Present: Commissioners Gottlieb, Jinkerson, Wong, Cottrell & Schreiner Staff: Ola Balogun, Associate Engineer, Carl Cahill, Acting Planning Director; Shaunn O'Connor, Assistant Planner; Lam Smith, Planning Secretary 2. PRESENTATIONS FROM THE FLOOR -none l 3. PUBLIC HEARINGS 3.1 LANDS OF AU, 12870 Robleda Road (271-99-ZP-SD-GD); A request for a Site Development Permit for a new residence and pool (continued from May 24, 2000). Staff had nothing further to add to the report. Commissioner Wong disclosed he had listened to the tape of the previous public hearing. OPENED PUBLIC HEARING Dean Au, 11021 Lund Ranch Road, Pleasanton, applicant, provided a handout describing the rationale and changes to the plan involving: (1) one neighbor's concerns; (2) visual impact from Robleda Road side; (3) lighting plan; and (4) driveway impact on trees. To resolve the neighbor's concern he made the following changes: redesigned two bedrooms with a new setback of 39 to 45 feet; reduced the number of windows and size; moved one skylight away from the Chen house; lowered the house by one foot; offered landscape screening; and oak trees #73, 74 and 75 are preserved. Regarding visual impact, they are visible from across the valley with only partially visible from Alta Tierra Lane, and no impact from Foothill College. Solutions to reduce visibility included lowering the whole structure by one foot, planting 25 foot evergreen trees (condition #5), and lowering the profile by stepping the structure down with the terrain. To improve lighting, they will remove all of the driveway lights between Station 0 and ( 750, and reduce the backyard path lights. Improvements to the driveway include the new driveway design with the Fire Department approval, and arborist updated report indicating an additional 24 trees will be saved (14 are oak trees). Planning Commission Minutes Approved 6/28/00 June 14, 2000 Page 2 4 Bruce Lyons, 2551 San Ramon Valley Blvd., San Ramon, project architect, stated the fire department did approve the 12 foot driveway width with an additional 1 to 2 feet for the grading of the retaining wall. They have reduced the grading area on the uphill side of the property with a very small section of cut which has been increased to 9 feet. Commissioner Gottlieb asked if the colors will conform with the Town Color Board as the site is visible. Mr. Lyons responded yes. He further discussed widening the driveway entrance for safety. Mr. Chan, 25545 O'Keefe Lane, reiterated his concerns voiced at the previous meeting. He requested trees and/or large shrub plantings between the two properties, with maximum height 15 feet. The applicant agreed. Sandy Humphries, Environmental Design Committee, asked that the Italian Cypress be deleted or changed so the view will not be blocked or a change in type. CLOSED PUBLIC HEARING Commissioner Gottlieb was still concerned with off site visibility. The materials used for the roofing and balustrades were very important especially from Alta Tierra Lane. Finding for the house and roof colors were to aid in blending the stmcture into the site. Also, condition #2 should be changed to require a three to one oak tree replacement. Commissioner Cottrell agreed. Chairman Jinkerson thanked the applicants and their architect for communicating with the Chans kor and other neighbors. MOTION SECONDED AND PASSED: Motion by Commissioner Cottrell and seconded by Commissioner Gottlieb to approve the Site Development Permit for a new residence and pool, Lands of An, 12870 Robleda Road, with the following additions/changes to the conditions of approval: removal of driveway lights between station 0 and 750 and reduce back yard path lights; 15 feet maximum tree height between the An and Chan properties; condition #2, three to one oak tree replacement; condition #8, no skylights shall be placed in direct view of the adjacent home to the east; #19, add "minimum of 14 feet wide except where otherwise approved by the Fire Department"; and findings for conformance with the color board due to high visibility from all directions from off site. Color conformance shall include the balustrades. AYES: Chairman Jinkerson, Commissioners Schreiner, Wong, Gottlieb & Cottrell NOES: None 3.2 LANDS OF ASKARINAM, 27830 Elena Road (281 -99 -TM -GD -ND); A request to subdivide a 5.08 acre parcel into three (3) lots, and proposed Negative Declaration (continued from April 12, 2000). Staff had nothing further to add to the report. Commissioner Cottrell disclosed he had listened to the tape of the previous public hearing. It was clarified that at the June 15L City Council meeting L the Council passed unanimously to determine that sanitary sewer lift stations may be used to #A/ provide sanitary sewer service to properties in Town and that they shall be privately constructed but that they may be maintained by the Town depending upon the number of properties that they Planning Commission Minutes Approved 6/28/00 June 14, 2000 ( Page 3 serve. Council further approved the installation of a generator for the proposed lift station at the Askarinam subdivision on Elena Road. OPENED PUBLIC HEARING Behrooz Askarianam, 27830 Elena Road, applicant, discussed the septic system approval and the existing driveway entrance to balance traffic. Everyone supports the access. He does not want three lots serviced by one access. He had no issue with the pathway dedication. Cart Cahill noted that engineering felt the driveway proposal was acceptable. Commissioner Schreiner was concerned with safety if backing out. Mr. Askarianam indicated that 30-40 feet of driveway would allow cars to safely make a turn. This makes it easier and safer for people to get in and out. Commissioner Gottlieb indicted that they do not normally put a driveway on a curve. She further discussed the major swale on Lots B & C which was discussed by the geologist. Scott Vanderlip, Pathways Committee, explained the pathway amendment (conditions #21) CLOSED PUBLIC HEARING Commissioner Gottlieb was troubled with the driveway. This is an old lot. When you subdivide you improve the property. She also felt there was a problem if the house on Lot C was built on the swale (move residence). Commissioner Cottrell appreciated the problems with the driveway but he was not sure they could improve the driveway. He suggested they widen it on the uphill side. The applicants have worked with staff to find boundaries. Otherwise he was in favor of the application. Commissioner Wong agreed. There needs to be some kind of turn around for safety. Commissioner Schreiner felt there were problems with the driveway and the Negative Declaration did not adequately address the lift station and the impacts on the surrounding areas. Mr. Cahill addressed the fail safe issues for the lift station and generator. Commissioner Schreiner asked if there was a study done on the lift station and if so, she requested a copy. She felt there were areas in the Negative Declaration which should be changed to "potentially significant" under IX. HAZARDS and XII. UTILITIES AND SERVICE SYSTEMS. Commissioner Cottrell noted at the City Council meeting there was mention of the Town taking over the lift station in one year and some compensation to the applicant for the cost (reimbursement agreement). Chairman Jinkerson was concerned with the driveway but the thought of three families using one driveway was not advisable. He asked the applicant's engineer about redesigning the driveway entrance for safety. Jeff Lea, applicant's engineer, stated he could work with staff. He felt there was more that could be done to improve that condition so people are not stuck with an unsafe backing out condition on Elena Road. He appreciated Commissioner Cottrell's suggestion. Chairman Jinkerson further discussed the potential of 125 connections to sewer. He asked that the Negative Declaration be expanded to more clearly identify potential impacts (strengthen). The public has the right to know that Los Altos Hills has not had much experience with lift stations (protect the safety of the community). Planning Commission Minutes Approved 6/28/00 June 14, 2000 Page 4 Commissioner Gottlieb would like the application continued to address reworking of the driveway, expansion of the Negative Declaration, and the impact on the Swale. Discussion ensued. It was felt staff could make the necessary changes. MOTION SECONDED AND PASSED: Motion by Commissioner Cottrell, seconded by Commissioner Wong, and amended to recommend approval to the City Council for a request to subdivide a 5.08 acre parcel into three (3) lots, and proposed Negative Declaration, Lands of Askarinam, 27830 Elena Road, with the following additions/changes to the conditions of approval and Negative Declaration: amend the Negative Declaration to expand on the lift station requirements relative to IX. HAZARDS a, c, and d changed to potentially significant; applicant to work with staff to improve the upper driveway entrance on Elena Road and add a turnaround for cars that mistakenly enter that driveway; that the applicant satisfactorily address any drainage issues relative to the swale that runs through Parcels B and C to the satisfaction of the City Engineer; and change condition #21 to be condition #10a under Land and Easement Dedications. AYES: Chairman Jinkerson, Commissioners Gottlieb, Wong, Schreiner & Cottrell NOES: None This item will be scheduled for a City Council public hearing agenda. Brief break at 7:55 p.m. 3.3 LANDS OF NAIR, 24680 Prospect Avenue (330-99-ZP-SD-GD); A request for a Site Development Permit for a new residence (continued from May 24, 2000). Staff noted that the applicant has shifted the location of the garage and its proposed floor area. The correct location is as shown on the enclosed set. There was also an error in the MDAJMFA table which as been corrected. It was noted that the second story over the garage would not be considered a secondary unit due to the lack of kitchen facilities and due to the size (over 1,000 square feet combined). Also, there is not an interior staircase from the lower portion to the upper. A disclosure statement regarding preventing turning the area into a secondary dwelling could be required. Commissioner Schreiner felt the dome should be considered a part of the roof and should comply with the color policy. OPENED PUBLIC HEARING Jeanine Unterleitner, Mountain View, project designer, discussed the staff report. She indicated that the arborist had visited the site finding no concerns or issues with the adjacency to the new addition to the trees and will be supplying a written report. Also, most of the garage not used for cars will be used for storage space. She provided a rending of the project for review. Commissioner Schreiner felt there may he an issue with the dome (shine) but it was noted that once patinaed it would be dull. Ms. Unterleitner continued by discussing the needed square footage and a single story design (many trees and landscaping would need to be removed) versus a two story design. Maintaining the trees is very important to the applicants. She worked with kw the design to reduce bulk and mass (the existing house has a third story). The fire department minimum requirement for the porte cochre is 14 feet. The highest point of the proposed porte Planning Commission Minutes Approved 6/28/00 June 14, 2000 Page 5 cochre is 17.5 feet. The planter section in the middle of the driveway will be removed to accommodate the fire turnaround. Commissioner Gottlieb felt the house siting on a knoll does not have much mitigation of the roof line. Ms. Unterleitner felt she could make some modifications to the ridge which would be mostly cosmetic. She would be happy to look at ways to break up the roofline. Commissioner Gottlieb felt the area of concern was the high roof line which if brought down would be less visible from off site (currently at 24 feet) from Oak Knoll Circle and Stonebrook Drive. Ms. Unterleitner agreed it could be brought down lower. Commissioner Wong asked if the applicants would be willing to plant more trees as a mitigation measure for the height for the center portion of the structure. Mrs. Nair did not feel the area was visible due to the existing trees. She would be happy to plant more trees if there was an area for more. Currently they have 88 walnut trees and many oaks. Sandy Humphries, Environmental Design Committee, felt the proposed skylights were excessive. Commissioner Gottlieb questioned the portion of Prospect Avenue where the pathway is on the other side until you come to Juan Prado Mesa which is the end of the path. However, there is a continuous path along this side of Prospect Avenue all the way down to the Quarry. She did not see any mention of the improvement to the path on Stonebrook Drive. Scott Vanderlip, Pathways Committee, will investigate to see if an additional piece of path needs to be added. CLOSED PUBLIC HEARING Commissioner Schreiner felt the basic issue was the amount of second story that is being allowed on a very visible hillside. In the past, they have tried to limit the second story to a smaller percentage of first floor and this has structural features which makes it very prominent (18 feet in diameter). She referred to the project on Dawson Drive where there was similar design features and the changes requested. Ms. Unterleitner stated that there is a flat roof up above the dome and the railing is only decorative. There is no access into that area. There are doors leading into the cupola on the second floor. She indicated that siting the second story back would change the design. She would rather increase the first floor area, however it would impact trees. Commissioner Schreiner continued voicing concern with the impact of visibility. In the past, they have asked applicants for a reduction of a second story. She would rather see more on the first floor. She was also concerned with the pone cochre mentioning the example on Fremont Pines Lane. Commissioner Wong felt the design was great except for the areas viewed from the Stonebrook Drive side which needs mitigation. Commissioner Cottrell discussed this very large lot with very large setbacks with existing landscaping. He did not feel the house was visible and certainly not as tall as the existing house with the high tower. He felt it was subjective saying the second floor was 48% of the first floor. He felt landscaping could mitigate the appearance from (, off site. Commissioner Gottlieb commented on the appearance of a three story element with the aI upper balcony. The element she was most concerned with was the center element which is 24 feet in height. She requested a reduction in height to reduce the visibility from off site. She was Planning Commission Minutes Approved 628/00 June 14, 2000 Page 6 4 not as concerned with the porte cochre as it faces into the property. Chairman Jinkerson agreed with Commissioner Cottrell in that they do not want subjectivity. This is a two story on a ridgeline, and a visible site from some areas. However, there is already a second and third story although you could say they are increasing the second story eight times more than existing. The dome and railing gives the impression of a third story. The applicant has suggested they could increase the size of the first floor which would be preferable. He suggested a redesign of the second story keeping in mind the possible increase to the first floor. Commissioner Schreiner agreed that the center portion of the structure gives an appearance of three stories. Commissioner Wong felt it was the second set of railing which gave the structure a three story element suggesting its removal. Discussion ensued. It was felt the two most prominent elements where the two flat roof areas. It would be helpful if they could be brought down or changed. When asked if they were willing to continue the application, Ms. Unterleitner stated she felt the upper railing was purely decorative (no access). This would be a simple modification. She felt it would change the architectural style of the structure to have the second story set back. She would need to discuss this with the applicants. The applicants consented to a continuance. MOTION SECONDED AND PASSED: Motion by Commissioner Gottlieb and seconded by Commissioner Cottrell to continue a request for a Site Development Permit for a new residence, Lands of Nair, 24680 Prospect Avenue, to June 28th at 6:00 p.m. to address the following: redesign the second story to nestle in with the first floor; mitigate the two roof flat areas (bring down) to reduce bulk; and to eliminate the upper balcony. AYES: Chairman Jinkerson, Commissioners Wong, Schreiner, Gottlieb & Cottrell NOES: None 3.4 LANDS OF NUENHUIS & BROERING, 12175 Hilltop Drive (89-00-ZP-SD- GD); A request for a Site Development Permit for a new residence. The Commission questioned the status of the grading and pool which were accomplished without prior approval or permits. Staff had determined that the pool could be included in the notice for the new residence and it would be reviewed for compliance with the Town's Codes and Policies. Additionally, the applicant will be required to meet the maximum development area allowed on the site (8,072 square feet). This will require the applicant to remove some existing development area. It was noted that there are four outside parking spaces proposed but the project does not include a garage or carport. The height of the structure as shown on the plan was discussed. Commissioner Gottlieb disclosed she is within 2,500 feet from the project site but will have no direct impact from the project. OPENED PUBLIC HEARING Frank Mayo, 5150 EI Camino Real, Los Altos, applicant's attorney, mentioned his letter dated June 1" regarding the understanding and agreement reached with Tina Darmohray and Charles Marker regarding the easement issues they have raised in connection with the improvements to the applicant's site (condition #4). He further discussed the request for a 10 foot pathway easement adjacent to the eastern property line (condition #6) which he felt would impact the Planning Commission Minutes Approved 6/28/00 June 14, 2000 ( Page 7 41Wdevelopment area. There is a private roadway owned by the neighbors which he felt was a natural place for the pathway to be installed with enough room without impacting the development area. Roland Nijenhuis, 12175 Hilltop Drive, applicant, discussed the aspects of the design which he felt all met code. He did not know they would have neighbor objections. He had looked at the design from the neighbors prospective (took photos) and had listened to their objections through meetings although many neighbors could not attend. After talking to the neighbors, he felt the project would have minimal impact. Privacy and easement issues could be worked out with the neighbors. Any road damage has been addressed under the conditions of approval. He further discussed drainage, no proposed garage or carport, and landscaping after framing. They could plant trees prior to construction but would rather not due to obstructing construction. Michaela Broering, 12175 Hilltop Drive, applicant, discussed the history of the design. The house is small for their family needs so they have lived in the house to see what would be best design. They did not realize they would have neighborhood opposition. They should have approached the neighbors regarding improving the site. The plan is for a one story structure with the entry element at 27 feet high. Jade Lum, 25935 Estacada Drive, Los Altos Hills, architect, the design focused on getting direct sunlight into the house. There is a limited area for sunlight exposure. She discussed not proposing a garage or carport at this time. The footprint is only 3,400 square feet which is small for Los Altos Hills. There is enough development area left for a two car garage. She further discussed the use of materials, colors and planting trees after construction. Commissioner Schreiner felt now was the time to see where a garage or carport could be located while they were siting the house so it would not impact the house. Ms. Lum stated they have discussed the possibility of putting a garage under the family room, however it would be a costly project. Al Stewart, 12165 Hilltop Drive, discussed: the west section being 27 feet in height; no garage; an inside laundry room; homeowner's disregard for proper permits; and the cutting down of live trees. He provided a photo of the outside laundry facilities. Currently the applicants are doing their laundry outside. He was concerned that there was no garage proposed and there appears to be a lack of storage areas. He further discussed the construction of pool and deck without permits and trees removed prior to the Site Development process. He asked that the center portion of the structure be lowered as he did not feel the design fit into the neighborhood. He also did not feel the siting of the house was correct as it runs into the bank where there will be three retaining walls. A split level house would be more appropriate for the site. Peggy Stewart, 12165 Hilltop Drive, noted that when they built their home they had to build around trees. N Planning Commission Minutes Approved 6/28100 June 14, 2000 Page 8 Roger Cruickshank, 12179 Hilltop Drive, asked if the applicants were complying with all Town codes how they miss obtaining approval and permits for the pool, decking and cutting down trees. The height of the house is obtrusive and prominent. Twenty-seven feet for a one story home was excessive. He would like to see their landscaping plans. His home is located across from the applicants and he has enough sun exposure. He asked the Commission to deal with the garage issue now. Tina Darmohray, 12171 Hilltop Drive, discussed the easement which is shared by five properties. There has been a huge impact from the tree removal and the pool construction. She voiced the following concerns: visual impact; water shed (no grading plan); and impact of the construction vehicles and spill over parking. There has been numerous times when the driveway has been blocked. She provided a letter for review from Frank Mayo, attorney, noting their intent to sue regarding the access easement. Each neighbor owns 16 feet (32 feet combined) of easement. There has been no agreement regarding the easement. They already have a way to get in and out of their property. She suggested that they address the shear walls, provide enough on site parking and follow the Town rules. She referred to the June lay letter from the applicant's attorney stating they have no agreement. Scott Vanderlip, Pathways Committee, reiterated pathway request. Chairman Jinkerson asked if they can request a pathway easement when the easement is in litigation. Mr. Vanderlip stated this was the reason they requested either a 10 foot pathway easement along the east edge of the property or grant an easement over the shared driveway. He would prefer an off road path. Mr. O'Connor, for clarification, stated currently the option was to have it on the eastern side of the property adjacent to the easement in dispute. If they look at the development which has occurred with the easement going down it basically dead ends into the Harati property which was recently developed. He felt the logical way to run the pathway was down the easterly property line. Sandy Humphries, Environmental Design Committee, requested that the existing oak trees behind the house be preserved in a conservation easement. Frank Mayo, attorney, discussed the easement noting that the driveway has been in the same location for 14 years or more. There is obviously a prescriptive easement. Mr. Brenner has consented to the easement. He is trying to resolve this issue. Marvin Kirkeby, 2397 Forest Avenue, San Jose, project engineer, noted that there are five houses which are serviced by the 30 foot driveway since 1957. A part of the existing structure is a retaining wall into the hill now. The drainage problems in part are caused by the Stewart property. He noted that the retaining wall in front of the pool is 3'/a feet. Jade Lum provided photographs taken around the neighborhood which she felt show minimal impact, or if any can, be mitigated with trees. They have satisfied the requirement for a 27 foot height. They are not asking for anything unusual. They have already made a major concession by cutting back the house. They are surrounded by two story homes. There is no zoning requirement for a garage. Mr. Stewart stated that the grading has not changed since 1975. Planning Commission Minutes Approved 6/28/00 June 14, 2000 Page 9 ( CLOSED PUBLIC HEARING Commissioner Cottrell noted the application with neighborhood opposition. There is a need to communicate with the neighbors. The issues are the easement, need for road maintenance agreement, need for a landscape plan, a drainage plan, and redo roofline. He does not see an approval until issues resolved. Commissioner Gottlieb referred to the seismic report and the pool location. She felt the roof line needed to be changed, where a garage could be located, and clarify grading. Commissioner Schreiner agreed. They cannot go forward until the easement access is settled. She questioned the Town's liability regarding the pool. She suggested dropping the height of the house. She was concerned with the lack of a garage or carport not being proposed. At some point someone will want an enclosure. She would like the garage to be factored in immediately. Commissioner Wong agreed with all concerns. It is necessary to have an area to park cars. Chairman Jinkerson disclosed that he had spoken to the applicants and visited the site. He felt they could reduce the 27 foot height to 24' or 25'. Also he has not seen a house come in without at least a carport. A two car garage is preferable. The pool, retaining will and tree removal all need to be resolved. A partial landscape plan would create goodwill due to the amount of vegetation already removed. He heard positive ideas from the neighbors as to how to improve the plans. The road issue needs to be resolved as well as any drainage issues. He suggested conferring with the City Attorney regarding the easement . The applicant's attorney would also like to work with the City Attorney. Chairman Jinkerson and Frank Mayo will contact the City Attorney. MOTION SECONDED AND PASSED: Motion by Commissioner Cottrell and seconded by Commissioner Schreiner to continue (with the agreement of the applicants) the request for a Site Development Permit for a new residence, Lands of Nijenhuis & Broering, 12175 Hilltop Drive, to June 28`s at 6:00 p.m. to address the issues as previously discussed by the neighbors and Commission. AYES: Chairman Jinkerson, Commissioners Wong, Schreiner, Gottlieb & Cottrell NOES: None 3.5 Proposed Ordinance of the Town of Los Altos Hills amending the Zoning Code to pre -zone properties to R -A (Residential -Agricultural); 24460 Summerhill Avenue, 24480 Amigos Court, 24490 Amigos Court, 24510 Amigos Court. Staff had nothing further to add to the report. Staff clarified the procedure for reviewing County projects within our sphere of influence.
