HomeMy WebLinkAbout3.2Item 3.2 TOWN OF LOS ALTOS HILLS May 5, 2011 Staff Report to the Planning Commission SUBJECT: RESOLUTION FINDING THAT THE VACATION OF PUBLIC USE EASEMENT ON CHAPARRAL WAY IS CONSISTENT WITH THE LOS ALTOS HILLS GENERAL PLAN; FILE #: 85-11-MISC FROM: Richard Chiu, City Engineer -AO, _ a� RECOMMENDATION: That the Planning Commission: Approve the attached Resolution finding that the vacation of public use easement on Chaparral Way is consistent with the Circulation and Pathways Elements of the Los Altos Hills General Plan. BACKGROUND On May 28, 2009 the City Council directed staff to proceed with modifying the existing public use easement on Chaparral Way to a 7 to 10 foot wide easement for non -vehicular use. The purpose was to clarify that the Town's maintenance responsibility on Chaparral Way was limited to pathway use and not for roadway purposes. DTSC'T MSTON The existing Public Use Easement to be vacated is approximately 3,000 feet long, 20 and 40 feet wide. The proposed easements to be retained are a Public Utility Easement with the same dimensions as the existing Public Use Easement and a Pathway Easement that is 7 to 10 feet wide for the same length. Town staff worked with the Town's consulting surveyor and the Town attorney's office to prepare the documents necessary to vacate the Public Use Easement and retain easements for public utility purposes and pathway purposes. Section 65402 of the Government Code requires that the Planning Commission report to the City Council as to whether proposed Public Use Easement vacation and reservation conforms with the Los Altos Hills General Plan. RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF LOS ALTOS HILLS FINDING THAT THE VACATION OF PUBLIC USE EASEMENT IS CONSISTENT WITH THE TOWN OF LOS ALTOS HILLS GENERAL PLAN (Chaparral Way) WHEREAS, in 1978 the the Town of Los Altos Hills ("Town") was offered, and the Town accepted dedication for public use across Chaparral Way as offered and accepted on Los Altos Hills Tract Map 6355 ("Public Use Easement"); and WHEREAS, the Public Use Easement accepted by the Town in 1978 meets the definition of a "public service easement" as defined by the Streets and Highways Code Section 8306; and WHEREAS, pursuant to the provisions of Section 8300 et seq., including Section 8340, of the Streets and Highways Code, the Town is considering vacating the Public Use Easement and reserving a public utility easement of equal dimensions, and a seven (7) to ten (10) foot pathway easement within the Public Use Easement; and WHEREAS, upon the proposed vacation and reservation, the Town would retain an easement for public utility purposes along the same dimensions as the vacated Public Use Easement ("Public Utility Easement"), and the Town would also retain an easement for pathway purposes more particularly described in the legal description, attached as Exhibit A and identified in accompanying plat map, attached as Exhibit B as the "Public Service Easement (Pathway)" [hereafter "Pathway Easement"]; and WHEREAS, Section 65402 of the Government Code requires that the Planning Commission report to the City Council as to whether proposed Public Use Easement vacation and reservation conforms with the Town of Los Altos Hills General Plan; and WHEREAS, the Planning Commission did receive information regarding the location, purpose and extent of the proposed vacation and reservation at a public meeting on May 5, 2011 and heard recommendations regarding this proposed action; and WHEREAS, the Planning Commission has considered the relevant portions of the Town of Los Altos Hills General Plan with regards to the proposed vacation and reservation. NOW, THEREFORE, the Planning Commission of the Town of Los Altos Hills does RESOLVE as follows: 1. The foregoing recitals are true, correct, and incorporated herein by reference. 2. The proposed vacation and reservation conforms with the Town of Los Altos Hills General Plan because it will: A. Continue to encourage consistent roadway maintenance and quality throughout the Town (Circulation Element — Goal C-2) B. The roadways will be compatible with the natural terrain, with minimal impact on grades and vegetation, and will maintain safe access to and from the individual parcels (Circulation Element — Goal C-3) C. Continue to develop and maintain a safe and convenient pathway __ _ system (Pathways Element — Goal 1) D. Bakker noted that Council had received correspondence from Akeena Solar related to agenda item #11 subsequent to the agenda being posted. The letter had threatened litigation and it was appropriate for the Council to confer with their legal counsel prior to hearing the agenda item.. Chiu) City Council Regular Meeting Minutes May 28, 2009 Staff had prepared preliminary costs for natural and synthetic turf fields and they were available to Council as an attachment to the staff report. The College had indicated a preference for synthetic turf. Christensen commented that at this time, staff was recommending deferring the project until next year citing the concern that there could potentially be a substantial diversion of Town fiscal and staff resources that could put proper completion of planned improvements to Town owned recreational assets at risk. It was also noted that the college campus was very much adult oriented and the Los Altos School District remained interested in developing a soccer field at Gardner Bullis which was a more appropriate site for children. Council discussion ensued. Concerns sited were the lack of input from soccer organizations and lacrosse groups; absence of true project costs; the potential fiscal impact on the Westwind Community Barn project; and, the terms outlined by the College for the Town's use of the facility. A preference to invest in Town properties was expressed. There was no Council support for the expenditure of funds this year. It was suggested that a more specific proposal (term sheet) from the Town might provide a more optimal discussion platform for the project. Staff suggested a "turn key" proposal for the field improvements with the College as the lead agency. Councilmember Larsen offered that he believed there was an opportunity open to the Town to develop a soccer field and improve relations with the College. He did not propose spending the costs that had been outlined in the staff report but supported further investigation. Larsen volunteered to work with the staff to define the term sheet and project site proposal. There was no consensus to open discussions with the Los Altos School District. MOTION SECONDED AND CARRIED: Moved by Larsen, seconded by Warshawsky to authorize Councilmember Larsen and staff to continue negotiations with Foothill College for the potential use of the Practice Field and to initiate the development of a term sheet proposal/concept plan with the assistance of staff for an amount not to exceed $5,000. • Sewers and Infrastructure Councilmember Larsen reported that the next meeting of the Ad Hoc Sewer (Infrastructure) Committee was scheduled for June 24th at Town Hall. 8. Pathway Improvements for Chaparral Way (Staff: R. Chiu) City Engineer/ Public Works Director Richard Chiu introduced the item to Council. He provided an overview of the project. In October, 2008 during discussions with Council regarding public use easements on Chaparral Way, resident Tom McReynolds expressed his concerns for shared use of the road for pedestrian and vehicular traffic. Council discussed the proposal of a one time financial assistance in an amount not to exceed $20,000 for making safety improvements to accommodate pathway use. Staff was directed to investigate and return to Council with recommendations. Council had before them a technical memoranda that had been prepared by CSG Consultants based on the improvements identified at the previous meeting. Staff recommended the following safety improvements: trim vegetation to correct visibility issues; grade the area to increase usable pathway space; installation of a reflective plastic 7 City Council Regular Meeting Minutes May 28, 2009 post system to delineate the edge of the road; and, the installation of a road gate that would allow unobstructed pathway use by equestrians and pedestrians. Staff had walked the site/road with - resident Thomas McReynolds and the consultant. Chiu proceeded with a PowerPoint presentation that included pictures illustrating the scope of work per the recommendations. Staff was also recommending approval of associated drainage improvements necessary for pathway use. In addition to the safety improvements, Chui advised that staff was recommending that Council consider vacating the public use easement and reserving a separate easement (7 to 10 feet wide) for non -vehicular pathway use by the public. Chiu shared several site plans with Council that delineated the pathway easement and public and private easements on Chaparral Way. The vacation and reservation procedure was established by state law. Chiu noted that the easement modifications would clarify now and into the future that the Town's maintenance responsibility on Chaparral Way was limited to pathway use and not for roadway purposes. City Manager Cahill advised Council that recorded easement modifications were necessary to ensure that there was no misunderstanding with the residents as to the Town's responsibility for the roadway. He noted that the oral agreement that had previously been reached was not a viable remedy. Council discussion ensued. There was a consensus of the City Council that the pathway safety improvements were a good compromise and the one time expense was consistent with Council's direction. Subsequent pathway maintenance would be provided consistent with the maintenance provided to other paths. Council suggested that ii would be appropriate for the Town to acquire an agreement signed by the neighborhood representative as a condition for the installation of the gate. MOTION SECONDED AND CARRIED: Moved by Kerr, seconded by Warshawsky and passed unanimously to approve a budget up to $20,000 for pathway safety improvements related to non -vehicular pathway use on Chaparral and to authorize staff to proceed with the modifications of the public use easement to a 7 to 10 foot wide easement for non- vehicular use. Installation of the road gate would require a document from the neighborhood representative bringing to a close requests for roadway maintenance. NEW BUSINESS 9. Finance Department Reorganization for the Fiscal Year Beginning July 1, 2009 - (Staff. N. Pegueros) Finance Director Nick Pegueros introduced the item to Council. The item before Council was a proposal to reorganize the Town's finance department for the fiscal year beginning July 1, 2009. The reorganization would require the elimination of the Accountant/Office Manager position. The budgetary resources for that position would be reallocated to a combination of professional services and part time personnel budget that would assist the Town in cost-effectively and efficiently completing priority projects. Additionally, the 8 City Council Regular Meeting Minutes May 28, 2009 Attachment 4 Lor Altos Hilly - Circulation & Scenic Roadways Eleme— Adopted January 2a 1999 conveyances to the city of real property interests for street and road uses and purposes. The designee shall, prior to recording any conveyance under this section, affix a certificate to the instrument stating the acceptance into the city street system and designating the name or number, or both, of the city street or road." The Town's current process for roadway dedication/acceptance is not documented in an ordinance. The Town adopted a policy in 1997 that details a process for acceptance of private roadways which identifies the role of the Town and responsibility of private road owners. Inherent in the policy is the potential public cost of accepting and maintaining streets as public. Goal C-2 Many of the Town's roadways are privately owned and vary in their level of maintenance. The Town encourages consistent roadway maintenance and quality throughout the Town. Objectives The policies and implementation measures should result in X The dedication of private roadways to public ownership when requested by affected property owners, when they have been upgraded to current Town standards and where all necessary dedications have been offered by adjacent property owners. X For every private road not intended to be dedicated to public ownership the formation of maintenance agreements between property owners responsible for monitoring and maintaining their respective private roadways. Policies -tl Dedication will be considered only when the road is maintained and, if necessary, improved to a level acceptable to the Town. The Town may provide limited resources to assist with the acceptance and improvement of "through" private roads to public road standards. av New private roads shall not be permitted. -,1 Private, gated roadways shall be prohibited. Driveways The design of driveways is important for safety and aesthetic reasons. Because most development in Los Altos Hills is on steep terrain, driveways tend to be long and driveway intersections with roadways are more critical than in more urban settings. Goal C-3 Driveways should be compatible with the natural terrain, with minimal impact on grades and vegetation and should be designed for safe access to and from the individual parcels. Objectives The policies and implementation measures should result in: X Minimal cut and fill from grading of driveways. X Minimal impact to native and existing vegetation. X Safe and adequate ingress and egress to the private parcel. Policies Driveways shall be of a minimum width in order to accommodate emergency vehicles. -,Zl Driveways shall not exceed a maximum grade in order to allow for safe travel, including the access of emergency vehicles. Driveway design shall allow for adequate and safe development of pathways near roads. This will include a roughened surface at pathway crossings to allow safe equestrian use. �► Driveways shall have adequate sight distance to allow for safe entry onto the roadway. -q� Driveway design shall be required to minimize cut and fill and impacts on vegetation, consistent with providing for safe access. Driveways should be designed with adequate drainage. Driveways should be located to provide for landscaping between properties, to protect privacy, and to maintain a safe distance between adjacent driveways. Street addresses should be based on the street where the driveway access is located. Implementation Measures ✓ Driveway standards shall be incorporated into the Town's Site Development and Subdivision codes. Page 10 Adopted May 8, 2008 THE PATHWAYS SYSTEM GOAL 1 Develop and maintain a safe, convenient pathways system that allows non -vehicular travel throughout Town, meets recreational needs of residents, and provides regional connections. Policy 1.1 All residents of the Town shall have immediate access adjacent to or across the street from their residence to a pathway or pathways, for safe and convenient pedestrian and other non -vehicular travel along Town roads and to schools and community facilities, and for recreational enjoyment of the natural amenities of the community. Policy 1.2 Pathways shall serve to provide access to and from neighborhoods in the event of an emergency. Policy 1.3 Pathways shall be separated from the roadway pavement wherever possible and meander where necessary to accommodate topography, trees and landscaping. Policy 1.4 All paths shall be located and designed to preserve the beauty and natural character of .the area and to safeguard the user. Policy 1.5 Except for connections to regional trail and bikeway networks, Town paths shall be designed primarily for local circulation and recreational use. Policy 1.6 The Town shall maintain the pathways, using both pathway fees and General Fund monies. The annual Pathways Run is a popular event. Pathways Element Los Altos Hills General Plan Page P-4 Adopted May 8, 2008 GOAL Develop and maintain a system of roadside paths adjacent to public and private streets. Policy 2.1 Roadside paths shall be located within or immediately adjacent to the right-of-way of Town streets and on separate pathway easements adjacent to or over private streets. Roadside paths shall be separated from the roadway pavement by landscape buffering and shall meander, where possible. Policy 2.2 The Town Council shall adopt a list of those streets or segments of those streets that shall be planned for paths on both sides of the street. (The approved list is included in Appendix A.) Landscaping separates this path from Fremont Road. Policy 2.3 A roadside path shall be maintained on only one side of the street unless the street is included on the list adopted pursuant to Policy 2.2. The path may be located on alternating sides of the street, however, depending on factors such as available easements, topography, or proximity to schools or other facilities. If only one side of the street is in Los Altos Hills, there should be a path on the side within the Town's corporate limits. Policy 2.4 Typically, a roadside path shall not be maintained on a cul-de-sac that serves or could serve eight or fewer lots. However, a roadside path along a cul-de-sac may be required by the Planning Commission or Council for topographic or safety reasons, and shall be required where it would connect to an off-road path. Policy 2.5 The Planning Commission or City Council may require that an easement separate from a private street be dedicated, or that a pathway easement over the paved roadway be granted (if feasible), when the width of a private street easement of right-of-way will not accommodate both the paved surface and a separate path. Policy 2.6 Dedication of pathway easements outside of required road rights-of-way shall not affect the computation of the net area, LUF (lot unit factor), MDA (maximum development area) or MFA (maximum floor area) for a lot.
