RESOLUTION NO. 59'-89
A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF
LOS ALTOS HILLS RESCINDING AWARD OF CONTRACT FOR
CONSTRUCTION OF MISCELLANEOUS STORM DRAINS
TO VICK'S PIPELINE CONSTRUCTION, INC.
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, on February 15, 1989, the City Council adopted Resolution
No. 27-89 awarding to Vick's Pipeline Construction, Inc., a Corporation, a
Contract for Construction of Miscellaneous Storm Drains (herein called the
"Public Works Project"), on an emergency basis at the price named in its
proposal,
Thirty-Eight Thousand Seven Hundred Fifty Dollars ($38,750);
and
WHEREAS, the Contractor named above never commenced work
because it has been unable to obtain issuance of the required bonds under
the Construction Contract; and
WHEREAS, it appears to the City Council that is should order
revocation of its order to enter into the Construction Contract, described
above,
NOW, THEREFORE, IT IS HEREBY ORDERED AND DETERMINED as follows:
1. The award of a Contract for the performance of the Public Works
Project hereby is rescinded and terminated, by reason of the failure of the
Contractor to post the necessary bonds and to commence performance of the
Public Works Project.
