, and Planning Commission uphold the seven lot subdivision map. The Public Hearing was then closed. Planning Commission Minutes - July 8, 1987 Page Five Commissioners informed Mr. Clausen that the City Attorney attended their last Planning Commission meeting to review with them the recent Supreme Court decisions, noting it is the City Council who should take action on the legal interpretation not the Planning Commission with regard to these decisions and the 7 lot map prepared 20 years ago by Charles McCandless, informing Mr. Clausen that the Planning Commission must take action based upon the current Zoning and Subdivision Ordinances. MOTION SECONDED AND CARRIED: Moved by Emling, seconded by Struthers and passed unanimously to recommend to the City Council denial of the Lands of Clausen, File #TM 2-86, based on the required findings of Municipal Code Section 9-1.515 (e), as listed in Staff Report dated July 1, 1987. H. STUDY SESSION: 1. Noise Element of the Los Altos Hills General Plan Ms. Scott referred to Staff Report dated July 1 1987, informing Commission the Noise Element is the second Element of the General Plan we will be updating this year, noting the purpose of this Study Session is to review the draft element, recommending that Commission focus their discussion this evening on policies and programs. 4W Commission discussed sources of Noise Pollution: 1) Air Traffic over Los Altos Hills; 2) use of leaf blowers; and 3) excessive noise from Foothill College. Commission and Ms. Scott discussed the Noise Contour Map which is to be prepared by consulting firm on contract with Martin Carpenter Associates, which will show theoretical contours based on mathematical output, (will be very generalized). Commissioner Patmore stressed the importance of making it clear in the General Plan that the Noise Contour Map are not to be used as basis in areas of concern, suggesting that it would be a good idea to have consultant do a study of Moody Road. Ms. Lytle asked if this is a consensus of the Planning Commission to have a study done along Moody Road. Commissioner Patmore had several comments regarding the Draft Noise Element, relating to: arterial roadways; land use compatibility - open space category; mitigation measures - control by traffic reductions and inducing development; rewrite the goal as shown on page 13 and questioned policies written; rewrite buffer areas as shown on page 12 and policy statement. Ms. Scott informed Commission the goal is as written in the existing Noise Element. Ms. Lytle suggested that Commissioners review the goal write down thoughts and give them to Lori. Planning Commission Minutes - July 8, 1987 Page Six Commissioner Struthers suggested the wording of the Goal, page 13, be amended to replace "natural environment" to "outdoor living". Commissioner Carico questioned if the existing Noise Element is included within the Draft Noise Element? and is the existing Noise Element out of date? Ms. Scott informed Commissioners that the Draft is a combination of both new and old. Chairman Yanez suggested that Commissioners review the Draft and make any comments in writing to Lori Scott_ Ms. Scott indicated after review of comments by Commissioners and preparation of Noise Contour Map the Draft Noise Element will return for review by the Commission. Ms. Scott indicated she will look into noise generated at clubs, schools etc., on properties which we have CUP's on, noting this is a good opportunity to set up standards on these types of uses. I. NEW BUSINESS: 1. Analysis of inconsistencies between Municipal Code Section 10-1.703 (c) of the Town Zoning Ordinance with State requirements regarding Mobile Homes ( Ms. Lytle referred to Staff Report dated July 2, 1987, informing 4/ Commission at the last Commission meeting, Commissioner Kaufman requested that staff analyze any discrepancies between the Municipal Code and State Law, noting staff does not find any inconsistencies between the two, also Commissioner Struthers asked if the Town did not issue temporary permits for trailers to be used on site during construction of new resisdences, noting staff has allowed this use on 3 properties in the last 3 years, requiring the owner of the lot to enter into an agreement consisten with Municipal Code Section 10-1.702(d). Ms. Lytle recommended that the Commission review the attached materials and direct staff to continue the current policy of allowing temporary construction and security related trailers with building permits for new residences. Commissioner Stutz questioned if the Town allows Mobile Homes as living units? Ms. Lytle noted we could allow with approval of a Site Development Permit which would be handled as a new residence. noting mobile homes must be on foundations. Mrs. Emling, 11853 Murietta Lane, commented on Ms. Lytle's staff report noting the statement is very clear, consistency in our zoning ordinances is very important and makes us what we are. Planning Commission Minutes - July 8, 1987 Page Seven Date of Scheduled Joint Study Session The City Council at their regular meeting of July 1, 1987, set Thursday, July 23, 1987 at 4 00 P.M. as the date for Joint Study Session, items scheduled for discussion are: 1) Quarry Hills Development (Vidovich) EIP Consultants will be in attendance 2) Variances Ms. Lytle informed Commission that EIP (consultant) will be conducting meeting for Quarry Hills and Mr. John Vidovich (applicant) will be in attendance to give a brief statement on the proposed project. Ms. Lytle noted that the Consultant will distribute a questionare on the project, and indicated that the public is invited to attend the Study Session but this is not a public hearing, noting this study session is for City Council and Planning Commissioners to give comments so that the consultant can get moving along on the project. Ms. Lytle informed Commission that the contract with the Consultant is to: 1) prepare an environmental assessment; and 2) constraints and opportunity analysis (then develop alternatives available). Commissioner Patmore indicated that some weeks ago she requested a briefing of the Vidovich application, noting we now have study session for discussion of an EIR on a project that we don't even know if we want to annex, asking why the applicant is spending so much money now? Noting she would prefer a briefing of the application. not a presentation on the EIR by EIP. Ms. Lytle informed Commissioners that this is what the applicant has proceeded with, noting it is important to have this Study Session early enough in the process of the project so that the application is well informed of community input. Commissioner Struthers indicated that property owners within 300' of the project should be notified of this Study Session. Ms. Lytle indicated staff will check with the City Manager on the mailing of the study session. Mr. David Proft, 26271 Moody Road. informed Commissioners that a few years ago there was another application on file with the Town for this property, and it received much concern from citizens, asking that neighbors be informed of the Study Session. 3. Commissioner Emling questioned the color of the Shockly house constructed on Moody Road, indicating that it has just recently been repainted "pink", asking if it was approved to be earth tones? Chairman Yanez indicated it is pink, and was painted within the last two weeks. Mr. Enright informed Commission, that staff will research the file with regard to the color of the resisdence, and will return with the results at the next meeting. Commissioner Emling questioned a potential water problem on Moody Road, which runs past Anderson to Somekh property and across Moody Road. Mr. Emling asked why the water does not go into the proposed culvert? Mr. Enright indicated that as it turns outthe PG&E gas lines prohibited the culvert installation at a deeper depth, and will have to check further into why it is not draining correctly. 5. Chairman Yanez referred to information received with regard to conference on aesthetics, on August 27th - 29th, asking if anyone is interested in attending, questioning if there is any money available for attendance. Chairman Yanez indicated he would be interested in attending the conference. Commissioners and Ms. Lytle discussed the conference to be held in Oakland on Thursday, July 16th. Ms. Lytle informed Commissioners that she will be attending with Mike Enright and Bill Siegel. 6. Commissioner Struthers that her term of office is Commissioner Kaufmans term we are in conformance with last meeting. Commissioner meeting. OLD BUSINESS: indicated that the City Clerk has discovered mixed up, and she has one (1) more year. is expired and he needs to reapply, noting that the Ordinance 2-2-2-1 as we voted on at the Kaufman will be re -appointed at the next Hidden Villa Master Plan Conditional Use Permit, County of Santa Clara Commissioner Struthers informed Commissioners of meeting held at the County Offices and referred to the Report prepared by Lee Patmore, noting she has obtained a copy of the contract of Hidden Villa with Open Space which indicates that Hidden Villa cannot do any more than what they are currently doing. Struthers noted the outcome of the County meeting is to allow a 90 day continuance and then public presentation as part of the public hearing to inform Community of proposals at Hidden Villa, noting September 9, 1987 has been scheduled for the Planning Commission public presentation and then back to the County on October 7, 1987. Chairman Yanez informed Commission that he received a telephone call from Ann Smith, Director at Hidden Villa and she is delighted to come to public hearing, and invites the neighbors, etc., to attend, she assured me that the level of involvement will not increase what is already happening at Hidden Villa. Planning Commission Minutes - July 8, 1987 Page Nine Commissioner Emling thanked Commissioner Patmore for her well written report and attendance of the County meeting, informing Commission that next week the Board of Directors will have an open meeting to show the location of proposals. etc. Commissioner Patmore indicated we should send a representative to the July 16, 1987 meeting which will be held at 7:30 p.m. to meet at the lower field. Passed by Consensus that the Subcommittee should attend the meeting. K.
