RESOLUTION NO. 15-89
A RESOLUTION APPROVING TENTATIVE PARCEL MAP
OF LANDS OF FRAMPTON
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, the City Council having examined the proposed Tentative
Parcel Map entitled
TENTATIVE MAP
KELSEY COURT
BEING A PORTION OF LOT 44 OF THE HALE
RANCH SUBDIVISION NEAR MOUNTAIN VIEW,
BOOK I OF MAPS, PAGE 48 AND 49, RECORDS OF
SANTA CLARA COUNTY AND LYING WITHIN
THE TOWN OF LOS ALTOS HILLS, CALIFORNIA
herein referred to as the "Tentative Map"; and
WHEREAS, the Tentative Map having been reviewed by any other
public agencies entitled to do so, and the recommendations of any such public
agencies having been considered by the City Council prior to its taking action
on the Tentative map; and
WHEREAS, the City Council having conducted a hearing concerning the
Tentative Map and having considered the evidence presented at the hearing;
and
WHEREAS, the City Council having determine that the Tentative Map is
in conformity with the requirements of Chapter 4 entitled "Subdivision" of
Title 9 of the Los Altos Hills Municipal Code; and the Subdivision Map Act of
the State of California commencing at Section 66410 of the Government Code;
and
WHEREAS, the City Council having read and considered the proposed
conditions of approval concerning the Tentative Map which have been

recommended by the Planning Commission,
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as
follows:
1. The City Council of the Town of Los Altos Hills hereby approves the
above-described Tentative Map subject to performance of and compliance

with each of the Conditions of Approval which are set forth in Exhibit "A"
attached hereto, entitled"Conditions of Approval Tentative Map", and which
conditions are incorporated herein by reference and made a part of this
Resolution as though set forth fully herein.
REGULARLY passed and adopted this .18th day of Janaury, 1989.

LAND AND EASEMENT DEDICATIONS:
Hale Court, subject to approval of
1 . The applicant shall dedicate the proposed K y-f'w-art to Fire Department
the Town of Los Altos Hills as a Public Street. The Final (MIMED BY

2. The applicant
s hall record an easement for Pacific Bell tel-
ephone lines and maintenance to the satisfaction of Pacific
Bell . The Final Map shall reflect this easement.

3. Conservation Easements shall be recorded for those areas
shown on the Tentative Map. The Final Map shall reflect
these easements.
4. A storm drain easement is to be dedicated to the Town over
the creek which extends from the northerly boundary of the
subdivision to a line 20 feet south of the top of the creek
bank, for maintenance purposes. The Final Map shall reflect
this easement.
5. A storm drain easement shall be dedicated to the Town in the
location shown on the Tentative Map on Lots 1 and 2. This
storm drain easement shall be 25 feet wide . The Final Map
shall reflect this easement.
6. A Sewer Easement shall be dedicated along the Northeast
property line of Lot 1 , to connect to the adjacent Lands of
Fowler . The Final Map shall reflect this easement.
7. A 15-foot Pathway Easement shall be dedicated along the :-
northwesterly boundary of Lot #4 from Magdalena Road. A 20-
foot wide pathway easement shall be dedicated from the end
of the 15-foot easement along the property line to connect
with the existing 30-foot wide easement on the west side of
the property at 25599 Fernhill Road. The Final Map shall
reflect these easements.
PUBLIC UTILITIES:
8. All utilities, including cable television , are to be un-
dergrounded, per Municipal Code 9-1 .1105. The undergrounded
utilities shall include a conduit for cable television.

9. All lots are to be connected to the Los Altos Sewer, and
necessary improvements installed prior to recordation of the
Final Map, or a bond to the satisfaction of the Director of
Public Works posted to ensure connection prior to issuance
of Building Permits. Sewer design and construction is to be
approved by the Town of Los Altos Hills and the City of Los
Altos.
10. All lots shall be connected to California Water Service Com-
pany public water system prior to recordation of the Final
Map.
11 . All Fire Department conditions shall be met prior to accep-
tance of improvements by the Town. Location of fire
hydrants to be approved by the fire department and be shown
on the improvement plans.
12. All wells on the property shall be sealed in accordance with
Santa Clara Valley Water District standards, and to the
satisfaction of the Santa Clara Valley Water District. How-
ever , prior to removal , it shall be verified that other
property owners in the area have no rights to water from the
well .
IMPROVEMENTS:

Hills standards for a public street. The work is to be
shown on the improvement plans for the subdivision. The
work is to be done prior to recordation of the Final Map, or
a bond to the satisfaction of the Director of Public Works
posted to ensure the completion of the required work prior
to issuance of Site Development Permits.

14. The creek crossing design for 14e-sled---Eek is to be approved (AMENDED_'BY
by the Town of Los Altos Hills and , as applicable , by the COUNCIL 1/18/8!
SCVWD and the Department of Fish & Game . As required by the
Fire Department, the bridge shall be capable of supporting
35,000 lbs. or better. Improvements shall be completed
prior to recordation of the Final Map, or a bond to the
satisfaction of the Director of Public Works posted to
ensure the completion of the required work prior to issuance
of Site Development Permits.
15 . The existing AC driveway and creek crossing shall be removed
upon completion of the it I-sey--C•aurt street improvements.

The area of the existing crossing shall be revegetated with
native e riparian vegetation after the removal of the bridge

and paving. A revegetation plan shall be approved by the
Department of Fish and Game and the Town, and a bond to the
satisfaction of the Director of Public Works posted to
ensure the completion of the revegetation prior to issuance
of Site Development Permits.
16. A Type IIB pathway shall be constructed within the rights-
of-way of 14e4spy-£� t*and Magdalena Road . The work is to
be shown on the improvement plans for the subdivision. The
work is to be done prior to recordation of the Final Map, or
a bond to the satisfaction of the Director of Public Works
posted to ensure the completion of the required work prior
to issuance of Site Development Permits. *Hale Court, subject to approval of
Fire Department (AMENDED BY :COUNCIL 1118/89)
17. A 5-foot wide native pathway shall be cleared along the
alignment described in Condition #7 above . The creek cross-
ing for this pathway, if required , shall be approved by the
Town of Los Altos Hills and , as applicable , by the SCVWD and
the Department of Fish & Game . Improvements shall be com-
pleted prior to recordation of the Final Map, or a bond to
the satisfaction of the Director of Public Works posted to
ensure the completion of the required work prior to issuance
of Site Development Permits.
18. All existing trees with a circumference greater than 20" ,
except any in the proposed street right-of-way, shall be
protected during construction of subdivision improvements.
A plan for the protection of the oak trees shall be sub-
mitted with the subdivision improvement plans for the ap-
proval of the Town.
19. A plaque denoting the property as an historic site - the
location of the original home of the manager of the Hale
Ranch - is to be installed prior to acceptance of subdivi-
sion improvements by the Town.
20. A drainage plan shall be prepared as a part of the subdivi-
sion improvement plans, and drainage improvements to
eliminate any flood hazard be carried out as a part of the
subdivision improvements. The Drainage Plan and improve-
ments shall be prepared to the approval of the Director of
Public Works and the City Engineer .

shall be madeby a qualified tree surgeon and the need for_Hamid g, cabling and
other protective steps shall be reported to the Director of Public Works. Subdivider
shall perform the work prior to recordation of the final map or bond to insure that

GEOLOGY AND SOILS:
21 . A Human Habitation Setback shall be recorded on the Final
Map for the area of the fault zone as shown on the Tentative
Map. A Deed Restriction shall be recorded with the Final
Map and a note placed on the face of the Final Map noting
the Human Habitation Setback from the fault , and the no
building restriction within that setback.
22. The area within 25 feet of the hillside slopes on the south
and southeastern margins of the property in which residen-
tial structures could be exposed to hazards related to
landslide processes as indicated in the Geotechnical Report
prepared by Donald E. Banta & Associates and dated Received
October 31 , 1988 shall be delineated on the Final Map and a
note placed on the face of the Final Map noting the hazards
for residential development and the need for further evalua-
tion of the slope stability of the specific hillside area in
question in greater detail before any development within
that area .
23. Geotechnical Plan Review - The applicant ' s geotechnical con-
sultant shall review and approve all geotechnical aspects of
the development plans (i .e . , site preparation and grading,
site drainage improvements and design parameters for founda-
tions and roadways) to ensure that his recommendations have
been properly incorporated.
The results of the plan review shall be summarized by the
geotechnical consultant in a letter and submitted to the
Town Engineer* for review and approval prior to issuance of
building permits. *and the Town Geologist (AMENDED BY COUNCIL 1/1'8189)
24 . Geotechnical Field Inspection -. The geotechnical consultant
shall inspect, test (as needed) , and approve all geotechni-
cal aspects of project construction. The inspections should
include , but not necessarily be limited to: site preparation
and grading, site surface and subsurface drainage improve-
ments, and excavations for foundations and retaining walls
prior to the placement of steel and concrete.
The results of these inspections and the as-built conditions
of the project shall be described by the geotechnical con-
sultant in a letter and submitted to the Town Engineer for
review prior to final project approval .

PLANNING AND ZONING
25. All existing structures shall be removed as indicated on the
Conceptual Development plan, dated October 15, 1988, prior
to recordation of the Final Map or a bond to the satisfac-
tion of the Director of Public Works posted to ensure the
completion of the required work prior to issuance of Site
Development Permits.
