RESOLUTION NO.. 110-85
RESOLUTION ACCEPTING AS COMPLETED A PORTION OF THE WORK
FOR THE CONSTRUCTION OF THE EDITH AVENUE BRIDGE REPLACE-
MENT IMPROVEMENTS, AUTHORIZING FINAL PAYMENT CONCERNING
SUCH WORK, AND DIRECTING THE CITY CLERK TO FILE NOTICE
OF PARTIAL COMPLETION
WHEREAS, the City Engineer-Public Works Director of the City of
the Town of Los Altos Hills, (herein called the "Town") , has, in writing,
made and filed in the Office of the City Clerk his notice or certificate
certifying that a portionof the work under contract described as
"EDITH. AVENUE BRIDGE REPLACEMENT AT THE
INTERSECTION OF EDITH AVENUE AND ADOBE CREEK"
has been completed in conformance with the plans and specifications for
said project, and has recommended that said portion be accepted as com-
plete and satisfactory; and
WHEREAS, the portion of the work performed by the above-referred
to contractor which is intended to be accepted, and no other, is de-
scribed as all of the work required to be performed except traffic control,
tubular handrailing, joint seal, rock slope protection, striping and type "D" pave-
ment marker, and chain link fence.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
the Town of Los Altos Hills, that the above-described portion of said
work by and with TIM HILLEARY as contractor, as mentioned in the said
notice or certification of said City Engineer-Public Works Director,
be and the same is hereby accepted as complete and the appropriate
officer of the TOWN is authorized to make final payment concerning the
above-described work only, exclusive of retention and subject to with-
holding of an additional sum of $ 42,938 pending completion of the
work described above remaining to be performed.

BE IT FURTHER RESOLVED that the City Clerk be, and she is
hereby authorized and directed to file with. the County Recorder of
the County of Santa Clara, notice of the partial completion of said
project within ten (10) days from the date of this Resolution.
BE IT FURTHER RESOLVED that nothing contained herein shall
affect the obligation of TIM HILLEARY to complete the remaining work
provided and in the manner specified in the above-referred to contract.
REGULARLY passed and adopted this 14th day of August, 1985 .
