ROLL CALL AND PLEDGE OF ALLEGIANCE Planning Commission meeting was called to order at 7:30 p.m. in the Council Chambers at Town Hall. Present: Chairman Pahl, Commissioners Cheng, Comiso, Schreiner, Sinunu & Stutz Absent: Commissioner Ellinger Staff: Linda Niles, Town Planner; Lani Lonberger, Planning Secretary 2. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Commission on any subject not on the agenda are invited to do so now. Please note, however, that the Commission is not able to undertake extended discussion or take action tonight on non-agendized items. Such items will be referred to Staff or placed on the agenda for a future meeting. None 3. CONSENT CALENDAR Items appearing on the Consent Calendar are considered routine and will be adopted in one motion, except for any item removed for separate consideration elsewhere on the agenda. The Chairman will ask the Commission and the audience for requests to remove these items. None 4. REPORT FROM THE CITY COUNCIL MEETING OF MAY 19,1993 4.1 Planning Commission Representative was Commissioner Cheng. Items discussed at the City Council meeting were: consent calendar items approved; Mayor agreed with the Planning Commission's decision regarding a continuance on the Lands of Lee; request from Luis Yanez for exception to current basement floor area calculation 4 interpretation was denied; Stonebrook truck accident discussed; request for a tentative `, map for a two lot subdivision for Lands of Merrill was denied. 4 Planning Commission Minutes May 26, 1993 Page 2 APPROVED The Planning Commission Representative for June 2, 1993 will be Chairman Pahl. 5. P I H .ARIN 5.1 LANDS OF VETTERLEIN, 26035 Todd Lane; A request for a Site Development Permit for a Second Unit. Ms. Niles introduced this item stating that there was nothing to add to the staff report. Commissioner Schreiner questioned the carport and it was explained that the carport was not counted as floor area as it was not enclosed on three sides. It was added as development area. OPENED PUBLIC HEARING Susan Roberts, Giuliani and Kull, 20431 Stevens Creek Blvd., Cupertino, applicant's representative, stated that they have been working with staff and the neighbors on this project. There were no problems with the conditions of approval. Ms. Roberts stated they had spoken with the adjoining neighbors and all seemed happy with the project. It was mentioned that Todd Lane has an architectural review committee who provided the Planning Commission with a statement of approval for this project. Commissioner Schreiner asked if there were any future plans to enclose the carport for a possible shop as there was enough floor area left after construction of the second unit. Ms. Roberts replied yes. CLOSED PUBLIC HEARING Commissioner Schreiner felt the project fit well on the site. Her only concern was the development area was maxed, however, there is 662 sq. ft. left in floor area. MOTION SECONDED AND PASSED: Motion by Commissioner Schreiner and seconded by Commissioner Comiso to approve as conditioned by staff. AYES: Chairman Pahl, Commissioners Simmu, Stutz, Cheng, Comiso & Schreiner NOES: None ABSENT: Commissioner Ellinger This item will appear on the City Council consent calendar on June 2,1993. Planning Commission Minutes APPROVED May 26,1993 Page 3 5.2 LANDS OF FATEMI, 25691 La Lanne Court; A request for a Site Development Permit for a Major Addition, Pool, and Poolhouse. This item was continued to June 9th. 5.3 LANDS OF GARROW, 13910 Mir Mirou Drive; A request for a Site Development Permit for a New Residence, Pool and Spa (continued from March 10,1993). Ms. Niles introduced this item stating there was nothing further to add to the staff report. Commissioner Schreiner asked for the exempt figures for the basement which Ms. Niles stated were 1,964 sq. ft. It was clarified that crawl space is not counted in the exempt figure for a basement. Commissioner Schreiner was also interested in condition 16 regarding the common driveway required on Tract Map 6604 being replaced by the individual driveway as shown on the site plans dated May 11, 1993 and asked Ms. Niles how that read in the conditions from the previous subdivision. Ms. Niles stated the conditions of approval on the final map read that lots 2,3 and 4 would provide common driveway easements for that particular lot combination, however, it also stated, revised and amended by Council on February 21, 1979, that the common driveways may be replaced by individual driveways with the approval of the Site Development Committee at that time. OPENED PUBLIC HEARING Robert Garrow, 13912 Mir Mirou, applicant, stated they had incorporated all of the Planning Commission comments into their plan. He felt that the comments had actually improved the overall plan. With the redesign, they have been able to: reduce the export by 53% from that previously proposed; the house has been rotated forward about 10' on the right side; moved the garage back 2'; raised the pad for the house about 12" and for the patio about 18" to lessen the required grading; the pool length has been reduced along with the related hardscape behind the pool; the lawn to be contoured to follow the natural contours of the terrain; the roof line of two gables in the front has been lowered and they have lowered the height of the windows that were above the front door. Mr. Garrow also discussed the lay of the land behind the house, contours and the mature oak trees. There will be additional planting of trees in the back to provide privacy for the two properties. He felt that the general look in the back of the property will be preserved. Chairman Pahl asked Mr. Garrow if he had read and agreed with the conditions of approval. He discussed #14 with regard to the recorded restriction being required. Mr. Garrow had no problem with the restriction. Planning Commission Minutes APPROVED May 26,1993 Page 4 It was noted that condition 14 in the staff report should be corrected to exclude the wording "and maximum development area". CLOSED PUBLIC HEARING Commissioner Comiso thanked the applicants for their hard work on this project and felt the house was beautiful. MOTION SECONDED AND PASSED: Motion by Commissioner Comiso and seconded by Commissioner Stutz to approve the application with change to condition 14 eliminating the wording "and maximum development area'. AYES: Chairman Pahl, Commissioners Schreiner, Sinunu, Stutz, Cheng & Comiso NOES: None ABSENT: Commissioner Ellinger This item will appear on the City Council consent calendar for June 2,1993. Ms. Niles explained the 10 day appeal period and that all conditions listed at the end of the Staff Report must be completed/reviewed and signed off by the Town Planner and the City Engineer prior to acceptance of construction plans for plan check by the (, building department. NEW BUSINESS None 8. APPROVAL OF THE MINUITS OF MAY 12 1993 MOTION SECONDED AND PASSED: Motion by Commissioner Stutz, seconded by Commissioner Schreiner and passed by consensus to approve the minutes of May 12 , 1993 with Commissioner Sinunu abstaining and Commissioner Ellinger absent. 9. REPORT FROM THE SITE DEVELOPMENT COMMITTEE MEETING There were no scheduled Site Development Committee meetings. 7. OLD BUSINESS 7.1 Discussion of the Recreation Element of the General Plan. This was introduced by Commission Schreiner. She provided the Planning Commission with an amended copy of the element. Carol Gottlieb read the Element and made some suggestions which she felt should be incorporated. Planning Commission Minutes APPROVED May 26,1993 Page 5 4 Items discussed: Recreation Element was written in 1974. Possibly the Recreation Element should be written from scratch; value of the little league field presently for recreation for the Town citizens; senior center or community center; limited area in Town; possibly use the little league field for other activities; perhaps add certain percentage or area that would be required around a house that would be usable as recreation space; pool and tennis court at a senior center; provide recreation for all ages; Neary Quarry lake, private or public; more urban than rural activities needed. Commissioner Schreiner requested input on future needs. It was felt that recreation depends solely on how the land was used, and land use depends on recreation. Commissioners Schreiner and Stutz were complimented on their work on the Recreation Element. 7.2 Discussion of the Land Use Element of the General Plan. This was introduced by Commissioners Sinunu and Cheng. It was thought, as suggested with the Recreation Element, that perhaps it should be re -written rather than updated. The concept of the Town being built out should be mentioned. Another suggestion was to eliminate the wording "Residential Unit #" as it is outdated terminology. Reference should be made to the area and/or street name instead. Discussion included: mentioning the LUF; formula for MDA and MFA; sensitive to the neighborhood, terrain and character of the area. 10.
