RESOLUTION NO. 44-89
A RESOLUTION APPROVING AND AUTHORIZING EXECUTION
OF AN AGREEMENT PROVIDING FOR THE ALLOCATION OF
CAPACITIES AT THE RECYCLERY-NEWBY ISLAND LANDFILL
BETWEEN THE COUNTY OF SANTA CLARA AND
THE CITIES OF CUPERTINO AND LOS ALTOS
AND THE TOWN OF LOS ALTOS HILLS
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, the City Council of the Town of Los Altos Hills has read and
considered that certain "AGREEMENT PROVIDING FOR THE ALLOCATION OF
CAPACITIES AT THE RECYCLERY-NEWBY ISLAND LANDFILL BETWEEN THE
COUNTY OF SANTA CLARA AND THE CITIES OF CUPERTINO AND LOS ALTOS
AND THE TOWN OF LOS ALTOS HILLS," herein called the "Agreement" and
which would allocate the quantity of solid waste produced by each City to be
deposited at the Recyclery-Newby Island Landfill site over a thirty year
period between incorporated area of each City and the unincorporated areas
of the County of Santa Clara within the boundary area of that City and to
allocate the costs of disposal between each City and the County of Santa Clara,
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as
follows:
1. Public interest and convenience require entering into the

Agreement described above and the Town of Los Altos Hills hereby approves
the Agreement.
2. The Town of Los Altos Hills shall enter into, and the Mayor and City
Clerk of the Town of Los Altos Hills be, and they and each of them hereby is
authorized and directed on behalf of said Town, respectively, to execute and
attest the Agreement between the Town of Los Altos Hills, Cities of Cupertino
and Los Altos and the County of Santa Clara.
REGULARLY passed and adopted this15 day of March, 1989.
