BACKGROUND: On March 8, 2007, the City Council approved a 2 lot subdivision on the property at 11990 Page Mill Road (FILE #132 -06 -IS -ND -TM -GD). Condition # 7 of the subdivision approval required that "All existing and proposed utilities located within the subdivision that serve the subdivision shall be placed underground, in accordance with Subdivision Ordinance, Sec. 9-1.1105". On May 11, 2009, the City Engineer reviewed proposed subdivision improvement plans for utility undergrounding and found them to be in substantial conformance with the approved tentative map and section 9-1.1105 of the Town's Municipal Code. The City Engineer approved the plans on May 11, 2009 and an appeal was submitted by Waidy Lee (adjacent neighbor to the east) on May 12, 2009. On June 11, 2009, the City Council reviewed the appeal of the City Engineer's approval of proposed subdivision improvement plans for utility undergrounding and unanimously voted as follows: "That the matter be returned to the Planning Commission with a request that the Planning Commission consider whether findings in support of a conditional exception pursuant to 9-1.1501 could be made that would allow the segment of the utility line that is proposed to be undergrounded (Section between points C and D on the map) could remain as above ground utility lines. Assuming the Planning Commission does make such a finding, the City Council requested that the matter be scheduled for final City Council action as a consent calendar item on the July 9, 2009 City Council meeting. If the Commission is unable to make such a finding, then the matter will be returned to Council for final action on the appeal. " In addition, the City Council also directed staff to work with the Fire District, property owners and PG&E to look into reducing the fire danger. Options discussed included tree trimming, tree removal, and the use of the more fire-resistant "tree wires." DISCUSSION: At the June 11, 2009 City Council meeting, Council was in support of not requiring the property owner to underground the section of overhead utility line between C and D as shown on the attached map because the undergrounding would require a PG&E access to be installed in order to maintain the underground line and transformer (Attachment 3). The access would also need to have a hammerhead turn around and be of sufficient width for a boom truck. In addition, the Council had concerns about undergrounding the utility and constructing the access in a drainage path and directed the matter back to Planning Commission to consider findings for a conditional exception. Assuming the Planning Commission does make such findings, the City Council requested that the matter be scheduled for final City Council action as a consent calendar item on the July 9, 2009 City Council meeting. The request to further investigate the feasibility of the neighbors' proposal to underground from pole F -to E and remove the line segments A -B -C -D -E was withdrawn from the motion due to the cost and time required for PG&E to do the design. The Town's Municipal Code Section 9-1.1501 allows the Planning Commission to recommend that the City Council approve conditional exceptions from the provisions of the Subdivision Ordinance, when, in the opinion of the Planning Commission, undue hardship may result from the strict compliance with the provisions of the Ordinance, and an exception would not be contrary to the public interests. Conditional exceptions may only be recommended for approval where the Planning Commission finds that: (a) There are special circumstances or conditions affecting such property so that the strict application of the provisions of this chapter would deprive the applicant of the reasonable use of his or her land; and (b) By granting the conditional exception applied for, any other landowner shall not be deprived of the reasonable use of his or her land nor be subjected to undue burdens or -hardships or be deprived of any material use or enjoyment of his or her property. It is the Planning Commission's role to review these findings and make a recommendation to the City Council. Proposed findings of approval for the conditional exception are included in Attachment 1. In regards to the fire concerns of the neighbors, the City Council directed staff to work with the Fire District, PG&E and the property owners to look into ways of reducing the fire danger. Possible options include pruning trees to maintain a safe distance from the power lines, tree removal, and use of tree wires. Staff looked into the cost of tree wires and per PG&E it would be about $3,000 for section C -D and about $7,600 for section A- B -C (segment located on the Lands of Lee and Killian, 27961 Central Drive). These costs do not include tax, engineering, or additional guying or anchoring that may be required. Staff also confirmed with PG&E that they have been inspecting the trees on the Lands of Killian and Lee on a regular basis and PG&E's offer to remove the trees on the neighbor's property is still available. To help mitigate the fire concerns, staff is recommending that section C -D be upgraded to tree wire, pursuant to the condition of approval included as Attachment 2. ATTACHMENTS 1. There are special circumstances or conditions affecting such property so that the strict application of the provisions of this chapter would deprive the applicant of the reasonable use of his or her land The condition to underground overhead utility segment (C -D) would cause an undue hardship on the applicant because unlike typical underground utility projects, this condition would necessitate the construction of a new 210 ft. long x 12' wide PG&E utility access along the easterly property line. The PG&E improvements would also include an 850 sq. ft. hammerhead turn around to accommodate boom trucks and heavy equipment for future maintenance of the underground line and transformer. The existing area within the setbacks currently serves as a natural buffer between the subject property and the neighboring property at 27961 Central Drive. However, the proposed use of the land as a PG&E access would necessitate the removal of existing screening vegetation and convert the open space buffer to a vehicular ingress/egress. Furthermore, the undergrounding would require grading within a natural drainage area for the utility access construction and trenching for the installation of underground electrical line in a wet area, both of which is not preferable. 2. By granting the conditional exception applied for, any other landowner shall not be deprived of the reasonable use of his or her land nor be subjected to undue burdens or hardships or be deprived of any material use or enjoyment of his or her property. Leaving the existing utility line overhead would not deprive any other landowner of the reasonable use of his or her land. No change would be made to the existing overhead utility line segment C -D which is located entirely within the subject property. The conditional exception would not subject any other landowner to undue burdens or be deprived of any material use or enjoyment of their property. In fact, the conditional exception would eliminate the need for construction of the PG&E utility access road and thus significantly reduce any potential maintenance activities occurring within the property line setbacks that will generate noise, traffic, or other disturbance to the neighbors. Furthermore, the potential fire risk for C -D can be mitigated by upgrading the existing wires to tree wires,'as proposed in the attached Condition of Approval. C, RECOMMENDATION: That the City Council uphold the City Engineer's approval of the utility undergrounding plans approved May 11, 2009. BACKGROUND: On March 8, 2007, the City Council reviewed the proposed Tentative Parcel Map for a two lot subdivision and approved it with conditions shown in attachment 1. On May 11, 2009, the City Engineer reviewed the proposed subdivision improvement plans for utility undergrounding and found them to be in substantial conformance with the approved tentative map and section 9-1.1105 of the Town's Municipal Code. The proposed utility undergrounding has also been approved by PG&E and is in line with utility undergrounding requirements of other subdivisions. The City Engineer approved the plans on May 11, 2009 and an appeal was submitted by Waidy Lee (adjacent neighbor to the east) on May 12, 2009. DISCUSSION: The approved plan would underground approximately 210 feet of existing overhead wires on Brockway's property along the common property line with Waidy Lee. The work would require approximately 210 feet of trenching and installation of a new transformer, primary box and maintenance/emergency access. The plan has been designed, reviewed and approved by PG&E. The City Engineer has determined that the plans are consistent with the approved tentative map, section 9-1.1105 of the Town's Municipal Code, and previous Town requirements for other subdivisions. The neighbors object to the developers proposed plan because they would like the developer to underground overhead lines and poles on Waidy Lee's property and on Page Mill Road to reduce the risk of fire. They also contend that the "Approved Tentative Map" stamped as received April 5, 2007 is not what was approved by City Council and that a petition has been signed by 23 neighbors requesting that Brockway implement the steps necessary to perform the undergrounding as proposed by the neighbors. The neighbors also object to the maintenance/emergency access required by PG&E. Based on information provide by the neighbors, their proposed alternative would underground the same 210 feet section of overhead wires on Brockway's property and an additional 310 feet of overhead wires on Lee's property. The neighbor's proposal would require approximately 700 feet of trenching and installation of a new transformer and primary box, utilizing the new driveway on the subdivision for maintenance/emergency access. The neighbor's alternative has not been designed by PG&E thus it cannot be confirmed that it is reasonably feasible. Additional cost will need to be submitted to PG&E for research, design, and cost estimate preparation. This will result in delays to the completion -of the subdivision improvements and will likely increase the cost by $70,000 to $150,000. The neighbors did not propose the alternative design during the tentative map approval process. The developer has expended funds for the utility undergrounding work consistent with the approved tentative map. Staff recommends that the City Council uphold the City Engineer's approval allowing the developer the ability to move forward with the work to underground the utilities per the approved tentative map. MOELLER TRUST, 11990 PAGE MILL ROAD FIf F #132 -06 -IS -ND -TM -GD Tliis project is also subject to the Mitigation Measures included in the attached Initial Study and Negative Declaration. GEOTECHNICA (EARTHWORK 1. Detailed Geotechnical Investigations — Prior to approval of site development applications on individual lots, detailed design -level geotechnical engineering investigations shall be completed for proposed project improvements (with ASTM approved borings). Appropriate subsurface investigations shall be completed to characterize the distribution and engineering index properties of site earth materials (existing fill materials, colluvium, alluvium, bedrock, etc.). Recommended geotechnical design parameters shall be prepared for proposed improvements. The following items shall be specifically addressed during site investigations: a) The plan view distribution and depth of existing fills (or other deleterious materials to be removed/reworked during site grading) shall be characterized and illustrated in plan view and cross section. b) Detailed geotechnical design criteria shall be prepared for any proposed basements with emphasis on mitigation of subsurface seepage. C) Areas of previous exploratory trench excavation shall be delineated and identified for removal and re -compaction of loose backfill materials. d) Consideration shall be given to extending all house foundation piers to achieve embedment into underlying bedrock materials. e) Anticipated seismic ground shaking conditions shall be characterized considering the close proximity of the Berrocal fault. Appropriate Uniform Building Code seismic design parameters should be provided. Appropriate documentation to address the above shall be submitted to the Town for review by the Town Engineer and Town Geotechnical Consultant prior to approval of site development applications for individual lots. LAND AND EASEMENT DEDICATION 2. The applicant shall relocate or abandon existing public utility easements and grant new public utility easements where needed to all utility companies for utility construction and maintenance, including but not limited to: SBC Telephone Company, Pacific Gas and Electric Company, Comcast Cable Television, and Purissima Hills Water District. The dedications shall all be completed in conjunction with Final Map approval, to the satisfaction of the City Engineer. 3. The applicant shall dedicate right-of-way on Page Mill Road and Central Drive to the Town of Los Altos Hills to create a 30' wide half -street right of way as measured from the existing centerline as shown on the tentative map. The dedication shall be irrevocable and the road right-of-way shall be located to the satisfaction of the Town Engineer. 3a. The applicant shall work with Town staff to relocate the driveway for Parcel A to the west side of the property. The dedication of all required easements to accommodate the driveway shall be completed in conjunction with Final Map approval, to the satisfaction of the City Engineer. EMPROVEMENTS 4. A grading and drainage plan which includes an erosion control plan shall be submitted for review and approval by the City Engineer as part of the subdivision improvement plans. This plan shall conform to all standards adopted by the Town of Los Altos Hills and shall comply with all appropriate requirements of the Town's NPDES Permit relative to grading and sediment erosion control including but not limited to: a) restricting grading during the moratorium from October 15 to April 15 except with prior written approval from the Town Engineer; b) protecting all finished graded slopes from erosion using such techniques as hillside benching, erosion control matting and/or hydroseeding; c) protecting downstream storm drainage inlets from sedimentation; d) appropriate use of sediment rolls to retain sediment on the project site; e) any other suitable measures outlined in the ABAG Manual of Standards. 5. The on-site and off-site drainage improvement shall be designed as surface flow whenever possible to avoid concentration of runoff. The proposed drainage shall be designed to maintain the existing flow patterns. The applicant shall design and construct all subdivision drainage improvements as deemed necessary by the City Engineer. Storm drainage design shall be for the 100 year storm with one hour rainfall duration and shall include hydrology calculations of the existing downstream drainage channels and pipes that will receive drainage from the subdivision to determine if they have adequate capacity to safely accommodate the additional flows. All required drainage improvements including the earthen swale along the east property line of Parcel B shall be constructed or bonded for prior to recordation of the Final Map. 6. Both lots within the subdivision shall be connected to the public water system to the satisfaction of the City Engineer and Purissima Hills Water District. Services shall be installed to the property lines or be bonded for prior to recordation of the,- Final heFinal Map. An encroachment permit shall be required to be issued by the Public Works Department for all work proposed within the public right of way. Any necessary fees shall be paid prior to the recordation of the Final Map. 7. All existing and proposed utilities located within the subdivision that serve the subdivision shall be placed underground, in accordance with Subdivision Ordinance, Sec. 9-1.1105. Cable television, gas, electric, and telephone services, to the property lines are included in this requirement. Plans for the location of all such utilities are to be included in the improvement plans for the subdivision. Improvements shall be installed or bonded for prior to recordation of the Final Map. 8. Both lots within the subdivision shall be connected to the public sanitary sewer system. The applicant shall be required to obtain permission from the Killian and Lee for connecting the sewer line into - their private sewer force main prior to recordation of the Final Map. All sanitary sewer improvements shall be constructed to the satisfaction of the City Engineer. An encroachment permit must be obtained from the County of Santa Clara Public Works Department for all work proposed within the public right of way. Services shall be installed to the property lines or bonded for prior to the recordation of the Final Map. 9. A Type IIB pathway shall be constructed along the Page Mill Road frontage. The path shall be separated from the edge of pavement by five feet minimum, and to meander around trees and power pole as necessary. Improvements shall be bonded for or constructed to the satisfaction of the City Engineer prior to recordation of the Final Map. 10. A grading and construction operation plan shall be submitted by the subdivider for review and approval by the City Engineer and Planning Director prior to issuance of any permits for subdivision improvements. The grading/construction operation plan shall address truck traffic issues regarding dust, noise, and vehicular and pedestrian safety on Page Mill Road and other surrounding roadways; storage of construction materials; placement of sanitary facilities; parking for construction vehicles; and parking for construction personnel. A debris box (trash dumpster) shall be placed on site for collection of construction debris. The new residences on Parcels A and B shown on the Tentative Map Conceptual Development Plan are conceptual only, and no approval of any residence is indicated by approval of the Tentative Map. Site development applications for the new residences shall be submitted to the Planning Department for review and approval. 23. The property owner shall grant an Open Space Easement to the Town as shown on the Tentative Map page C-1. No structures are permitted and no grading or fill shall be permitted. Native vegetation may be planted within the easement but no irrigation or sprinkler systems are permitted. The property owner shall provide Ie -gal description and plat exhibits that are prepared by a licensed land surveyor or a registered civil engineer and the Town shall prepare the grant document. All required documents shall be signed and notarized by the property owner and returned to the Town prior to recordation of the Final Map. 24. The applicant shall file a Notice of Intent to comply with the State's National Pollutant Discharge Elimination System General Permit for Storm Water Discharge associated with construction activity with the State Water Resources Control Board prior to recordation of the Final Map. 25. The applicant shall prepare, implement, and maintain Stormwater Pollution Prevention Plan and provide measures to minimize or eliminate pollutant discharges from construction activities, the parking areas, and landscaping area after construction. FIRE DISTRICT REQUIREMENTS 26. Fire protection improvements, including installation of any required hydrants, shall be constructed as requested by Santa Clara County Fire Department. Improvements shall be constructed and ready for use prior to the recordation of the Final Map, or shall be bonded for. Driveway access to each parcel shall be installed prior to commencement of any construction on that lot. 27. Plans for new residences shall be reviewed and approved by the Santa Clara County Fire Department at the time of site development permit application. Conditions that may be applied at that time include, but are not limited to, providing an acceptable water supply based on the size of the new residences, providing an emergency vehicle turnaround, placement of property address signs that are clearly visible from Altamont Road, and providing an approved access system if the lots are fenced and gated. 9-1.1105 Underground utility improvements. July 3, 1976) littp://gcode.us/codes/losaltoshills/view.php?topic=9-1-11-9_1_1105 &frames=off 5/21/2009 Attachment 3 Date: March 8, 2009 To: Town of Los Altos Hills From: Neighborhood at Page Mill Road, Central Drive, and Red Rock Road in Los Altos Hills Reference: Utility Undergrounding requirements for 11990 Page Mill Road subdivision The developer of the 11990 subdivision sent email to our neighborhood that detailed three options for under grounding electrical utilities as part of the conditions of approval: (1) as approved but with a PG&E access road above the under grounded electrical line, and with the house driveways moved to this location (this driveway location was previously denied by the Planning Commission and Town Council both); (2) being granted an exemption from the under grounding requirement; or (3) receiving service from Page Mill Rd (this option was not properly explored in the email). We discussed these options at a neighborhood meeting and would like to propose that a fourth and, we believe better, option be explored based upon option 3. Because the distribution line in question already has caused two fires, we believe that undergrounding of the electrical lines is a safety issue and strongly request that Option 2 not be considered. In addition, the tree cutting on the subdivision has already -negatively impacted the neighborhood. Because Option 1 requires cutting even more trees with further negative impact, we find it less desirable than alternatives. We also note that the Los Altos Hills General Plan and Municipal Code are both clear on the subject of underground utilities (see notes 1 and 2). We would like to propose a fourth alternative which is to route the PG&E distribution line underground, beneath the subdivision driveways from pole F to pole E (illustrated in annotated photo 1 below with the approximate run being shown in red). We favor this option because it replaces 4 sections of overhanging wires and 3 poles (poles B,C,D). The developer indicated she did not explore this option because she believed it would require removal of trees surrounding pole F. Upon inspection of the area (pole F), we found that this is incorrect. There are no trees that would require removal. In addition, there is an existing underground box marked '12 kV high voltage' next to pole F, and this underground box is also clearly shown on the PG&E map of the area. (See photos 2-4 below). This box currently serves the homes on Altamont Circle. It appears to us that the best solution is to connect these underground high voltage 12 kV wires to the pole (pole E), with an underground box location on the subdivision. This would allow the poles on Waidy Lee's property (pole B), Ms. Brockway's property (pole C), as well as the pole on Central (pole D) to be removed. In our proposal, Waidy Lee's transformer (currently on pole C) would be moved to pole G and be pad mounted on Waidy Lee's property along Page Mill Road (indicated by the white dot below pole G photo below). Waidy Lee's electrical connection is shown in blue. We ask that the Town and developer consider our new option 4, since the developer has requested that the issue of undergrounding be reopened. Additionally, we would need a road installed to service the new UG wires down this route. 3. Approximately how long will it take to have PG&E come up with a design for this proposal? Since the proposal would require new right of way easements, we would need to start with the easement rights first, then only design when we know we can successfully obtain these easements. We would also need to find a suitable trench route for the 12kv lines, which may be difficult to agree upon. This will likely delay a design from being completed for at least a few months. 4. Approximately how much will it cost to have PG&E do the design? We will only be able to provide costs if the applicant is willing to pay for this estimate. I believe that the plans should be sent back to the planning commission for the following reasons: 1. Initially, three options were discussed by the developer, Ms. Brockway, and the neighborhood on Central Drive. One of those options was to underground the power from a pre-existing transformer box on Page Mill. That would eliminate four power poles on Page MIll Road and would dramatically increase neighborhood safety by reducing the fire danger. Not enough consideration of this option was given by Town Staff. 2. There was not enough energy nor emphasis placed on exploring these options -the planning staff essentially allowed Ms Brockway to go with the option that worked the best for her - this is in direct contradiction to the wishes of the Planning Commission who clearly stated that the developer should take into account the wishes of the neighborhood. The neighborhood showed its concern over this proposed development many times over the last two years -through meetings with Town staff and Town manager as well as neighborhood meetings and a letter signed by 23 residents of Central Drive. 3. There are -still property boundary disputes/issues between Lee & Killiian and Bahlman & Cunningham and other neighbors at the Page MIll end of Central with the developer Ms Brockway. The plan map should not be approved until these issues are completely resolved. 4. The current plan for an underground transformer box along the fence line of the Lee/Killian property with a service road built along that edge of the property is flawed for several reasons: a. The slope for the road coming off Central is too great and requires substantial grading -previously the idea of a driveway there was rejected for this reason. b. The proposed PGE vault and road lie directly in the drainage swale for the seasonal spring that exists on the property. As of today, May 19, 2009 there is still water flowing from the spring down the proposed road way and pooling where the vault would be placed. c. The removal of one power pole and its replacement with another on the Lee/Killian property puts a power pole in the view shed of both proposed new homes -their patios literally look out on a service road and a power pole that blocks their view down canyon. 5. Allowing Ms Brockway to not underground 5 poles on her proposed two home subdivision of the Moeller property is an unfair application of the undergrounding ordinance in Los Altos HIlls. In order to build our home at 27690 Central we were required to underground power to the property -1,000 feet plus from the nearest pole -this in order to remove only one pole. The intent of the ordinance is to increase public safety by removing power poles - particularly those near trees and along roadways. The four poles on Page Mill meet both these criteria -there have already been two fires sparked by two of these poles igniting nearby tree limbs. We believe this item should have been returned to the Planning Commission for consideration in light of the neighborhood petition, signed by 23 residents and submitted to the Town in March 2009, supporting a plan that would be safer for the neighborhood and more in keeping with Town policy regarding utility undergrounding. The developer, Ms. Brockway, is apparently not willing to consider the neighborhood proposal because it would delay approval of the Final map. However, a look at the timeline shows that this situation was created by Ms. Brockway's own actions. The Planning Commission requested at the time of Tentative Map approval two years ago that she work with the neighbors on the undergrounding plan. However, she applied for release from the undergrounding requirement in October of 2008. When Ms. Brockway was told the request would have to go before the Council she dropped it. Finally, in January of 2009, Ms. Brockway met with neighbor Waidy Lee and presented 3 options, and in February of 2009 she forwarded details of the options to Ms. Lee for neighborhood consideration. Shortly thereafter, several of the neighbors met. The result was a petition to the Town signed by 23 residents along Central Drive expressing our strong preference for the option that would remove 3 poles and provide significant safety and aesthetic advantages. Ms. Lee also notified Ms. Brockway of our meeting and the outcome. However, Ms. Brockway instead submitted the PG&E study of her preferred plan (with no pole removal and the addition of an access road) to the Town. We acted as expeditiously as possible. We had no control over the timing and any delay incurred is not due to any lack of action on our part. We request that the plan for undergrounding the utilities at 11990 be referred back to the Planning Commission. We also request that the fees for this appeal be waived. The only action being requested is that the administrative action approving the developer's plan be changed to a referral to the Planning Commission. This does not seem to us to justify the large fee charged. You really made our town a safer place for the residents of Los Altos Hills. Here I want to set out the reasons for my appeal on the sub -division of 11990 Page Mill Rd. The purpose of my appeal is to request Council to either approve the underground plan suggested by the neighbors to preserve the original intent of the Planning Commission decision approving the subdivision more than two years ago, or refer this matter to go back to the Planning Commission if further investigation is needed. 1. The tentative map on which the subdivision is based has not been seen by either the Planning Commission or the Town Council. The revision date of the map is dated April 3, 2007 and stamped as received April 5, 2007, when the last Council meeting on this subdivision was March 8, 2007. There have been substantive changes to the subdivision plan since the Council meeting. As a result, the "Approved Tentative Plan" that is being referenced by the Town and the developer is not the same as what was approved by the Planning Commission and the Council. 2. At their meeting on January 4, 2007, the Planning Commission directed the developer _of 11990 Page Mill Road to work with us to underground the utility overhead lines from Page Mill Road to Central Drive. The developer refused to do so and has refused to explore under -grounding options that would improve neighborhood safety. This is important because the overhead wires on my property at 27961 Central Drive have caused two fires in the past (see attached fire reports from the Santa Clara Fire Department and from Palo Alto Fire Department). Our property is situated downward from Page Mill Road and from Central Drive. The power lines follow the contours of the steep landscape from Page Mill Road down to our property, cross the property line to 11990 and up to Central Drive. The fires were caused by high wind (50-70 miles per hour), breaking tree branches that then touched the power lines. The tree branches sparked and then dropped on the ground and caused the fires. 3. A petition with 23 signatures from the neighbors was submitted to the Town concerning the safety of the neighborhood. The developer has refused for many months to do the investigation with PG&E that only she is able to do. I am also requesting the appeal fee to be waived because the map on which the sub -division is proceeding has never been seen by either the Planning Commission or Town Council, and because the undergrounding issue noted in the Planning Commission minutes has not been resolved. Regards, Waidy Lee May 18, 2009 Page 1 of 4 Waidy Lee 27961 Central Drive, LAH Elucidation 1. 11990 Page Mill Road Tentative map Some brief background is appropriate so that you can understand what has taken place. When the Tentative Map was submitted, the Planning Commission approved the plan with certain changes requested by neighbors (myself included). The minutes of the PC meeting states that the developer was to work with me to underground the lines all the way to Page Mill Road with me sharing in the expense. The developer went to the Town Council in March 2007 to overrule the Planning Commission's changes, but was rebuffed. The developer's civil engineer then submitted a revised plan on April 5, 2007 that was stamped as approved at the March 8, 2007 Council meeting. However, this plan included changes beyond what the Planning Commission and Town Council had approved; no neighbors were notified about these changes, which included placing a sewer line 25 feet from my well (the distance required by Santa Clara County is 50 feet); I only learned of this when the sewer line was installed. Had I not been home at the time, I would have never found out about the illegal sewer line. The County has since signed off on the sewer line as long as it is double sleeved within 50 feet of the well. I relate this background because: (1) it illustrates the contempt with which the developer regards our neighborhood; and (2) because it illustrates a failure of the town process (we should have been notified about the sewer line change, for example). As further illustration of the first point, the developer cut almost all of the trees on the heavily wooded property, creating noise, headlight, and visual disruption to our neighborhood, although only a few trees were approved to be cut in the sub -division proposal. In the under -grounding utility plan approved by the Town Engineer, a service road is added where a driveway was rejected at the Planning Commission meeting on January 4, 2007. The Planning Commission acted in support of an Environmental Impact Report which specifically called out the driveway as a negative impact to my property, which was mitigated by moving the driveways to the other side of the development. This "access road" is similar enough to the road that was rejected by the Planning Commission two years earlier that it should be reviewed again by Planning Commission, since it will appear to be a pathway to walkers along Central Drive. 2. At the Planning Commission Meeting on January 4, 2007, it was recommended that the developer work with us to do the under -grounding of PG&E overhead lines. For several years after the fires on our property, we have been trying to underground these utility lines. Several PG&E estimators came out (in different years) and gave us quotes. The last PG&E estimator came out and suggested that I ask Joan Moeller (the previous owner of 11990 Page Mill Road) for an easement to underground the power lines straight from Page Mill Road to Central Drive (the most cost effective). Ms. Moeller was quite sick at that time and never recovered to the point that we felt we could talk to her. Please note that the several PG&E estimators never had told us that it was not feasible to underground the distribution lines. In the summer of 2007, we spoke to the PG&E Rep for Ms. Beverly Brockway (new owner and the developer at 11990 Page Mill Road). He described the project is do -able. Later, Ms. Brockway had her PG&E rep send out an email in June to the Town that said it was'not possible'. We were puzzled but did not follow up; we still expected a town process to occur where we would be able to provide input. May 1.8, 2009 Page 2 of 4 Waidy Lee 27961 Central Drive, LAH In Feb, 2008 we received an email from the developer at 11990 Page Mill Road, informing us her plan and requesting us to change our electrical panel to cope with a pad mounted transformer. We wanted to discuss further with her about under -grounding our section of the overhead. We did not hear from the developer. Around late Oct to early Nov of 2008 we found out that Richard Chiu, the Town Engineer, granted permission to the developer to not underground overhead wires. We wrote to the town quoting from the Town's municipal code, reminding that the code does require Ms. Brockway to underground the utility. Therefore, the re -visit of the underground utility got started again early 2009. Ms. Brockway came to our house on January 24, 2009 and presented 3 options. She strongly suggested not to under -ground the existing overhead wires because: (1) PG&E asked for a 25 foot wide road and the town want this road to be combined as the two parcel's driveway; and (2) the route from the Page Mill Pole next to Foothill Park requires the cutting of trees and she did not want to cut more trees. Ms. Brockway told us: "Therefore, the only option is for the two lots to get electricity from the pole on Central Drive." We asked Ms. Brockway to email us the 3 plans so we could talk to the neighbors about them. We got the email with drawings from Ms. Brockway on February 18, 2009. After meeting with the neighbors and with further investigation, we saw that the route from Page Mill Pole next to Foothill Park does not require the cutting of any tree. As a matter of fact, there already exists a high voltage underground vault, which could be the starting point for the undergrounding. The neighbors and we were very pleased with this option. On March 8, a petition asking for further investigation of this option and signed by 23 neighbors was sent to the town. - We heard back from the Town Engineer that the developer is anxious to meet the March 8, 2010 sub -division deadline and had made up her mind to under -ground the utility the way she wanted. This deadline is still far in the future, and also it seems that developer has been responsible for most of the delays in this matter; the neighborhood has acted quickly when given a chance. 3. Neighbors' concerns ignored After submitting our petition with 23 signatures, several of Central Dr and Red Rock Rd neighbors had a meeting with the Town staff to further look into the matter. After the meeting, Mr. Chiu sent us an email informing us he is going to approve the Beverly's plan because it complies with "the approved tentative map" and no appeal is allowed. Later the Town reversed itself, and has allowed an appeal. I reiterate that the notion that the map being used has never been seen by the Planning Commission or the Town Council, and it is inappropriate to consider this map "approved." Page 3 of 4 May 18; 2009: Waidy Lee 27961 Central Drive, LAH There are several reasons why the alternate under -grounding route is preferable to the new plan that is approved by Mr. Chiu: Pros: Cons: It provides fire safety as there are less overhead High Voltage (12,000 Volt) wires. It provides a more attractive neighborhood (less poles and less overhead wires). • No new service road is needed as it will be under the proposed driveway. • The developer's proposed service road would be flooded in the spring (see attached photos taken May. 13, 2009), whereas the new route would not. • It may reduce cost because only one vault box is added, no additional service road is required, no additional pole is needed. • It may take more time. The PG&E study will take time. Debbie and Richard said the under -ground utility is the last item on the developer's list before submitting for recording. (This assumes that the boundary line dispute among the adjoining neighbors along Central Drive has been resolved.) © It may add cost because the trench is longer. I sincerely ask Council to approve the underground plan suggested by the neighbors; or to refer this matter to go back to the Planning Commission, in view of the neighborhood concerns and the fact that there was no detail given in the original tentative map. E-8 was on scene of a 10'X 20' wood coral that was 50% loaded with cut firewood and was fully involved with fire. E-8 crew stretched an 1 1/2" preconnected hose line down to the fire. R-14 parked behind E-8 and used 100' of 2 1/2" to supply E-8 with water. B-6 arrived on scene and parked in front of R-14 as did B-7. B-7 assumed command after a face to face with R-14 captain. E-2 arrived on scene and parked in front of E-8 as a water source also. E-15 arrived and replaced R-14 when they had emptied their tank and went to refill from a nearby hydrant. The fire was knocked down and E-15 & E-2 were released. B-7 passed command back to R-14 captain. After interviewing the homeowner it was determined that the most likely cause of the fire was tree limbs from a nearby tree had come into contact with 12KV high voltage lines and burned off and fell into a woodpile providing heat to the fuel load and the strong winds created the fire. 2,211 gallons of water and foam were used to extinguish and over haul the fire. A sprinkler that the home owner had was put in place to keep the fuel wet and to prevent a rekindle with the high winds. 3). R-14 & P-14 cleared the scene. FF P-14 Number of responders this Incident: 9 Date: March 8, 2009 To: Town of Los Altos Hills From: Neighborhood at Page Mill Road, Central Drive, and Red Rock Road in Los Altos Hills Reference: Utility Undergrounding requirements for 11990 Page Mill Road subdivision The developer of the 11990 subdivision sent email to our neighborhood that detailed three options for under grounding electrical utilities as part of the conditions of approval: (1) as approved but With a PG&E access road above the under grounded electrical line, and with the house driveways moved to this location (this driveway location was previously denied by the Planning Commissionand Town Council both); (2) being granted an exemption from the under grounding requirement; or (3) receiving service from Page Mill Rd (this option was not properly explored in the email). We discussed these options at a neighborhood meeting and would like to propose that a fourth and, we believe better, option be explored based upon option 3. Because the distribution line in question already has caused two fires, we believe. that uodergrounding of the electrical lines is a safety issue and strongly request that Option 2 not be considered. In addition, the tree cutting on the subdivision has already negatively impacted the neighborhood. Because Option 1 requires cutting even more trees with further negative impact; we find it less desirable than alternatives. We also note that the Los Altos Hills General Plan and Municipal Code are both clear on the subject of underground utilities (see notes 1 and 2). We would like to propose a fourth alternative which is to route the PG&E distribution line underground, beneath the subdivision driveways from pole F to pole E (illustrated in annotated photo 1 below with the approximate run being shown 'in red). We favor this option because it replaces 4 sections of overhanging wires and 3 poles (poles B,C,D). The developer indicated she did not explore this option because she believed it would require removal of trees surrounding pole F. Upon inspection of the area (pole F), we found that this is incorrect. There are no trees that would require removal. In addition, there is an existing underground box marked 12 kV high voltage' next to pole F, and this underground box is also clearly shown on the PG&E map of the area. (See photos 2-4 below). This box currently serves the homes on Altamont Circle. It appears to us that the best solution is to connect these underground high voltage 12 kV wires to the pole (pole E), with an underground box location on the subdivision. This would allow the poles on Waidy Lee's property (pole B), Ms. Brock -way's property (pole C), as well as the pole on Central (pole D) to be removed. In our proposal, Waidy Lee's transformer (currently on pole C) would be moved to pole G and be pad mounted on Waidy Lee's property along Page Mill Road (indicated by the white dot below pole G photo below). Wkidy Lee's electrical connection is shown in blue. We ask that the Town and developer consider our new option 4, since the developer has requested that the issue of undergrounding be reopened. The line would be underground from the Central pole to the current pole. Then the line would be underground from the pole to your current panel.Your current electrical panel is for over head and it would need to be modified or changed for underground. According to PG&E, Eric Blanchard, all this would need to be done whether or not you underground your lines. You would need to explore the possibility of undergrounding the lines that currently exist across your property as a separate matter. The work of undergrounding your portion could entail your being without electricity for a day as once the trench is dug and the lines laid, the Town still needs to do an inspection. I am no expert, but after looking at the map you gave me, I would think you still have the problem of how to cross the swale and get up the hillside. Feb 19 GS 09o25a Rev 9rockwau 950-941-3371 pat February 18,2008 pG&E proposals for Brockway 3ubdivislon The subdivision was approved with the condition "all existing or proposed utilities located in the subdivision that serve the subdivision shall be.unde.rgrounded." The approved plans shoved undergrounding approximately 220 feet along the Lee property line (Exhibit 2). It would not eliminate the existing pole on the subdivision nor would there any way to do this unless the Lee's underground their portion. Some PG&E requirements are as follows for Exhibit 2: 1. PG&E would require a 12-14 foot paved road with a turnaround for a big boom truck. This would necessitate a hammer head turn around area. It could have a gate and be locked. 2. Lee would have to change their panel to underground. 3. Several oak trees would need to be removed, the newly installed sWale reconfigured, and a large,filled approach -built for the driveway off Central for the PG&E truck to negotiate. 4. A large 50" x 52" pad would be required with a 17" x 30"x 26" box on top. 5. The current pole would not be removed and possibly a larger one installed as the lines crossing the Lee property are overhead. The subdivision does not need the overhead pole so technically it could be moved to the Lee property. PG&E finds it inconvenient to service a 220 foot section of underground when for miles on either side the lines are overhead and there are no plans to underground the other lines. We looked.at extending the PG&E line up to the Page Mill poles but the slope is too steep unless a significant portion of the property is made into a road and a major bridge built over the swale. Upon reviewing the conditions set by PG&E, Mark Holderman of PG&E came up with the idea of serving the property from the pole near the corner of Central and Page Mill Road (Exhibit 1.) The primary reason was because they do not like very small sections of undergrounding to maintain and service but also because this would have an easy access to service. The main house on the property had been served by an overhead line from Page Mill and the old home overhead from Central Drive pole. Both the new homes on the subdivision will have underground electrical regardless of their point of access to PG&E. Benefits of this plan from the Central pole include: Feb 10 09 09o25a Bev Drockwau 650-941-9371 p.3 1. The driveway could be used for one of the homes. 2. It would be easy for the PG&E truck to back out and service the line. 3. The direction of the flow of electricity makes no difference to PG&E's ability to service the property. 4. At least 3800 square feet of roadway would be eliminated making it a much more friendly ecological and esthetic development. Only after the plans were redrawn did anyone realize the direction the electrical flows makes a difference --not to service the subdivision but rather to meet the Town's conditions that "the lines are not connected to any distribution line situated within the subdivision." The electric line on Central comes from the line along the Lee property line thence up along Central toward Page Mill. The Town's Conditions of Approval would need to be changed for Exhibit 1. If this plan is not utilized and we are burdened with a road for PG&E along the Waidy Lee property line as well as the driveway up by the corner of Central and Page Mill Road, we would propose that this become the driveway for one of the homes and the home's drive be the turnaround. This would eliminate almost 4,000 square feet of impervious surface for the property and keep the property from looking like a freeway interchange with the five foot wide horse path taking up 8/10t` of an acre, 3 driveways plus Central and Page Mill Roads circling three sides of the property. Exhibit 3 shows this version. Although this version was denied at the previous approval of the subdivision, no input had been received by PG&E nor were we aware of the impact of the horse path, the water collection systems, and the 2 swales required in the final subdivision improvement plans. The three Exhibits show three different plans and different coverages and exclude the driveway for the home next to Central. Exhibit 1 shows 7500 square feet of driveway that serves both the house and PG&E. Exhibit 2 shows what has been approved --a driveway for the house and a separate road for PG&E requiring approximately 11,300 square feet of driveways .26 of an acre or almost a quarter of an acre. This is excessive. Hopefully in the final house plans an even smaller drive and turnaround area could be built. The possibility of coming in from Page Mill Road by the culvert and existing pole was also explored but ruled out. This would be too close to the existing heritage oaks, and necessitate negotiating with neighbors, the County of Santa Clara and the City of Palo Alto. The culvert, the creek, Page Mill Road, the trees and the lack of easements make it a very complicated proposal. Attached are the maps showing the three different proposals. Since the proposal is in substantial conformance with the approved tentative map, staff is obligated to approve the improvement plans for construction. At out last meeting, you all had a question about appeals and per section 1-4.01, there is no right to appeal since this does not involve .administrative discretion. The proposed plans are in conformance with the approved tentative map. The plan that was discussed with you all at the last meeting will be modified to relocate one power pole a few feet onto Waidy's property per approved tentative map. I have attached some pertinent emails reflecting efforts to work with the neighbors, staff and PG&E to solve the issues. It should be noted that I did not purchase the property until August of 2007 when the Tentative Map was already approved and was not the "developer" until that time. I was the listing agent on the property for the owner. We purchased the property with the idea of living on it, but the cost overrides of the improvements and the time it has taken to do them have precluded that opportunity for us. I had been involved in one other subdivision in Los Altos Hills almost 16 years ago so I would hardly call myself a developer. I have sold many lots and homes in Los Altos Hills. lived in the county area of Los Altos for 38 years and my children attended Los Altos schools. Even though we sold our Los Altos home to complete the subdivision, I still consider myself a member of the Los Alto/Los Altos Hills community. Needless to say, there is a huge difference between completing a subdivision and selling a piece of property as this project has shown. An application to PG&E was made in August of 2007 for the plans based on the Tentative Map. PG&E does not do the detailed plans until the Tentative Map is approved and they know the location for the utilities. It took until June 4 of 2008 (9 months) to receive the plans and be able to turn them into the Town. (Exhibit 1) I naively had expected the plans to be reviewed and approved without much delay as PG&E said they design the plans and the governmental agencies make sure they meet their codes. That sounded simple enough. Richard Chiu began emails to PG&E as early as 6/24/08 and these continued for 6 months Eric Blanchard and Derrick Victa had worked on the plans for PG&E. Numerous emails went back and forth between PG&E, my engineers Lea & Braze and the Town staff. Emails will show that staff worked diligently to look at the impacts on the Waidv Lee/Killian property and possible solutions to her concerns. (Exhibit 2) Efforts were made as early as February 28, 2008 to work with Lee/Killian and we met at their home and went over the proposed plans. (Exhibit 3 & 4). The problem was the same as the one she had encountered years ago with PG&E ... the bank is steep and would take up a large portion of any property that tried to. build a road up the steep bank to Page Mill Road. Calls were made to me by Town Staff and even a Town council member on Waidy's behalf. In the email (Exhibit 3) she asks to "know when the down time is for the connection between your power pole to our well house (relocating the transformer on the power pad." This indicated to me that she had accepted the design and especially since I had not heard from her regarding this issue though we communicated on many other In an effort to solve the issues on January 21, 2009, I again called and asked to meet with Waidy in an effort to resolve the issues and presented 3 solutions. These was not done on a Town staff level or as a formal application to change the conditions of approval but simply to try to find solutions and meet with the interested parties. Having no list of the neighbors, Waidy agreed to send out my proposal. I heard nothing for 6 weeks (Exhibit 5). Finally the Staff called me in for a meeting with an entirely new proposal. No effort was made by the neighbors or Lee/Killian to involve me in the discussions. Meanwhile I had decided to go forward with the original plans as designed by PG&E. Staff approved the plans proposed by PG&E with 3 changes that benefited the neighbors. Pressure was brought on PG&E and they agreed that the road could curve to save the oak trees. We agreed to have the new PG&E pole on my property instead of Waidy's. The size of the road has not changed but PG&E did agree that it doesn't have to be paved as they first requested. I have no record of the size of the road requested by PG&E changing. The Lee/Killian plan would entail months of obtaining easements before PG&E would even see if the plan would work. The horse path would be torn up, more road would be required on a property that is already burden with extensive driveways due to the request of the neighbors as to the location of the driveways. Bonds. encroachment permits. PG&E fees, engineering, and carrying costs on the property are only some of the additional expenses that would be required. This is simply too late in the development process to start over again. Over 90% of the improvements are completed already. I can't afford the delay financially. emotionally or physically for a plan that may not work and is considerably more complicated than the small PG&E project we have attempted to complete. The people desiring the new plan certainly can purchase the property and do their own improvements on their own time and money. For over a year I have been trying to have the PG&E plans approved by the Town. it has taken 22 months of significant time and effort by Town staff- my engineers and PG&E to get this far. The improvements are staked and ready to go, the contractor started already and the fees were paid to PG&E last year. The neighbors have also spent a great deal of time and effort on this issue and it is time to help everyone get on with their lives. The issue is degenerating and becoming personal with interpretations of motives and behavior, remarks and insinuations which are not constructive toward solving the issue. The Conditions of Approval require us to underground the utilities. We have never had a problem with that but only with how it is to be accomplished and at what cost and to whom. The Conditions of Approval do not say we are to solve all the neighbor's problems. We have tried and are trying to comply with the Conditions of Approval. The little old pole would be removed as it belongs to the phone company. The line would be underground from the Central pole to the current pole. According to PG&E, Eric Blanchard, all this would need to be done whether or not you underground your lines. I did understand the neighbors' proposed alternative and perhaps I should have used the term "remove" instead of "underground". In regards to the neighbors' request to "investigate" compare to "perform", I believe that the term "implement the steps necessary to perform" is appropriate. The rough estimate I provided does adequately represent my estimate of the additional cost for the neighbors' proposal. The estimate does not include the cost to physically install underground lines from A -B -C. With your presentation and the lengthy discussions that occurred during the Council meeting, I am confident that the City Council fully understood the various alternatives including the neighbors' proposal. Below is the motion that was passed by the Council: " The City Council directed that the matter be returned to the Planning Commission with a request that the Planning Commission consider whether findings in support of a conditional exception pursuant to 9-1.1501 could be made that would allow the segment of the utility line that is proposed to be undergrounded (Section between points C and D on the map) could remain as above ground utility lines. Assuming the Planning Commission does make such a finding, the City Council requested that the matter be scheduled for final City Council action as a consent calendar item on the July 9, 2009 City Council meeting. If the Commission is unable to make such a finding, then the matter will be returned to Council for final action on the appeal. The City Council also directed staff to work with the Fire District, property owners and PG&E to look into reducing the fire danger. In your report you have stated incorrect information. Although I corrected you at a Central Drive gathering June 10 and at the City Council Meeting June 11, Planning Commission will not have this information until the June 11 minutes and report come out. I understand that meeting minutes and report may take a while before it 6/26/2009 Page 2 of 2 becomse available. Here are the items that require correction: The neighbors object to the developers proposed plan because they would like the developer to underground overhead lines and poles on Waidy Lee's property and on Page Mill Road to reduce the risk of fire. You have incorrectly stated the neighbors' proposal. We never asked that the developer underground lines on my property. The neighbors' proposal is to take out the section of wires of Poles A to B, B to C, C to D, and D to E and the Poles, B, C, D (please reference http ://waidy. comfUtilityUG/PGE4thOption.pdf). They also contend that the "Approved Tentative Map" stamped as received April 5, 2007 is not what was approved by City Council and that a petition has been signed by 23 neighbors requesting that Brockway implement the steps necessary to perform the undergrounding as proposed by the neighbors.. The neighbors also object to the maintenance/emergency access required by PG&E. This is not factual. The neighbors did not ask that the developer perform their proposal; we requested that our proposal be investigated. That investigation has never occurred. We still think it is appropriate that it be investigated. Please refer to the neighbors' proposal (original copy is filed at the Town and an online version is available at http://waidy.com/TJtilityUG/A`ttachment3.pdf) that the neighbors requested that it needs further investigation. Based on information provide by the neighbors, their proposed alternative would underground the same 210 feet section of overhead wires on Brockway's property and an additional 310 feet of overhead wires on Lee's property. The neighbor's proposal would require approximately 700 feet of trenching and installation of a new transformer and primary box, utilizing the new driveway on the subdivision for maintenance/emergency access. The neighbor's alternative has not bee not been designed by PG&E thus it cannot be confirmed that it is reasonably feasible. Additional cost will need to be submitted to PG&E for research, design, and cost estimate preparation. This will result in delays to the completion of the subdivision improvements and will likely increase the cost by $70,000 to $150,000. This repeats the incorrect assertion that we are asking for the power line on my property to be undergrounded by the developer. The trenching numbers and cost are therefore clearly incorrect. They should be removed from your presentation to the Planning Commission. Earl and I are in Scandinavia now.
