Hidden Villa Overlay District (HV) is established to provide for the continued use of the lands of Hidden Villa, a nonprofit educational organization that uses its- organic farm, wilderness, and community to teach and provide. opportunities to learn about the environment and social justice. The intent of this chapter is to recognize and support the existing uses on these lands and to establish a range of permitted and conditional uses and standards governing those uses that might otherwise not be permitted within the underlying R -A Zone District and to generally preserve as open space, areas of land exceeding 20% slope. New development within the Hidden Villa Overlay District shall be subject to both this Article and Article- 7, Residential -Agricultural District (R -A). Where there may be conflicting provisions between the R -A Zoning District and the Hidden Villa Overlay District, the provisions of this Hidden Villa Overlay District shall apply. 10-1.902. Applicability. The provision of this chapter shall apply solely to the area identified on the Official Zoning Map, constituting that area owned by Hidden Villa, upon annexation of this area to the Town. 10-1.903., Maximum Number of Parcels. Subject to subsections 1-2 below, lands within the HV Overlay District may not be subdivided into more than five (5) lots. .1. California Non-profit Benefit Corporations. The uses and structures set forth in Sections 10-1.903(a) and 10-1.904(a) shall occur on no more than two (2) separate lots within the HV Overlav District. 2. Residential -Agriculture. The uses and structures set forth in Sections 10-1.903(b) and 10-1.904(b) shall occur on no more than four (4) separate lots within the HV Overlay District. 10-1.904: Primary and Accessory Uses and Structures Permitted. The following uses are permitted as primary uses within the Hidden Villa Overlay Zone District-. The following uses are permitted as primary uses within the Hidden Villa Overlay Zone District-. Any change to the DRAFT Page 2 of 4 permitted uses listed in (a) below require Planning Commission and City Council review and approval prior to commencing such uses. (a) California Nonprofit Public Benefit Corporations. If the lands of Hidden Villa, or any portion, have been or are annexed to the Town of Los Altos Hills, the maximum number of parcels used by California nonprofit public benefit corporations shall not exceed one (-)two 2 . The following uses and structures to carry out the purposes of nonprofit public benefit corporations qualified for exemption from federal income tax under Section 501(C)(3) of the Internal Revenue Code: 1. All agricultural uses including the keeping, raising, and feeding of poultry and livestock, grazing, indoor or outdoor growing and harvesting of shrubs, plants, flowers, trees, vines, fruits, vegetables, hay grain, and similar food and fiber crops, composting, and beekeeping. 2. On-site processing, preparation, and sale of agricultural products grown and raised at Hidden Villa. 3. Year-round environmental and multicultural education and related facilities including summer camp, classrooms, dining facilities, administrative offices, and overnight accommodations for participants and staff. 4. Educational programs including tours of farm and buildings on site, guided.hikes, demonstrations and activities. 5. Interpretive centers and visitor information centers. 6. Summer camps and related facilities including overnight- accommodations for campers and staff. 7. Hostel and ancillary facilities and other overnight guest house accommodations. 8. Pools and accessory structures. 9. Housing for interns and staff (caretaker housing). 10. Ecological and agricultural related research. 11. Trails and recreation. 12. Assemblies and events including fundraisers, classes, programs and workshops. 13. Facility rentals for groups and assemblies including weddings. 14. Periodic sale of crafts, food, books, t -shirts, -gifts and other items related to agricultural, environmental and multi -cultural programs and events on-site that does DRAFT Page 3 of 4 not include more than five (5) outside vendors on-site for more than one consecutive day. 15. Blacksmith shop. 16. Timber management including planting, raising, harvesting, and incidental milling for noncommercial purposes of trees and logs for lumber or fuel woods, subject to requirements of California Department of Forestry and Fire Protection. 17. Wind, solar, and hydroelectric energy systems .to serve the energy needs of the uses, buildings and structures within the Hidden Villa Overlay District. 18. Accessory structures, buildings and uses appurtenant to the operation of the permitted uses set forth in this section. 4-8-.19. Other compatible uses. Additional land uses maybe permitted if the Planning Director determines that the proposed use is consistent with the purpose of the district and sufficiently similar with other permitted land uses in the district. (b) Primary Dwellings. 1. A maximum of four (4) primary dwellings (excluding those dwellings covered under .Section. 10-1.903 (a)(9)) shall be allowed within the Hidden Villa Overlay District on lands with average slopes up to 20% and with a. minimum lot size of one (1) dwelling unit per five (5) acres . 2. Development of primary dwellings on lands with slopes over 20% is generally prohibited. As a condition of approval of any subdivision of lands within the Hidden Villa Overlay District for the purpose of constructing single family dwellings, lands generally in excess of 20% slope within the residential parcels created- by the subdivision shall be placed in an open space easement held by the Town. 3. Dwellings or other structures may not be sited on ridgelines or hilltops. 4. The maximum development area and maximum floor area for lots on the Lands may not exceed the maximum development area and maximum floor area, respectively, allowed by the Los Altos Hills Zoning Ordinance on a one acre flat lot in the Town's Residential Agricultural zone. 5. Accessory structures, buildings and uses as permitted in the R -A District pursuant to Section 10-1.702. (c) Open space. 1. Agricultural uses, including horticultural and grazing; 2. Forest preserves; DRAFT Page 4 of 4 3. Fences, trees, and shrubs subject to the height limitations set forth in Section 10- 1.504. 10-1.9054. Conditional Uses and Structures (a) California Nonprofit Public Benefit Corporations. The following conditional uses and structures shall be .allowed with a conditional use permit subject to the approval of the Planning Commission, and the issuance of a permit thereof pursuant to the provisions of this chapter: 1. Seasonal concerts. 2. Commercial Stable, Boarding of horses and riding lessons as defined in Section 6-1- 902 of the Town of Los Altos Hills Municipal Code; and consistent with regulations contained in Section 6-1.906 of the Town of Los Altos Hills Municipal Code and when deemed appropriate by the Planning Commission to meet the needs of the residents of the Town for stabling facilities. 3. Periodic sale of crafts, food, books, t -shirts, gifts and other items related to agricultural, environmental and multi -cultural programs and events on-site that extends beyond one (1) day and includes more than five (5) outside vendors. (b) Primary Dwellings. The conditional uses and structures under section 10-1.703 shall be allowed with a conditional use permit subject to the approval of the Planning Commission, and the issuance of a permit thereof pursuant to the provisions of this chapter. 10-1.9065. Area, Coverage, Height and Setback Limitations (H -V). See Article 5 Section 10-. 1.502 through 508 of this chapter for the applicable provisions. 10.1-9076. Amendment of the Hidden Villa Overlay District. Any amendment to this Article shall be subject to Section 10-1.1013 and specifically shall be.subject to Planning Commission and City Council review and approval. Re: Planning Commission Hearing of March 25, 2010 To the Planning Commission Members: I moved to Los Altos Hills in 1971 when I was five years old. I spent the next 20 years "growing up" in the Hills. In 2006, my husband and I moved back to Los Altos Hills with our three children and chose a home on Murietta Lane. We chose our home because we wanted our children to grow up in a rural setting with abundant natural beauty. Our property is adjacent to the Hidden Villa property that is being discussed tonight Adobe Creek and the lush vegetation surrounding the creek provides a natural buffer between the residents of Murietta Lane and the rest of the 30 acres of Hidden Villa under discussion. This strip of land is not large, however, it is a vital thoroughfare for wildlife. For the past four years, our family has witnessed the constant flow of the wildlife that lives in Los Altos Hills and travels through the Hidden Villa property along Adobe Creek. It is truly a corridor of wildlife. Deer, coyote, bobcats, rabbits, quail, and hawks travel along the wooded area in and around Adobe Creek. They travel along this route going up the steep hills that connect further on to the open space land beyond. These animals need this land preserved for them in order to continue to coexist with the many residents of this Town. Tonight we ask the Planning Commission to protect the Town of Los Altos Hills by creating a "designated open space preserve" or "wildlife corridor" in this small but vital area referred to as the Murietta Lane "buffer zone". We are encouraged by the environmentally appropriate use of the Hidden Villa land by Heifer International and by their sensitivity to the existing wildlife and vegetation. Below are the requests we share with our neighbors about the proposed use by Heifer: 1. No outdoor excessive flood lighting. 2. No outdoor amplification of sound. 3. A parking lot that is only used when the compound is open and fully supervised. 4. The Global Village remain non-commercial and rural in nature. 5. No hiking or hiking trail access from parking lot. Thank you very much for your time and consideration of these very important issues. We know you will do what is in the best interest of the Town of Los Altos Hills. Sincerely, Katie & Tom Marron 12345 Murietta Lane (650) 941-8814 March 25, 2010 Dear Planning Commission Committee, Our family has been living on Murietta Lane in Los Altos Hills since April of 2000. This area attracted us with its beautiful nature surrounding along with the wildlife that also reside in this area. We love the serenity and peaceful aspects of this beautiful area. We would have liked to attend the meeting tonight but we can't because Michael is currently travelling on a business trip overseas for his company and Sunny is home with her three young children (two of whom are sick). It is wonderful that Heifer organization will be using the lower fields of Hidden Villa. Although with the building of the amphitheatre and parking just behind Murietta Lane there are some concerns that need to be addressed and would appreciate some consideration upon future planning by the Planning Commission. As this is a very quiet neighborhood in regards to both sound noise & lighting we request the following: 1. The amphitheatre to be built will have NO sound amplification and excessive lighting (flood lighting) which will be very disruptive to the surrounding neighbors (not only to. Murietta Lane residents but also Hidden Villa, Moody Road and Tanglewood Lane residents and possibly down to Chaparral Way, Adobe Creek Lane, Francemont Dr, etc.). 2. The parking lot built will be used for Heifer International ONLY and to be closed to anyone not affiliated with Heifer International. 3. The Hiefer land needs to be supervised any time the gate is unlocked to assure those who have no business on the land not be "hanging around". 4. It is vital that Hiefer International remain non-commercial and rural in design as well as use. 5. The buffer between Murietta and Heifer's project to remain and be called "designated open space preserve" or "wildlife corridor". There is a wonderful wildlife in this area where deer, coyotes, bobcats and quails reside and come up and down the mountain. We observe them very often and it adds to the beauty of Los Altos Hills that is not found anywhere else. They need the abundant vegetation that is present as well as the space to roam. Please allow the forested area around Adobe Creek to remain. 6. There be no residential homes in this annexation area in the future in case Heifer leaves Hidden Villa in the future. I have met with representatives of Heifer International, and think their project is a good match for the land, and for Los Altos Hills. Having lived in Town for 30 years, I know not all projects are permanent. Therefore, I am in favor of annexation, so we have some control over this land for now and in the future. Of course, this is where the Planning Commission comes in, and I certainly acknowledge the time and efforts. Although there is currently an appropriate buffer between Murietta Lane and the Heifer project, I know how vital it is to make these things permanent. I ask that the creek and forested area, of this buffer, be given a permanent designation of "open space preserve" or "wildlife corridor". This area is heavily populated with deer, coyote, bobcat, and all the forest animals we are so lucky to have. Though Heifer has no intention of touching this area, now is the time to place it permanently into protection, as the impact of future projects cannot be foreseen. The Heifer land will be fenced, but we also need to be assured it will be supervised any time that gate is unlocked and their project and parking lot is not left to the whim of the public. Of course, there should be no amplified noise or night lighting except if needed for the purposes of safety. It is vital that Heifer remain non-commercial and rural in design as well as use.
