APPROVED: Debbie Pedro, AICP, Planning Director DP RECOMMENDATION: That the Planning Commission: Forward a recommendation .to the City Council to approve the requested modifications and variance for the existing/previously approved Wireless Communications Facility, subject to the recommended Conditions of Approval in Attachment 1 and Findings of Approval in Attachment. 2. BACKGROUND On July 17, 2003, the City Council approved a Conditional Use Permit and a variance for a Wireless Communications Facility at the Purissima Hills Water District water storage facility at 26451 Ascension Drive (file # 41 -03 -CUP -VAR). On May 28, 2009, the City Council approved the Conditional Use Permit to be renewed for ten (10) years (file # 21 -09 -CUP). The existing Wireless Communications Facility consists of a 28' tall steel monopole at the south side of the Purissima Hills Water District property. Four (4) antennas are currently mounted on the pole at 24' from grade. The associated ground equipment is located on an 8'x18' concrete pad east of the existing pump house, which was previously approved to be located within the front setback. DISCUSSION The Purissima Hills Water District property is located on the west side of Ascension Drive. The property is used as water storage and an operations facility. Existing structures on the property include a maintenance building, pump house, storage building, two (2) water tanks, 28' tall monopole, and three (3) associated ground equipment cabinets. Surrounding uses include family residences to the north, west, south, and across Ascension Drive to the east. Staff Report to the Planning Commission Lands of Purissima Hills Water District (AT&T) September 1, 2011 Page 2 of 6 The applicant is proposing to add two (2) new panel antennas (52" H x 12" W x 6" D), four (4) new RET'S (remote electrical tilt) one (1) new ray cap, and four (4) new RRU's to the existing 28' tall steel monopole. In addition, three (3) new ground equipment cabinets are proposed on a 64 square foot concrete pad, in the same vicinity as the existing cabinets. . The proposed modifications to the existing wireless facility are for the new LTE (Long Term Evolution) 4G technology and will increase data speed to uplink and downlink for cell phones and handheld devices. Variance Per Section 10-1.505 of the Los Altos Hills Municipal Code, "no structure, nor portion thereof, other than driveways, including necessary backup areas; walkways; minor ornamental garden structures subject to the height limits specified in Section 10-1.504(f); fences; driveway light fixtures, limited to one fixture on each side of a driveway, for a maximum of two (2) fixtures per lot, subject to the height limits specified in Section 10-1.504(h); or underground utility facilities, shall be constructed, altered, or maintained so as to be located between the property line and any setback line." The applicant is requesting to install the three (3) new ground equipment cabinets on an 8'x8' concrete pad which will encroach within the front property line setback. Due to the topography of the site, existing development, and open space easement along the west, south, and east property lines, the locations to place the ground equipment is limited. Two (2) of the ground cabinets ( 29" H x 24" W x 20" D) will be stacked one on top of the other and the third cabinet (72" H x 30" W x 36.1" D) will stand alone. Because of the existing vegetation along Ascension Road, the equipment cabinets will not be visible from off site. Wireless Communications Facilities Policy Pursuant to the Town's Wireless Communications Facilities Policy, the applicant has submitted a 3-5 AT&T antenna master plan for the Los Altos Hills and Los Altos areas and coverage map (Attachment 6). CONCLUSION The facility is operating in compliance with conditions of the approved Conditional Use Permit and the Wireless Communications Facilities Policy. The applicant has submitted a report demonstrating that the proposed facility will operate within federal RF emissions standards and guidelines (Attachment 3). Site Development Plans Attachment 1 ATTACHMENT 1 CONDITIONAL USE PERMIT FOR A WIRELESS COMMUNICATIONS FACILITY LANDS OF PURISSIMA HILLS WATER DISTRICT 26451 ASCENSION DRIVE: FILE W21 -09 -CUP PLANNING DEPARTMENT: Any changes or revisions to the telecommunications facility or its use shall require an amendment to the applicable conditional use .permit(s). Additionally, the Planning Director may schedule a review or revocation hearing before the Planning Commission regarding the use permit, if any condition of approval is not being met or the facility is being used inconsistent with the approved use or in violation of Town development codes. 2. The use permit shall expire ten (10) years from the date of approval. Renewal of the permit must be requested in writing, with appropriate fees, prior to the expiration date. 3. The monopole shall be painted to the satisfaction of the Planning Director, prior to final inspection of the facility. The equipment units/shelters shall be painted a color, to be determined by the Planning Department, to blend with the surrounding environment prior to final inspection of the facility. 4. Landscape screening of the. equipment structures may be required by the Planning Department upon final inspection, if determined to be necessary. 5. 64 square feet of hardscape shall be removed from the site, in order to comply with the maximum development area on the property, prior to final inspection. 6. No portion of the ground equipment shall obstruct 'or encroach within the open space easement. 7. No trenching shall be conducted within the open space easement. 8. No trees shall be removed. If a tree is required to be removed, the applicant shall replace the tree at a 1:1 ratio with a like tree species and size, prior to final inspection. 9. The radio frequency emissions report shall be revised to include an actual measurement, not a modeled measurement, prior to acceptance of plans for building plan check. 10. The applicant shall submit a signed agreement to the Town, agreeing that, should the use be discontinued by the carrier, all facilities will be removed not later then 90 days after discontinuance of the use or abandonment. The agreement shall be drafted by the City Staff Report to the Planning Commission Lands of Purissima Hills Water District (AT&T) September 1, 2011 Page 5 of 6 Attorney, and must be signed by the applicant and submitted to the Town prior to acceptance of plans for building plan check. 11. Not later then 30 days after installation and initial operation of the antenna facility, and on or prior to January 1St of each year thereafter, testing of radio frequency emissions shall be conducted by qualified professionals and the reports of such testing shall be provided in writing to the Planning Department, with comparison of applicable Federal emissions standards. If at any time the emission levels are shown not to comply with Federal standards, the use permit shall be scheduled for a revocation hearing before the Planning Commission. ENGINEERING DEPARTMENT: 12. Any, and all, changes to the proposed Site Plan shall first be approved by the Town Engineering Department. No grading shall take place during the grading moratorium (October 15 to April 15) except with prior approval from the City. Engineer. No grading shall take place within ten feet of any property line. 13. Because of exceptional and extraordinary circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the provisions of this Title is found to deprive such property of privileges enjoyed by other properties in the vicinity and under identical zoning classification; Due to the existing development on the site, topography, and the open space easement, locations for placement of the ground equipment is limited. In addition, the property is a water tank facility; the proposed ground equipment is consistent with the existing utility uses on the site. 2. Upon the granting of the variance, the intent and purpose of the applicable sections of the Zoning Ordinance will still be served and the recipient of the variance will not be granted special privileges not enjoyed by other surrounding property owners. If this application is approved, the purpose and intent of the Zoning Ordinance is still served. This would not be a grant of special privilege because the Town has granted a setback Variance for wireless proposals with previous applications. The equipment will not be visible from off site by the neighboring properties due to the existing vegetation and slope of the property. 3. The granting of such variance will not be materially detrimental to the public welfare or injurious to the property, improvements or uses within the immediate vicinity and within the same zoning district. The granting of the Variance for encroachment into the setback would limit potential impacts to neighbors or property owners because the proposed location of the ground equipment is the same vicinity as the previously approved ground equipment. The proposed antennas and ground equipment meet the FCC limits for human exposure and the installations will be completed to Building Code standards. No detriment to public welfare is anticipated. (dba EBI Consulting) has been contracted by AT&T Mobility, LLC to conduct radio frequency electromagnetic (RF-EME) modeling for AT&T Site CNU 1811 located at 26451 Ascension Drive in Los Altos Hills, California to determine RF-EME exposure levels from proposed AT&T wireless communications equipment at this site. As described in greater detail in Section 2.0 of this report, the Federal Communications Commission (FCC) has developed Maximum Permissible Exposure (MPE) Limits for general public exposures and occupational exposures. This report summarizes the results of RF-EME modeling in relation to relevant FCC RF-EME compliance standards for limiting human exposure to RF-EME fields. 11 This report contains a detailed summary of the RF EME analysis for the site, including the following: ■ Antenna Inventory ■ Site Plan with antenna locations ■ Antenna inventory with relevant parameters for theoretical modeling ■ Graphical representation of theoretical MPE fields based on modeling ■ Graphical representation of recommended signage and/or barriers This document addresses the compliance of AT&T's transmitting facilities independently and in relation to all collocated facilities at the site. Statement of Compliance A site is considered out of compliance with FCC regulations if there are areas that exceed the FCC exposure limits and there are no RF hazard mitigation measures in place. Any carrier which has an installation that contributes more than 5% of the applicable MPE must participate in mitigating these RF hazards. As presented in the sections below, based on worst-case predictive modeling, there are no modeled areas on any accessible ground -level walking/working surface related to the proposed antennas that exceed the FCC's occupational or general public exposure limits at this site. AT&T Recommended Signage/Compliance Plan AT&T's RF Exposure Policy guidance, dated March 31, 2009, requires that: I. All sites must be analyzed for RF exposure compliance; 2. All sites must have that analysis documented; and 3. All sites must have any necessary signage and barriers installed. Site compliance recommendations have been developed based upon protocols presented in AT&T's RF Exposure Policy guidance document, dated March 31, 2009, additional guidance provided by AT&T, EBI's understanding of FCC and OSHA requirements, and common industry practice. Barrier locations have been identified (when required) based on guidance presented in AT&T's RF Exposure Policy guidance document, dated March 31, 2009. EBI 21 B Street 0 Burlington, MA 01803 0 1.800.786.2346 2 RF-EME Compliance Report EBI Project No. 62 10 1511 1.0 SITE DESCRIPTION USID No. 24152 Site No. CNU 1811 26451 Ascension Drive, Los Altos Hills, California This project involves the proposed installation of up to two (2) wireless telecommunication antennas to four existing antennas on a monopole, in Los Altos Hills, California. There are two Sectors (A and C) proposed at the site, with three (3) antennas that may be installed per sector. In each sector, there is proposed to be one UMTS antenna transmitting in the 850 MHz and two bands in the 1900 MHz frequency ranges, one GSM antenna transmitting in the 850 MHz and the 1900 MHz frequency ranges, and one LTE antenna transmitting in the 700 MHz and 1710. MHz frequency ranges. The Sector A antennas will be oriented 0° from true north. The Sector C antennas will be oriented 120° from true north. The bottoms of the antennas will be 23.7 feet above ground level. Appendix B presents an antenna inventory for the site. Access to this site is accomplished via a gate in the fence surrounding the water tower compound. Workers must be .elevated to antenna level to access them, so these antennas are not accessible to the general public. 2.0 FEDERAL COMMUNICATIONS COMMISSION (FCC) REQUIREMENTS The FCC has established Maximum Permissible Exposure (MPE) limits for human exposure to Radiofrequency Electromagnetic (RF-EME) energy fields, based on exposure limits recommended by the National Council on Radiation Protection and Measurements (NCRP) and, over a wide range of frequencies, the exposure limits developed by the Institute of Electrical and Electronics Engineers, Inc. (IEEE) and adopted by the American National Standards Institute (ANSI) to replace the 1982 ANSI guidelines. Limits for localized absorption are based on recommendations of both ANSI/IEEE and NCRP. The FCC guidelines incorporate two separate tiers of exposure limits that are based upon occupational/controlled exposure limits (for workers) and general public/uncontrolled exposure limits for members of the general public. Occupational/controlled exposure limits apply to situations in which persons are exposed as a consequence of their employment and in which those persons who are exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. Occupational/ controlled exposure limits also apply where exposure is of a transient nature as a result of incidental passage through a location where exposure levels. may be above general public/uncontrolled limits (see below), as long as the exposed person has been made fully aware of the potential for exposure and can exercise control over his or her exposure by leaving the area or by some other appropriate means. General public/uncontrolled exposure limits apply to situations in which the general public may be exposed or in which persons who are exposed as a consequence of their employment may not be made fully aware of the potential for exposure or cannot exercise control over their exposure. Therefore, members of the general public would always be considered under this category when exposure is not employment-related, for example, in the case of a telecommunications tower that exposes persons in a nearby residential area. Table I and Figure I (below), which are included within the FCC's OET Bulletin 65, summarize the MPE limits for RF emissions. These limits are designed to provide a substantial margin of safety. Known as the power density, the FCC has established an occupational MPE of 5 milliwatts per square centimeter (mW/cm2) and an uncontrolled MPE of I mW/cm2 for equipment operating in the 1900 'MHz frequency range. For the AT&T equipment operating at 850 MHz, the FCC's occupational MPE is 2.83 mW/cm2 and an uncontrolled MPE of 0.57 mW/cm2. These limits are considered protective of these populations. These limits apply for continuous exposures and are intended to provide a prudent margin of safety for all persons, regardless of age, gender, size, or health. Personal Communication (PCS) facilities used by AT&T in this area operate within a frequency range of 850-1900 MHz. Facilities typically consist of: 1) electronic transceivers (the radios or cabinets) connected to wired telephone lines; and 2) antennas that send the wireless signals created by the transceivers to be received by individual subscriber units (PCS telephones). Transceivers are typically connected to antennas by coaxial cables. Because of the short wavelength of PCS services, the antennas require line -of -site paths for good propagation, and are typically installed above ground level. Antennas are constructed to concentrate energy towards the horizon, with as little energy as possible scattered towards the ground or the sky. This design, combined with the low power of PCS facilities, generally results in no possibility for exposure to approach Maximum Permissible Exposure (MPE) levels, with the exception of areas directly in front of the antennas. 3.0 AT&T RF EXPOSURE POLICY REQUIREMENTS AT&T's RF Exposure Policy guidance, dated March 31, 2009, requires that: 1. All sites must be analyzed for RF exposure compliance; 2. All sites must have that analysis documented; and 3. All sites must have any necessary signage and barriers installed. Pursuant to this guidance, worst-case predictive modeling was performed for the site. This modeling is described below in Section 4.0. Lastly, based on the modeling and survey data, EBI has produced a Compliance Plan for this site that outlines the recommended signage and barriers. The recommended Compliance Plan for this site is described in Section 5.0. 4.0 WORST-CASE PREDICTIVE MODELING In accordance with AT&T's RF Exposure policy, EBI performed theoretical modeling using RoofView® software to estimate the worst-case power density at the site ground -level resulting from operation of the antennas. RoofView® is a widely -used predictive modeling program that has been developed by Richard Tell Associates to predict both near field and far field RF power density values for roof -top and tower telecommunications sites produced by vertical collinear antennas that are typically used in the cellular, PCS, paging and other communications services. The models utilize several operational specifications for different types of antennas to produce a plot of spatially -averaged power densities that can be expressed as a percentage of the applicable exposure limit. For this report, EBI utilized antenna and power data provided by AT&T, and compared the resultant worst-case MPE levels to the FCC's occupational/controlled exposure limits outlined in OET Bulletin 65. The assumptions used in the modeling are based upon information provided by AT&T, and information gathered from other sources. There are no other wireless carriers. with. equipment installed at this site. At the nearest walking/working surfaces to the AT&T antennas, the maximum power density generated by the AT&T antennas is approximately 13.00 percent of the FCC's general public limit (2.60 percent of the FCC's .occupational limit). The composite exposure level from all carriers on this site is approximately 13.00 percent of the FCC's general public limit (2.60 percent of the FCC's occupational limit) at the nearest walking/working surface to each antenna. The inputs used in the modeling are summarized in the RoofView® export file presented in Appendix C. A graphical representation of the RoofView@ modeling results is presented in Appendix D. It should be noted that RoofView is not suitable for modeling microwave dish antennas; however, these units are designed for point-to-point operations at the elevations of the installed equipment rather than ground level coverage. As presented in the AT&T guidance document, the signs must: ■ Be posted at a conspicuous point; ■ Be posted at the appropriate locations; ■ Be readily visible; and ■ Make the reader aware of the potential risksrp for to entering the affected area. EBI has conducted theoretical modeling to estimate the worst-case power density from AT&T antennas to document potential MPE levels at this location and ensure that, site control measures are adequate to meet FCC and OSHA requirements, as well as AT&T's corporate RF safety policies. As presented in the preceding sections, based on worst-case predictive modeling, there are no modeled exposures on any accessible ground -level walking/working surface related to proposed equipment in the area that exceed the FCC's occupational and general public exposure limits at this' site. As such, the proposed AT&T project is in compliance with FCC rules and regulations. 7.0 LIMITATIONS This report was prepared for the use of AT&T Mobility, LLC. Colocation, location on or near existing buildings, and landscape screening will be desired to minimize the visual impacts of the facilities on neighbors and the public. Policy: 1. Other public or quasi -public facilities, such as schools or churches e. Residential properties of at least ten (10) acres 2. Siting on residential parcels - Wireless communication facilities may be permitted on properties used for residential purposes or vacant parcels intended for residential property owner provides written consent and significant visual impacts are mitigated. 3. Colocation — Colocation of wireless communication facilities with other facilities is encouraged to the maximum extend feasible, as long as the colocation is technologically compatible and does not substantially increase visual impacts. Applications for colocation on an existing wireless communications facility shall be subject to an administrative review provided that the following requirement is met: ® The colocated antennas and ground equipment shall be mounted or installed within an existing tower, building, or structure where the physical appearance of the existing facility is not altered to accommodate the additional antennas and equipment. 4. Landscape screening and color - Landscape screening shall be required by the Town to minimize the visual impacts of wireless communication facilities. Poles, antennas, and equipment buildings should be painted to blend with the surrounding environment and/or buildings to further minimize visual impacts. 5. Environmental review - A Negative Declaration will typically be prepared for review of proposed wireless communication facilities, with special attention to the visual impacts of the facilities. Categorical exemptions may be used where facilities are colocated with or would be minimal additions to existing structures, with negligible additional visual impact. 6. Antenna master plans — Any applicant for a wireless communication facility site shall submit applications, to the best of their knowledge, for all sites anticipated to be required by the carrier for a three (3) to five (5) year period, and the request shall be reviewed by the Planning Commission and the City Council as a master plan application. 7. Terms of permits and abandonment of sites — Conditional use permits for wireless communications facilities shall be established for periods not to exceed five (5) years, at which time renewal of the permit must be requested by the applicant. More frequent review of the operation of the permit may be made a condition of approval. Approval will also require a written agreement from the applicant that, should the use be discontinued by the carrier, all facilities will be removed not later then ninety (90) days after discontinuance of the use or abandonment. Such a provision shall also be included in any lease with the Town for use of Town lands for wireless communications facilities. The Town may require bonding or other surety to assure the removal of such facilities. 8. Wireless communication firms shall, at the time of application for permits, demonstrate efforts which have been mad to inform neighboring residents of the proposed facilities, such as conducting meetings, or mailing fact sheets and/or letters, etc ... to neighbors. 9. The Planning Director is authorized to reduce or waive permit fees for any wireless communications facility that is proven to expand wireless coverage in the Town and is structurally capable of colocation. 10. The Planning Director is authorized to administratively approve portable wireless communications facilities also known as cell on wheels or COWS on certain properties as specified in Policy #1 on a temporary basis.
