RECOMMENDATION That the Planning Commission:
Approve the grading and drainage plan, subject to the recommended conditions in
Attachment 1.
CODE REQUIREMENTS
As required by Section 10-2.301 of the Site Development Ordinance, this application has
been forwarded to the Planning Commission for review since the proposed grading is
more than 1,000 cubic yards and would cover an area larger than 10,000 square feet.
BACKGROUND
On December 10, 1997 the Planning Commission forwarded a tentative map for a two lot
subdivision of the subject property to the City Council with. a recommendation for
approval. The City Council approved the tentative map on January 21, 1998. The
applicant has since sold the property and will be developing one single-family residence
for the new owner. The new owner does not wish to split the property and the
subdivision application has been dropped. Plans for the new residence are presently
being worked on although a submittal is not anticipated in the immediate future.
DISCUSSION
The applicant is requesting approval of a grading and drainage plan. The existing creek
channel is to be excavated and the dirt spread on the site along with the excavation
material from the drainage pipe installation on the adjacent Silvestri property. There was
discussion on drainage improvements and grading when the Planning Commission
considered the tentative map. The Commission and Council in approving the map agreed
that the excavation for the creek channel could be spread on the site at a depth up to two
feet. However, the drainage improvements and grading were considered part of the
subdivision improvements. Since the subdivision is not moving forward and the property
will remain as one lot, the proposed grading and drainage plan needs to be re-approved.
Typically grading and drainage improvements are done when a property is developed.
However, the channel excavation is part of a Town Capital Improvement project that will
be done to correct drainage problems in the La Paloma Basin. The applicant is working
with the Town to complete the drainage improvements on the subject property in
conjunction with the development of the Silvestri property and the work to be done by the
Town. Staff supports the on-site work being done at this time since it will facilitate the
drainage improvement project and the Town will be able to follow the grading work with
the lining of the channel. The entire drainage improvement project is to be completed
before next Winter.

As noted on the plans there are a number of trees to be removed. The Redwoods in the
northwest corner of the property and several other trees along Fremont Road will be
saved as will a Pine located midway into the site near the channel. The trees to be
include seven pines and four apricot and one palm.
The conditions of approval would limit the fill to a maximum depth of two feet at any
point on the lot. No grading would be done within 10 feet of any property line, or in the
vicinity of the redwood trees. It is anticipated that the new residence will be limited to a
height of 23 feet above the finished grade proposed with this grading and drainage plan.
Staff is available to answer any questions from the Commission or any member of the
community.

RECOMMENDED CONDITIONS OF APPROVAL FOR GRADING&
DRAINAGE PLAN

1. The depth of fill shall not exceed two feet at any point on the property. The
height of the new residence to be built on the property shall be measured from the
finished grade or the building pad, whichever is lower.
2. The fill shall to be placed on the site shall be at a density of no less than 90%, and
shall be certified by soils engineer prior to final inspection. No fill may be
imported to the site other than the excavation from the Town storm drain project
on the Silvestri property (13935 La Paloma Road).
3. No grading shall take place during the grading moratorium (November 1 to April
1) unless otherwise approved by the City Engineer. No grading shall be done
within ten feet of any property line.
4. No grading is allowed within the driplines of the redwood trees located in the
northwest corner of the property. The trees on the site shall be fenced at the
dripline, prior to commencement of any grading or construction. The fencing
shall be of a material and structure to clearly delineate the dripline. Town staff
must inspect and approve the fencing prior to issuance of any building permits.
The fencing must remain throughout the course of construction. No storage of
equipment, vehicles or debris shall be allowed within the dripline of the fenced
trees.
5. A grading permit shall be issued by the Building Department prior to
commencement of any work.
