The Regular Meeting of the Planning Commission of the Town of Los Altos

ROLL CALL: PRESENT: Commissioners Alter, Garbett, Hawley, Hibner,

ABSENT: Commissioner Prentice
MINUTES: May 17, 1962.
ACTION:
Adopt Minutes of May 17, 1962 as submitted.
COMMUNICATIONS & ANNOUNCEMENTS -
Deferred to end of meeting.
PUBLIC HEARINGS:
1. Fremont Hills Country Club - Use Permit for Liquor License,
Chairman Bowler declared the public hearing open at 7:59 P. M., asking
for comments from the Floor. There being none, the public hearing was
closed.
RECOMMENDATION:
That the original decision on the Use Permit of the Fremont
Hills Country Club be waived to allow a liquor license for the
sale of alcoholic beverages to bona fide members,and'their guests,
MOTION: Hawley; SECOND: Mellquist; VOTE: Passed unanimously
VARIANCES:
Request of Ray S. Stewart (V-112-62) was cancelled.
OTHER BUSINESS:
1. E1 Monte Road.
Commissioner Mellquist commented on the Council's decision on the pro-
posed improvement of E1 Monte Road, by the County, stating that the
plan had not been before the Planning Commission. He commented on the
anticipated heavy traffic, and questioned whether or not paths or in
leiu payment for paths had been required for pedestrians and whethor
L there are plans'for equestrian ; trails and for landscaping.
�r _ Councilman Fowls was present and stated that the City Attorney, the City
Engineer, and the Staff had reviewed the Flan. He stated that he would
register the Planning Commission's concern, relative to this matter,
with the Council..
DIVISLONS OF LAND:
Ttem 1, Bruce McNeil, and Item 2, R. A. Bowan, were postponed.

Mr. Baker explained that he wished tosubdtVide"hisproperty -so that he
might negotiate with the California Division of Highways for the pur-
chase of property lying within the right of way of the proposed freeway.
He exclained that the line drawn through the garage represents the
High�aay Commission's approximate right of way; that the like drawn,
creating a strip 167.20' snide, is to maintain the proper setback from
the proposed freeway, and that the prospective purchaser -.of Lot 2
(7.503 acres) would have an option to purchase this 167.20' strip Of
land. He further explained that division line between Lots 1 and 2
is permanently established, he would not be in a position to sell to
the State.
RECOMMENDATION:
That the Map of of Milton L. Baker (228-62) 2 lots be approved
under the conditions Of Sec. III, Subsec, 3:40, Ord. No. 69•
MOTION: Mellquist; SECOND: None.

questions were raised relative to access for Lot 2 and problems re-
garding passible subdivision.
RECOMMEND&TION:
That the Tentative Map of M. L. Baker be approved under condi-
tions of Sec. III, Subsea. 3:40, Ord. No. 69, and conditional -
upon an agreement that any portion of the Baker property not
accuired by the California Division of Highways is to be offer-
ed totthe prospective, purchaser of -Lot No..2 at .a nominal -amount,
and that the purchaser will bind himself to purchase the land.

2. Albertsworth E F (229-62) 2 lots. Engr. Charles Coburn.
Due to inadequacy of the Map and non-conformance with the provisions
of the Subdivision Ordinance, the following action was taken.
ACTION:
That the Tentative Map of E. F. Albertsworth (229-62) 2 lots
be returned to the Engineer for a more adequate map.
MOTION: Mellquist; SECOND: Hibner; VOTE: Passed unanimously
USE PERMITS:
Retarded Childrens' Guild (UP -111-62) - Request for Use Permit for
School for Retarded hildren.
Mrs. B. Harris and Mr. H. Littig, of the Retarded Childrens' Guild
were present. Mrs. Harris commented briefly on the purpose of the
organization.

Mr. Wm. Powell. Realtor, presented and explained the Plans for estab-
low lishing a day care center on the Leslie F. Shupe property at 26744
Arastradero Rd. Gross acreage of the property is 3.073 acres. He ex-
plained that the Retarded22Chi]drens' Guild is a non-profit organization.
Mr. Powell and Mrs. Harris ansdered questions relative to the number
of children to attend, parking and traffic problems, and planned use
of the property.
Mr. Hart H. Tantau, 27072 Old Trace Rd., commented relative to removal
of land from the Town's Tax Roll, and suggested that the amount set
aside by the General Plan be considered before approving use for more
tax-free organizations.
Mr. Gus Christianson, 27161 Fremont Rd., stated his objections to the
approval of the Use Permit, onrthe grounds that a school would create
additional traffic on an already hazardous intersection and also to a
use other than residential.
Comments were heard in favor of granting the permit from Mrs. Leslie F.
Shupe, Mrs. Margaret Best, Mrs. Alex Berger, and Mrs. Sittig.
The suggestion was made that a joint meeting of the Planning Commission
and City Council be held to determire a policy with regard to removal
of land from the Tax Roll. Deputy Clerk, C. J. Smith, was asked to
determine the percentage of tax-;kempt land in the Town at the present
time.
RECOMMENDATION:
That the recommendation on the Use Permit of the Retarded Child -
rens' Guild (U'P-111-62) be tabled until a joint meeting is held
with the Council to gain guidance as to limitation of tax-free
properties within the Town.
MOTION: Alter; SECOTTD: Garbett; VOTE: Passed unanimously
The meeting of the Council and Planning Commission will be held Satur-
day, June 16, 1962 at 10:00 A. M. at the Town Hall.
The suggestion was made that the matter of approval or disapproval of
building sites when an inadequate water supply exists be discussed at
the June 16« meeting.
COMMUNICATIONS:
1. City Manager - Letter, dated June 7, 1962, stated the Council's request
for the Planning Commission to consider amending Ordinance No. 78 with
regard to changing 'Home Occupation' from a Permitted Use to a Condi-
tional Use.
Deferred to discussion at the Meeting with the Council on June IGO.
MEETING ADJOURNED: 10:20 P. M.
