SUBJECT: CERTIFICATE OF CORRECTION, RECORD OF SURVEY 58 MAP
13; LANDS OF ZHONG; 26131 ALTADENA DRIVE; FILE #6-11-MISC

RECOMMENDATION: That the Planning Commission:
Recommend approval to the City Council of a Certificate of Correction amending a Final
Map.
BACKGROUND:
In March 1955, Record of Survey 58 Map 13 "A portion of Lot 12 of Mesa Tract" was
approved by the Board of Supervisors of Santa Clara County. This Record of Survey
included building setback lines on the subject lot. The intent of the setback was to assure
that adequate space for sanitary sewer leach fields was reserved. It is not the current
practice of the Town to require setback lines for sanitary sewer leach fields.
At the time of this map approval, sanitary sewer service was not available to the residents
in this area. Since that time, sanitary sewer service has been added with a sewer main
located in Altadena Drive. The subject property is connected to the Los Altos Basin
Sewer.
DISCUSSION:
The property owners of 26131 Altadena Drive have requested the removal of the 76'
setback line that was recorded with the Final Map. The attached exhibit shows the
proposed Final Map Amendment.
The Town's Municipal Code Section 9-1.1210 requires that findings be made to support
Final Map Amendments. The Planning Commission must review the findings and make
a recommendation to the City Council.
FINDINGS:
1. The original purpose of the setback is no longer applicable since the property has
been connected to the Los Altos Basin Sewer System. The building setback line
shown on the map is no longer necessary.
2. The .proposed change does not affect the size of the lot or the Maximum Floor
Areas and Maximum Development Areas allowed for the property.
3. The modifications are consistent with the Town's General Plan in that the General
Plan does not require additional building setbacks to allow for septic leach fields.
4. The modification does not alter any right, title, or interest in the real property
reflected on the recorded map. The modification includes the removal of a
setback line which is more restrictive than the Town's current setback
requirements, the setbacks that are required by the Municipal Code for all
properties in the Town will still be required for this property.
5. The proposed modification will not affect any existing easements acquired by the
Town, for access through or use of, the affected property.
