Item 3.1 TOWN OF LOS ALTOS HILLS October 16, 2012 Staff Report to the Planning Commission SUBJECT: PATHWAYS ELEMENT MASTER PATH PLAN STUDY: TOYONITA ROAD AND WEST LOYOLA DRIVE FROM: Debbie Pedro, Planning Director V RECOMMENDATION That the Planning Commission: Accept the recommendations from the Pathways Committee on the Master Path Plan study area of Toyonita and West Loyola neighborhoods and forward the proposal to the City Council. BACKGROUND On February 16, 2012, the Pathways Committee presented a memo to the City Council regarding annexed properties not addressed on the Town's Master Path Plan and proposed the following three items: 1. That the Pathways Committee uses the Pathways Element guidelines until an official map update is generated and approved for the West Loyola annexation area. And that the Town Council approve a kickoff for the Pathways Committee and the neighborhood to work together to generate a draft map. 2. That in the future, the Pathways Committee should generate and make available a "straw man" map covering areas to be annexed prior to their annexation. And that annexations trigger Master Path Plan updates. 3. That there should be regular, more frequently scheduled updates to the Master Path Plan Map portion of the General Plan. The Council voted 4-0-1 (Larsen -recused) to authorize the Pathways Committee to proceed with the proposal. (Attachment 1) GENERAL PLAN AND MUNICIPAL CODE REQUIREMENTS Per the General Plan Pathways Element Policy 1.1, "All residents of the Town shall have immediate access adjacent to or across the street from their residence to a pathway or pathways, for safe and convenient pedestrian and other non -vehicular travel along Town roads and to schools and community facilities, and for recreational enjoyment of the natural amenities of the community." In addition, the Pathways Element lays out goals and policies for developing and maintaining a system of roadside paths adjacent to public and private. streets as well as off-road paths that provide connections between neighborhoods and direct routes to schools and open space preserves. (Attachment 2) Planning Commission Staff Report October 16, 2012 Page 2 of 2 Article 6 of the Site Development Ordinance further stipulates the requirements for pathway dedication, maintenance, and improvement. (Attachment 3) On March 5, 2005, the City Council approved the 2005 Off -Road Path Map which shows the location of off-road paths within the Town. Currently, the Town does not have an official Roadside Path Map. Requirements for Roadside and On -road paths are implemented in accordance with Policies 2.1 to 2.5 of the Pathways Element and a working Roadside/On-road path map is used by Town staff and the Pathways Committee as a reference document. For the subject study areas, the Pathways Committee recommends planned roadside paths along West Loyola Drive and portions of Berkshire Drive. The Committee also recommends on -road paths over Eloise Circle, portions of Berkshire Drive and Toyonita Road. No off-road paths are proposed. (Attachment 4) PUBLIC NOTICE Meeting notices were sent to the West Loyola and Toyonita neighbors prior t0 the Pathways Committee meetings on April 16, 2010 and April 23, 2012. Public hearing notices for the October 16, 2012 Planning Commission meeting were sent to residents with property abutting West Loyola Drive, Toyonita Road, Berkshire Drive, and Eloise Circle on October 5, 2012. COMMENTS RECEIVED On October 11, 2012, the Town received comments from Doug'and Bridget Morgan, 10711 Eloise Circle expressing concerns about the proposal. (Attachment 5) ATTACHMENTS 1. Processes The Master Path Plan map is getting out of date, particularly with respect to annexed areas. The Pathway committee (PWC) is seeking approval for some processes to deal with our responsibility of keeping the map current. We propose the following items and ask.for the council to approve: 1. That the PWC use the pathway element guidelines until an official map update is generated and approved for the West Loyola old annexation area. And that the town council approve a kickoff for the PWC and the neighborhood to work together to generate a draft map. 2. That in the future, the PWC should generate and make available a strawman map covering areas to be annexed prior to their annexation. And that annexations do cause Master Path Plan updates. 3. That there should be regular, more frequently scheduled updates to the Master Path Plan_ Map portion of the General Plan. Part 1: Old annexation As you know, the PWC makes recommendations to staff for paths or fees from homeowners who are building in town. We are guided by routes previously chosen with public input and shown on our General Plan Master Path map. (Not the walking map). If there are planned pathways on a property, we generally ask for a path to be built or upgraded. If there is no planned pathway, we typically ask for an "in lieu" fee. Rarely do we'vote to ask a homeowner to install a path not drawn on the map. However, since the town annexed the West Loyola area in 2007, we have been operating without our normal guidance. During the (lengthy) time it takes for the pathway committee and neighbors to generate carefully thought out routes and to allow for public review process, we must have SOME guidance for selecting path or in -lieu fee. We use the guidance set forth in the Pathway Element: GOAL 1 Develop and maintain a safe, convenient pathways system that allows non -vehicular travel throughout Town, meets recreational needs of residents, and provides regional connections. 2/3/12 page 1 A Proposal .for Three Processes All residents of the Town shall have immediate access adjacent to or across the street from their residence to a pathway or pathways, for safe and convenient pedestrian and other non- vehicular travel along Town roads and to schools and community facilities, and for recreational enjoyment of the natural amenities of the community. GOAL 2 . . Develop and maintain a system of roadside paths adjacent to public and private streets. GOAL 3 Off-road paths shall be located on private property on easements that have been dedicated to the Town, or over public lands. They shall provide connections between neighborhoods and provide direct routes to schools and open space. Cul- de -sacs should have off-road paths that connect the end of the street to adjoining neighborhoods whenever possible. The goals for the pathway committee are clear even without an approved map, but any map (official or strawman) does provide residents a better understanding of areas of interest for pathways. To involve the neighbors who know the routes and needed paths, the PWC is asking that the town council support a kickoff mapping project in West Loyola annexation neighborhoods. The'outcome would be a strawman map that will be used for the pathway committee to review pathway accessibility by pedestrians and equestrians to determine where roadside paths and off road connections are needed. It will allow the neighbors to see a concept of what. paths in their neighborhood could be planned. In NO way does this indicate a final map for the general plan master path map, but it would at least bring to the homeowners attention that a pathway in their neighborhood is possible. Once the PWC has had time to review each road to determine where and on which side roadside paths are needed and where off road connections should be planned, then we will present a "draft" map for approval by the town. Part 2. Strawman for New Annexations and annexation automatically causes MPP update 2/3/12 1 page 2 A Proposal for.Three Processes We request that neighborhoods to be annexed be given a proposed mapping of their area before they are annexed. We need to educate potential new residents about our pathway system, given that residents being annexed might not be familiar with it. We have learned that trying to add a newly annexed area to our pathway system without discussion during annexation creates hard feelings and difficulties in proposing routes. Having a proposed route in a neighborhood might influence a neighborhood to more detailed discussions while they are being annexed so that there is not a feeling of surprise or betrayal when the paths are requested. To that end, we show a proposal for the Olive Tree Lane area, and will develop a map for the area to the south of West Loyola (Mora drive). Olive Tree Lane annexation strawman map. 2/3/12 page 3 A Proposal for Three Processes Again, these maps are merely suggestions, placeholders and a beginning discussion point. When the annexation is complete, we would have drafts in place that the neighbors helped to build. The full review and public discussion could not be up for vote until the neighbors are actually residents of our town. If the annexation process would automatically cause a master path map review for update, then we would. not ever again have the situation that a neighborhood is in limbo for 5 or more years. Part 3. Updates to the Master Path Map be scheduled at regular, more frequent intervals. Given that the Master Path Map communicates to residents about what some feel is an encumbrance on their property which may need to be disclosed during a sale, subdivision or even an annexation, the PWC feels that it is critical that the map be as up to date and error free as possible. In addition, some residents do not recognize that the Master Path Plan map is.and will always be a work in progress. Since the last approved map, the PWC has had a collection.of small corrections; there have been new paths built; and new subdivisions made. In addition, we have neighborhoods in town that were annexed without those neighborhoods being reviewed and put into the pathway system. We know that the public review of master path maps are a topic of much interest in our town and that level of interest causes a burden on the staff and the town council. However, if. regularly scheduled reviews and updates were part of a normal town process, we feel that everyone would become accustomed and would benefit. We would suggest a period such as every two to four years might be workable. Perhaps one fourth of the town could be updated each year and then the map would be under review only in a given area once every four years. We are not certain of the exact process; but We very strongly encourage the town council take some steps to create a regular review process and schedule to keep this vital document approved and up to date. We would like all town residents to be aware that the Master Path plan is a living document, subject to change and development. 2/3/12 page 4 A Proposal for Three Processes In conclusion, the PWC would like the town council: 1. To understand the goals the committee uses when reviewing properties not mapped and to approve the kick off of an exploration for paths in the West Loyola old annexation neighborhood to create a new update to the master path plan map. 2. To approve having some sort of map in place during an annexation for new neighborhoods, with the understanding that any annexation would automatically cause a master path plan update cycle. 3. Policy 1.1 All residents of the Town shall have immediate access adjacent to or across the street from their residence to a pathway or pathways, for safe and convenient pedestrian and other non -vehicular travel along Town roads and to schools and community facilities, and for recreational enjoyment of the natural amenities of the community. Policy 1.2 Pathways shall serve to provide access to and from neighborhoods in the event of an emergency. Policy 1.3 Pathways shall be separated from the roadway pavement wherever possible and meander where necessary to accommodate topography, trees and landscaping. Policy 1.4 All paths shall be located and designed to preserve the beauty and natural character of the. area and to safeguard the user. Policy 1.5 Except for connections to regional trail and bikeway. networks, Town paths shall be designed primarily for local circulation and recreational use. Policy 1.6 The Town shallmaintain the pathways, using both pathway fees and General Fund monies. Policy_ 21. _ - Roadside paths: shall be located within or _ - immediately adjacenf''to the right-of-way of Town streets. and on separate pathway easements adjacent to or overprivate streets. Roadside paths shall be separated from the roadway pavement by landscape buffering and shall meander, where possible. Poli_cy,2.2 _ _ The Town Council shall adopt a list of those streets or segments of those streets that shall be planned for paths on both sides of the street. (The approved list is included in Appendix. A.) Landscaping separates this path from Fremont Road. Policy 2.3 A roadside path shall be maintained on only one side of the street unless the street is included on the list adopted pursuant to Policy 2.2.. The path may be located on alternating sides of the street, however, depending on factors such as available easements, topography, or proximity to schools or other facilities. If only one side_of the street is in Los Altos Hills, there should be a path on the side within the Town's corporate limits. Policy 2.4 Typically, a roadside path shall not be maintained on a cul-de-sac that serves or could serve eight or fewer lots. However, a roadside path along a cul-de-sac may be required by the Planning Commission or Council for topographic or safety reasons, and shall be required where it would connect to an'off--road path. Policy 2.5 The Planning Commission or City Council may require that an easement separate from a private street be dedicated, or that a pathway easement over the paved roadway be granted (if feasible), when the width of a private street easement of right-of-way will not accommodate both the paved surface and a separate path. Policy 2.6 Dedication of pathway easements outside of required road rights-of-way shall not affect the computation of the net area, LUF (lot unit factor), MDA (maximum development area) or MFA (maximum floor area) for a lot. Pathways Element Los Altos Hills General Plan Page P-5 Adopted May 8, 2008 GOAL 3 Develop and maintain a system of off-road paths that provide connections between neighborhoods and direct routes to schools and open space preserves. Policy 3.1 Off-road paths shall be located on private property on easements that have been dedicated to the Town, or over public lands. They shall provide connections between neighborhoods and provide direct routes to schools and open space. Cul- de-sacs should have off-road paths that connect the end of the street to adjoining neighborhoods whenever possible. Policy 3.2 There shall be three classes of Off -Road Paths: Class 1—Off-road paths for which easements have been granted to the Town for a completed route, on which a path has been developed or pathway use has been established, and which is maintained by the Town and is open for public use. Class 2—Off-road paths for which easements have been granted to the Town for less than a completed route, or where the pathway easement exists but the path has not been constructed or maintained and is not open for public use. Such paths remain to be completed in the future. Class 3—A planned future off-road path, as shown in the Master Path Plan. These paths may need dedication of easements over a single large parcel of land, or may require easements over a number of smaller parcels. Policy 3.3 Off-road paths shall be a permitted use in conservation and open space easements, and should be reflected as such in the language of the easement agreement at the time of dedication. Policy 3.4 Whenever possible, the Town shall require the dedication of easements for off- road paths along designated emergency routes. Policy 3.5 The design of new subdivisions—especially those with cul-de-sac streets—shall incorporate pathway connections to nearby neighborhoods or community facilities, such as schools, and to open space areas. Policy 3.6 Dedication of off-road pathway easements shall not affect the computation of the net area, LUF (lot unit factor), MDA (maximum development area) or MFA (maximum floor area) for a lot. Policy 3.7 Off-road paths shall be maintained in as natural a state as possible, except that installed surfaces may be acceptable when paths serve as connectors to schools or neighborhoods, or where special use or topography make it necessary. Policy 3.8 Off-road paths shall be located along or as close to property lines as possible. Pathways Element Los Altos Hills General Plan Page P-6 Adopted May 8, 2008 GOAL 4 Maintain and implement the Master Path Plan to ensure development of the Town's pathways system. Policy 4.1 The Master Path Plan shall consist of all of the following: a. A book of street maps of the Town showing streets with paths planned on both sides of the street, after adoption by the City Council (see Policy 2.2). b. A book of street maps of the Town showing the side of each street on which a roadside path is planned. Determination of which side of a street the path should be located and type of construction shall be made by the Planning Commission, with the advice of the Pathways Committee and the City Engineer, at the time of subdivision approval or site development approval. The book of street maps shall also show the status of roadside paths for cul- de-sacs and private streets, in accordance with Policies .2.4 and 2.5. c. A book of street maps of the Town showing the location of Class 1 off-road paths. d. A book of street maps of the Town showing the location of Class 2 off-road paths. The Pathways Committee will review from time to time these paths to determine the status of their development and to recommend actions to convert Class 2 paths to Class 1 paths. e. A map to be developed by the Pathways Committee and approved by the City Council showing future needed off-road paths. Such a map, upon adoption, will identify Class 3 paths. In addition to or in lieu of the documents required above, the Town may display the Master Path Plan through other mapping or computer data bases for public and staff use. Policy 4.2 At the time of subdivision or site development approval, property owners may be required to dedicate easements and/or construct paths on their property. Owners of property on which no path is needed shall contribute to completion of the pathways system by the payment of a pathway fee. The pathway fee shall be established by Town ordinance. Paths shall be constructed by property owners as site development occurs. In some cases, the Town may construct paths as funding permits. Policy 4.3 All new development which is expected to result in an increased demand for use of pathways shall comply with requirements for non -vehicular access, including dedication of easements and/or construction of paths, or payment of pathway fees, as follows: Pathways Element Los Altos Hills General Plan Page P-7 Adopted May 8, 2008 a. All subdivision development (except for lot line adjustments) shall be required to comply with pathway requirements, as the project would result in an increase in the number of homes (and residents) in the Town. b. All proposals for new main residences and/or secondary dwelling shall be required to comply with pathway requirements, as the project would result in an increase in the number of residents in the Town. c. A cumulative development of 900 square feet of habitable floor area or greater shall be required to comply with pathway requirements, as 900 square feet is considered a major addition requiring Planning Commission discretionary review; is generally the size of a large master bedroom and bathroom suite or three smaller bedrooms, based on typical submittals to the Town; and is roughly equivalent to the average area of floor space per Town resident, resulting in an increase (presently or in the future) in the number of residents in the Town. d. Development of a barn or stables in excess of 900 square feet shall be required to comply with pathway requirements, as the project would generate additional stable capacity and place an increased burden on the equestrian us-e—of pathways. e. Other types of development proposals, such as conditional use permits or variances, shall require finding by the Town that justify the nexus for pathway requirements for that particular project. Policy 4.4 Where pathway installation is required for a project, construction of the path shall occur concurrent with development of the project, unless the Planning Commission or Council determine that the path would serve no useful purpose in the near future, due to the incompleteness of the pathway segment. Policy 4.5 A lot that contributed a pathway fee at the time of subdivision shall not be required to contribute again at the time of initial site development. Policy 4.6 Pathway fees shall be deposited in a designated fund and used only for pathway projects. Policy 4.7 The incremental development of the pathways system sometimes results in gaps in both the roadside and off-road pathways. Public funds available to the Town, including the pathway fees, shall be used on projects that will complete the gaps in the system. Policy 4.8 Pathway standards shall be adopted by resolution of the City Council to address roadside and off-road pathway design. Policy 4.9 Site development authorities shall be sensitive to path location and design. This is especially the case for the off-road paths. The location shall be sensitive to the privacy of future residents whenever a parcel is subdivided or a lot is developed. All paths shall be located and designed to preserve the beauty and natural Pathways Element Los Altos Hills General Plan Page P-8 Adopted May 8, 2008 character of the area and to safeguard the user. Particular care shall be given to retaining trees and vegetative cover and to minimize grading and erosion. Policy 4.10 Typically, off-road paths shall be located along property lines, when topography permits. Fencing along paths may sometimes be appropriate to protect privacy, so long as it does not intrude into easements or right-of-way. Policy 4.11 Street trees along the roadside path system should be promoted to enhance the pathway experience, but shall be located to avoid conflict with path use. Policy 4.12 Property owners who damage paths on their property shall.be required to repair them. Damage can occur by landscaping planted too close to the path, sprinklers near the path, slippery driveway surfaces across a path, or disking too close to the path. Policy 4.13 Class 1 off-road paths shall have sign posts at their entrance to help residents locate them and feel free to use them. Policy 4.14 Major off-road paths should be named as a way to encourage their use and to recognize historical entities associated with the Town or to honor Town residents who -have contributed to the development of the system. Policy 4.15 The Town shall accept offers of dedication of pathway easements made at the time of development and record them so that the future pathway right-of-way is identified. Policy 4.16 The Town shall seek donations of pathway easements needed to complete gaps in the system. The Town shall assume the legal and engineering costs involved with the preparation of easement donations unrelated to development and should inform residents of possible tax advantages from easement dedication. Policy 4.17 A Pathways Committee of residents interested in the pathways system shall be appointed by the Council. A major responsibility of the Committee shall be to suggest priorities for the Council and the City Manager regarding those paths most in need of maintenance or development. The Committee shall also be responsible for the maintenance and development of the Master Path Plan. Policy 4.18 Property owners shall not block pathways or otherwise impede pathway use through the placement of fences, landscaping, irrigation, mailboxes, or any other means. Policy 4.19 Provision for pathway crossings or bridges shall be made at appropriate locations, such as across creeks, and all roadway vehicular bridges shall be designed to incorporate pathway crossings. Policy 4.20 Trails and paths shall be permitted uses in open space and conservation easements. These trails shall be constructed and maintained to minimise the environmental impact upon the area. Pathways Element Los Altos Hills General Plan Page P-9 Adopted May 8, 2008 Policy 4.21 When a pathway crosses a driveway or walkway, the pathway surface shall take precedence to provide safe footing for equestrians and pedestrians. Where a paved surface is required, the crossing must be acceptable as a pathway, e.g., roughened. Policy 4.22 The Town shall maintain a walking map available to residents that indicates all roadside and off-road paths that are passable. Program 4.1 Continue to implement the Master Path Plan by requiring the dedication of easements, construction of pathways and/or payment of pathway fees as a condition of approval for subdivisions and site development permits. Program 4.2 Continue toimp rove the Town's maintenance of constructed pathways. Program 4.3 Review the.approved list of streets that should have paths on both sides and update the list as necessary. Program 4.4 Review the walking map on a regular basis and update the map as necessary. Program 4.5 Develop, adopt and implement an ordinance that codifies pathway requirements and regulations. Pathway Dedication, Maintenance and Improvement 10-2.601 Puraoses. The purposes of this article are to insure that provision is made for public pathways to provide pedestrian, equestrian, and bicycle access for Town residents; to implement the Master Pathway Plan of the General Plan of the Town of Los Altos Hills; and to prevent damage to the Town's.pathways from activities that occur on private property. (§ 15, Ord. 299, eff. December 11, 1985) 10-2.602 General policies. (a) Each property shall have direct access to a pathway or indirect access via a vehicular right-of-way. (b) Undeveloped properties along designated pathways and bicycle routes may be required to dedicate an easement for the extension of the pathway as a condition of site development approval. (c) Pathways shall be sited and improved in a manner that creates minimal disturbance to the natural environment. (d) Equestrian and pedestrian paths should generally be separated from roadways. (e) Pathways shall be of sufficient width to provide a safe corridor for travel and pathway maintenance. (f) Except for designated regional trails and bikeways, paths shall be designed primarily for local use by Town residents. (g) Intersections of paths and vehicular rights-of-way shall be kept clear of vegetation which might obscure the view of users. (h) Pathways shall be designed and maintained to prevent erosion, to prevent injury from landslides or other soil movements, and to assure proper drainage of the path. (i) Slopes in excess of fifteen (15) percent adjacent to a pathway shall contain soil retentive landscaping, rockery, netting, or other devices approved by the City Engineer to reduce potential damage to the path or injury to users of the path from landslide, soil creep, or erosion. (i) Pathways shall be designed and maintained to minimize their impact on adjacent properties. (§ 15, Ord. 299, eff. December 11, 1985) 10-2.603 Construction activities near pathways. Construction activities and tilling undertaken near a pathway shall create minimal disturbance to the pathway. Appropriate measures shall be undertaken to assure that landslides or soil movement do not occur on pathways. Temporary drainage facilities or plantings may be required by the City Engineer during construction to insure that pathways are not eroded or damaged from stormwater runoff. Any damage to a pathway resulting from private activities shall be repaired by the responsible party at their expense. In the event damage creates an irreparable break in the pathway, the responsible party may be required by the Town to provide or acquire an alternate easement for the pathway. (§ 15, Ord. 299, eff. December 11, 1985) 10-2.604 Drainage. Drainage facilities on private properties adjoining pathways shall be designed and maintained so that stormwater runoff from those properties does not drain onto the pathways. (§ 15, Ord. 299, eff. December 11, 1985) Article 6. Pathway Dedication, Maintenance and Improvement 10-2.605 Driveway surfaces. Page 2 of 2 The surfacing or resurfacing of a driveway at its intersection with a path shall be accomplished with material and methods acceptable to the City Engineer to reduce the danger of slipping by users of the pathway. (§ 15, Ord. 299, eff. December 11, 1985) 10-2.606 Dedication of pathway easements. Whenever a site development permit is requested for a main residence, a secondary dwelling, an addition to a structure of at least nine hundred (900) square feet of "habitable" floor area (including cumulative additions of nine hundred (900) or more square feet of habitable floor area), or a barn or stable of at least nine hundred (900) square feet in floor area, on a property which is designated on the Master Path Plan for an off-road pathway or for a roadside pathway, but where all or a portion of such roadside path cannot feasibly be located within the existing public or private right-of- way, the Site Development Authority may require the dedication of an easement for public use as part of the Town's pathway system according to the guidelines contained in the Pathway Element of the General Plan. Pathway easements shall be required within emergency road easements. In addition, the following guidelines apply: (a) An easement should generally be located along the boundary of a property; (b) The easement shall be located so as to connect -to existing or future pathway segments at the boundaries of a property; and (c) The easement shall not be located on terrain that cannot be safely or conveniently traversed by pedestrians or equestrians. (§ 15, Ord. 299, eff. December 11, 1985; § 4, Ord. 381, eff. We writing to express our opposition to this proposal which comes before the Planning Commission for a study session at your October 16 meeting. Our opposition is based on the following points, each of which are explicitly recognized in the Pathways Element of the Los Altos Hills General Plan as factors that must be considered in determining the location of pathways: 1) Affected Terrain. The terrain throughout the proposed route effectively precludes the construction of pathways. It consists of severe hillsides,. loose soil, concentrated sections of mature trees, and established landscaping, as shown by the attached photos of the roadside frontage. Even assuming that engineering and ground stabilization problems could be overcome, the construction of pathways here would threaten serious erosion, require the wholesale removal of mature trees and shrubs, and the destruction or relocatiort of fencing and other permanent landscaping features that have been in place for decades. 2) Safety of Users. The safety of pathway users would be at risk due to loose soil and steep hillsides between the proposed pathway and the roadway below (especially on W. Loyola Drive), With attendant liabilities for property owners and the Town. 3) Privacy of Owners. The privacy of property owners would be compromised as many parts of the proposed pathways would, by necessity, run immediately adjacent to patios, pools, tennis courts, and lawns of the homes along W. Loyola and Berkshire Drives. We, of course, have a direct stake in this matter since the proposed pathway route would run the length of our property's significant frontage on W. Loyola Drive. So to determine the position of our neighbors on this matter, we circulated a survey to affected property owners throughout the area, not just those over which the pathways would run. We learned that our concerns were the shared concerns of the West Loyola community neighbors who we surveyed. The opposition of those who responded was unanimous. The survey results, together with the accompanying opinions expressed by the respondants, are attached to this letter. No neighbor has thus far expressed support for the proposed pathways. Finally, one must ask who the proposed pathways would serve? Bike riders would certainly not use a path with a crushed rock, pervious surface that would not, in any case, be a continuous path until sometime in the distant future. Pedestrians rarely walk up West Loyola Drive—see attached traffic survey taken on Saturday, September 29—and equestrians have not been seen in the neighborhood in over 30 years. Moreover, the pathway starting point is at the dangerous, low -visibility intersection of West Loyola and Eastbrook Avenue—nowhere near any other pathway that would provide access for Los Altos Hills residents. For each and all of the above reasons, we respectfully request that the Planning Commission decide against the proposed pathway location recommended by the Pathways Committee. Pursuant to that policy, by action of the. 12 member Los Altos Hills.Pathways Committee, pathways in our neighborhood have been proposed for all of West Loyola Drive and for roughly %Z of Berkshire Drive (see route on enclosed map). At its next meeting on Tuesday, October 16, the Town's Planning Commission will conduct a study session to discuss the Pathways Committee's proposals. If approved, the Planning Commission will recommend that the Town Council amend the Los Altos Hills. General Plan Pathways Element Master Plan Map to include the paths along West Loyola Drive and Berkshire Drive. The Town's pathway policy is not without limits. It clearly -and explicitly requires the Town to consider privacy of property owners; safety of pathway users, and respect for existing terrain and natural features to avoid erosion of land and removal of trees and plants in determining where pathways should be located. At their September 24 meeting, we appeared before the Pathways Committee to oppose a proposed path over our property because of each of these considerations. We pointed out that the path across our property, proposed by the Pathways Committee to be constructed above the crest of our hillside which rises some 16 feet over the roadbed of West Loyola Drive, would be immediately adjacent to our pool, patio, and outdoor living area, would cause damaging erosion along the hillside, and would create an undue safety risk for pathway users with the attendant liability to us. The Pathways Committee declined to act on our appeal. In our view, the concerns we raised with the Pathways Committee apply in varying degrees to the other affected properties in our neighborhood, such that the proposed pathway routes along West Loyola Drive and Berkshire Drive are simply not feasible. We think it is important to determine if our neighbors share our concerns, or, as indicated in prior minutes of the Pathways Committee, the proposed pathways have neighborhood support. We of course share in those concerns, since I doubt that the Town would assume such liabilities itself or indemnify us from the consequences. No pedestrian/car accidents in 41 years. 2. There is a fault line on and near our property, do not want anyone creating a path. 3. The majority of Eloise Circle is narrow and hardly enough for two cars to pass. 4. Concerns about feasibility, safety, and private property/privacy re proposed paths on West Loyola Drive and Berkshire Drive preclude our support for paths thereon. 5. Properties in area were developed from 1924 to LAH annexation under Santa Clara County rules so heritage trees and large, mature shrubs everywhere are close to the roadways. 6. Privacy concerns prevail because pathways as proposed would run near pools, tennis courts, patios, and even front doors of the parcels. 7. LAH installed Botts Dots on West Loyola Drive from Eloise Circle to Eastbrook Drive so safety .problem caused by drivers crossing over center line has been eliminated. 8. Pedestrian traffic on West Loyola Drive and Berkshire Drive is small. 9. The slope of the proposed routes would be economically unrealistic. 10. If paths cannot go on winding corners then there is no point. 18. Cost ambiguity — who is paying? LAH or residents? If the latter how much? 19. What about valuation impact on residences?. 20. Biggest safety risk is cyclist which proposed pathway plan does not address. 21. Why is this scheme a priority for LAH funds? Are there better and more urgent issues for LAH funds? 22. There is easy.access from our neighborhood to Mid -Peninsula Open Space District lands for all kinds of hiking, biking, and equestrian needs for residents of our neighborhood and other LAH neighborhoods. 27. Since there appears to be no easy pathway route across the California Water Company property on West Loyola Drive which does not impact its operation to pump water to our neighborhood, the only option there would be to interrupt the path which would lead to increased danger for pedestrians and liability to LAH. 28. Notification to property owners affected by the proposed pathways in the neighborhood was slow in that pathways proposal by Pathways Committee was made in April 2012 and notice to property owners/neighborhood residents was received October 6, 2012. 29. If LAH is planning a pathway on West Loyola Drive, is there a LAH pathway planned for Eastbrook Drive? As currently configured; and even after a West Loyola Drive path might be put in, walking along Eastbrook Drive to West Loyola Drive is not safe. 30. Where does LAH want to encourage residents to enter Rancho San Antonio? If it is at the Ravensbury entrance then doesn't it make more sense to build a path along Ravensbury to that entrance? 31. And what about all those walkers — most of whom are not LAH residents -- who enter Rancho San Antonio from Mora Drive above Terry Way, an area which has applied for annexation to LAH, and an area which has yet to be considered for LAH paths by its Pathways Committee. 32. The impact of these proposed paths on West Loyola Drive and Berkshire Drive is huge in that its cost would be high and it would be an engineering feat on such a slope. 33. We like the idea of pathways which have been in place for years and make the hills accessible to everyone, but, in the case of our narrow roads and steep slopes, not to mention the impact on our neighbors, a pathway up West Loyola Drive doesn't seem feasible at all. 34. Why? Waste of money. -Makes no sense. 35. After 37 years of walking, running, and strolling. babies; I have never felt unsafe on the roads in our neighborhood. 36. The terrain on West Loyola Drive and parts of Berkshire is not suitable for pathways; and from the Morgan study and having lived here for over 60 years, pathways simply are not warranted. Quaint as it was in 1960 to plan for lovely meandering pathways through or along residents' property in the rustic little town in the hills, in today's economy, and in this specific area, it must be recognized that forcing an ordinance on an inhospitable area where no resident need has been shown to exist at an exorbitant cost is not what was defined in the Town's Green Sheets. I am the developer of record for the Cinnabar Hills Subdivision, which was approved under county jurisdiction in 1973. Four properties touch West Loyola Drive. At the time a pathway was proposed to the Town of Los Altos Hills along the road on the downhill side of West Loyola Drive. The Town would not accept the dedication because they felt the land was too steep, the maintenance too expensive and the liability to the Town and the owners too great. The same problems are true today on both sides of West Loyola. Sadly, Los Altos Hills seems to have a problem in its insistence in trying to enforce antiquated ordinances or spending excess monies on -projects -for which -there is -no justifiable need, -and -in this -case where the terrain simply will not support the project. 1) The terrain on these roads is very steep in most locations on both sides. Extensive retaining walls totaling up to 500 yards in length and up to 16 feet in height would have to be built at a huge cost with safety issues and serious liability both for the Town and the property owner. 2) Mature heritage trees and established landscaping would have to be removed and interior fencing built for privacy and security for the homeowner. This area was under County jurisdiction until six years ago and frontage was developed accordingly. 3) Residents do not "walk to town" on a regular basis. The Town's General Plan states the pathways are for the residents to have an alternative manner to travel through town. In truth, of the few walkers seen on West Loyola Drive, most are non-residents from the other side of Interstate #280 and are out to walk for their own or their dog's exercise. A pathway, which could also draw unsavory non-residents to our properties, could also dramatically affect residents' safety. 4) Residents no longer ride their horses "to town". At one time horses ruled the road, even on West Loyola with several stables. There has not been a horse seen on West Loyola to my knowledge in over 30+ years. 5) Road cyclists, who have replaced the horses, will never use the pathways, as their tires are not meant for the crushed rock, the traditional type of material used. To Summarize: The steep terrain on these roads simply does not warrant pathways; Many residents affected by the pathway strongly oppose it and there has been no proven need for pathways in this area. Building up to 500 yards of up tol6high, visually offensive retaining walls at an absurd cost, removing mature heritage trees and established landscaping for a few non-residents to wander though our properties uninvited, increasing liability and reducing resident safety issues and property values, is not what was defined in the Town's Green Sheets. The properties in this area were developed in the period from 1924 to 1960. Many of the properties have significant hills down to or slopes up to the roadways. Trees are everywhere close to the roadways with many of them over 50 years old. The construction of pathways on many of the properties would interfere with the privacy of the . owners, cause erosion of the land, and require the removal of heritage treesand large shrubs. The Morgan's property is just one example where pathways would run near the pools, tennis courts, patios, or even front doors of the parcels. Since the installation of Botts Dots on the W Loyola from Eloise to Eastbrook, the problem of safety caused by drivers continually crossing over into the oncoming lane has been essentially eliminated. The amount of pedestrian traffic on both streets is small. The impact this would have on the neighborhood is huge. The cost would be high and it would be an engineering feat on such a'slope. Jack and I like the idea of pathways. We use the ones in Portola Valley a lot. They have been in place for years and do make the hills accessible to everyone. But, in the case of our narrow road and steep slopes, not to mention the impact on our neighbors, a pathway up W. Loyola doesn't seem feasible at all. Loyola you are encouraging them to walk to and on Eastbrook Ave, which will put them at risk. 2) Have you coordinated with the city of LA to extend a path to meet up with the LAH path on Eastbrook Ave? 3) -Doesn't- it =make a whole -10t -more sense to run a path -along -Ravensbury; to the preexisting path at the intersection of Magdalena and Ravensbury? Ravensbury has, for most of its course, a better shoulder. Also, if LAH wants to encourage citizens to utilize the Ravensbury entrance to Rancho San Antonio then a path should be built to that entrance. 4) And furthermore, a much more needed pedestrian path is along upper Mora (in the process of annexation). On this street,. especially at the point just uphill from Terry Way, there is zero room for pedestrians.
