HomeMy WebLinkAbout105-85 • • 411 RESOLUTION NO. 105-85 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS CALLING A SPECIAL ELECTION TO BE HELD IN THE CITY. OF THE TOWN OF LOS ALTOS HILLS ONNOVEMBER5 , 1985 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS THEREOF A PROPOSED INITIATIVE ORDINANCE TO AMEND THE ZONING LAW OF THE TOWN; AND MAKING PROVISION FOR CONDUCTING SAID ELECTION AND PRO- VIDING FOR NOTICE THEREOF RESOLVED, by the City Council of the City of the Town of Los Altos Hills , County of Santa Clara, State of California, that WHEREAS, on August 7 , 1985 the City Clerk certified to the City Council that a certain Initiative Petition theretofore submitted was signed by not less than fifteen (15) percent of the voters of the City of the Town of Los Altos Hills and contained a request that the ordinance be submitted immediately to a vote of the people at a Special Election as provided in Section 4010 of the Elections Code; and WHEREAS, the City Council having determined not to introduce the proposed Initiative Ordinance without alteration at the regular meeting at which the Initiative Petition was presented; and. WHEREAS, pursuant to Section 4010 of the Elections Code, the City Council now is required to order a Special Election to be held not less than 88 nor more than 103 days from- and after August 7 , 1985, NOW, THEREFORE, it is hereby ordered and determined by the City Council of the City of the Town of Los Altos Hills, as follows: 1. A Special Election (herein the "Election") is hereby called and ordered to be held on Tuesday, the 5th day of November, 1985, within the City of the Town of Los Altos Hills for the purpose of submitting to the qualified voters of the City of the Town of Los Altos Hills the following Measure, to wit: 411 • • y MEASURE Shall the Initiative Ordinance defining and allowing a "Recreational Club" Recreational Clubs operated by a. non-profit organization on a 15 acre minimum site together with ancillary uses customary in such. a facil- ity, as a primary use in the Residential Agricultural Zoning District without a Use Permit, and repealing Municipal. Code Section 9-5.703 (d) currently. allowing Recreational Facilities only with a Use Permit in the Residential Agricultural Zoning District, be approved? 2. The City Council does hereby submit to the qualified voters of the City of the Town of Los Altos Hills , at the Election, this res- olution and the Measure set forth in Section 1 hereof. 3 . The City 'Clerk shall publish Notice of the Measure to be voted on at said Election as required by Elections Code Section 22835 . 4 . That said Election shall be held and conducted, the votes thereof canvassed, the returns thereof made, and result thereof ascertained and determined as herein provided; and in all other particulars not pre- scribed by this resolution the Election shall. be. held and conducted and the votes canvassed as provided in the Elections Code. 5. Request is hereby made, consent is hereby given and it is ordered that said Special Election shall be consolidated with.. any election or elections to be held on the same day, in the same terri.tor.y, or . in ter- ritory that is in part the same, pursuant .to the applicable provisions of Chapter 4 of Part 2 of Division 14 of the Elections Code, if, and to the extent that, the County Registrar of Voters deems such consolidation prac- tical and feasible. • 6 . The election precincts, polling places, and officers of elec- tion shall be established, designated, and appointed by the Registrar of Voters of Santa Clara County, who shall also canvass the returns and pre- pare and mail a statement of the results thereof, all as provided by the e ® • appropriate provisions of the Elections Code. 7 . That all qualified voters resident within the City of the Town of Los Altos Hills , upon the date of the Election herein pro- vided for, shall be qualified to vote upon the Measure submitted at said Election. 8 . Ballots for the Election shall be provided of the form and to the number provided by law. On said ballots , in addition to any other printed matter which may be required by law, two voting spaces shall be set off to the right of the Measure submitted at the Election, in the manner provided by law, one having the word "YES" printed before it, and the other having the word "NO" printed before it. 9 . Each voter to vote for the Measure hereby submitted and for the proposed Initiative Ordinance shall mark in the prescribed manner the voting space provided opposite the word "YES" on the ballot to the right of the Measure, and to vote against the Measure and against the proposed Initiative Ordinance shall mark in the prescribed manner the voting space provided opposite the word "NO" on the ballot to the right of the Measure. 10 . The Registrar of Voters of Santa Clara County shall be respon- sible for procuring the rosters and all other supplies necessary to properly and lawfully conduct the Election. 11. That the polls shall be opened at 7 : 00 A.M. of the day of the Election and shall be kept open until 8 : 00 P.M. of the same day, when the polls shall be closed, except as to voters in line as provided in Section 14301 of the Elections Code. 12. That the Board of Supervisors of the County of Santa Clara is hereby requested to permit the Registrar of Voters of said County -3- • • to render services relating to the conduct of said Election to be held within the City of the Town of Los Altos Hills on Tuesday, the 5th day of November, 1985 . 13 . That this City Council shall, and does hereby, accept the terms and conditions of the performance of said election services by said Registrar of Voters; and this City Council further agrees to make the payments therefor as may be set forth in a billing to the .City- Couricil from the Registrar of Voters prescribing the amount due for costs in- curred from the rendering of election services , all as provided by the provisions of Section 23524 of the Elections Code of the State of Califor- nia. 14 .
