REESOLUTION NO. 27-89
A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS
HILLS DETERMINING THAT THE WORK REQUIRED TO COMPLETE
CONSTRUCTION OF MISCELLANEOUS STORM DRAINS NEEDS TO BE
PERFORMED IMMEDIATELY ON AN EMERGENCY BASIS, AND
AUTHORIZING THE ENTERING INTO OF A CONTRACT THEREFOR
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, on June 15, 1988, the City Council adopted Resolution No.
60-88 awarding to Lawrence Thomas, an individual doing business under
the name and style of L. Thomas Construction, a Contract for Construction of
Miscellaneous Storm Drains (herein called the "Public Works Project") at the
price named in his bid, to wit:
Fifty-One Thousand Eight Hundred Seventy-Five Dollars ($51,875);
and
WHEREAS, although the Contractor named above commenced work
and received progress payments the City Council of the Town of Los Altos
Hills has been advised the Contractor later abandoned and failed to
complete performance of his Contract; and
WHEREAS, in the opinion of the City Council the work in question
required to complete the storm drains needs to be performed without
further delay by reason of the immediate threat to public health and safety
which exists, by reason of the present winter weather,
NOW, THEREFORE, BE IT FURTHER RESOLVED, ORDERED, AND
DETERMINED as follows:
The City Council of the Town of Los Altos Hills hereby declares and
determines that pursuant to Section 20168 of the Public Contract Code, the

public interest and necessity demand the immediate expenditure of public
money to safeguard life and health in order to complete construction of the
storm drains.
The City Council hereby awards a Contract to complete the
construction of the storm drains to the following named person at the price
immediately following the name of the person, namely:
Vick's Pipeline Construction, Inc.,
A Corporation $38,750
The Mayor is hereby authorized and directed to execute the Contract
so awarded to the above named firm on behalf of the Town of Los Altos Hills,
and the City Clerk is hereby directed to attest her signature thereto.
REGULARLY passed and adopted this 15th day of February, 1989.
