Staff Report to the Planning Commission
RE: REQUEST FOR PRE-ZONING OF A 1.22 ACRE PARCEL WITHIN SANTA
CLARA COUNTY TO BE ANNEXED INTO THE TOWN; LANDS OF
LOUGHMILLER; 25309 LA LOMA DRIVE; FILE#89-97-ZP-SD-GD.

RECOMMENDATION That the Planning Commission:
Forward the request to pre-zone the property R-A (residential-agricultural) to the City
Council with a recommendation for approval.
CODE REQUIREMENTS
As required by the Local Agency Formation Commission (LAFCO) the Loughmiller
property must be pre-zoned prior to its being annexed into the Town of Los Altos Hills.
The Planning Commission's recommendation will be forwarded to the City Council for
final action.
BACKGROUND
The Planning Commission approved a site development permit for a new residence and
variances to allow grading over a property line and the maximum development area to be
exceeded on December 10, 1997. The Commission forwarded the application to the City
Council with a recommendation for approval of a related parcel merger and annexation of
the portion of the property that is presently within Santa Clara County. The City Council
considered the application on January 7, 1998, and approved the parcel merger and
annexation. Staff has prepared the application for annexation and the urban service area
amendment to be submitted to LAFCO by February 18, 1998.
DISCUSSION
The property consists of two contiguous parcels, one in the Town and one in Santa Clara
County (the County parcel was previously two lots that were merged in May 1996). The
property within the County will be annexed into the Town and the Urban service Area
will be amended to include the land. Following annexation, the two lots will be merged
and building permits can be issued for construction of the new residence. Prior to
annexation, the County parcel must be pre-zoned. Staff is recommending that the
property be designated R-A,residential agricultural. This is the zoning designation for all
surrounding properties other than permanent open space. It is also the current zoning
designation for the .50 acre lot that is within the urban service area and Town limits, and
which will be merged with the County parcel. Approval of the pre-zoning is necessary
before the urban service area can be amended and the property annexed. Once these two
actions are completed the two parcels can be merged.
ENVIRONMENTAL REVIEW
Staff has determined that the annexation and related urban service area amendment is
categorically exempt from the California Environmental Quality Act (CEQA) in

accordance with Section 15319(b) for annexations of individual small parcels of the
minimum size for facilities exempted by Section 15303. The approved single family
residence is exempt from CEQA under Section 15303(a). The Santa Clara County
Planning Department concurs with this assessment. An environmental information form
has been completed for submittal to the County with the annexation application.
Staff is available to answer any questions from the Commission or any member of the
community.
