C FROM: Suzanne Davis, Planner SD APPROVED BY: Curtis Williams, Planning Direca, RECOMMENDATION That the Planning Commission: Recommend approval of the lot line adjustment to the City Council, subject to the applicant's submittal of grant deeds and plats prepared by a registered engineer or licensed surveyor prior to the Town's recordation of certificates of compliance. DISCUSSION The subject properties were created as part of a two lot subdivision that was recorded in 1987 (Lands of Bettencourt, Parcel Map 574-M-34). At the time the properties were developed, some hardscape improvements were inadvertently constructed across the common property line between the two lots. The Chambers granted an easement to the developer since part of the driveway serving the house at 12051 Stonebrook (now Lands of Hill) encroached onto their property. The applicants are now proposing a lot line adjustment between their properties so that some existing improvements including part of the driveway and a brick planter, will be on the Hill property rather than the Chambers'. Both properties are already developed in excess of the allowable floor and development area numbers. Equivalent land areas will be exchanged so that the resultant lots will remain the same size as those existing. The LUF, MDA and MFA numbers will change slightly due to differences in slope, but the degree of nonconformity will not increase on either property as a result of the lot line adjustment. Because the existing access easement will be abandoned the numbers on both properties will improve, although the existing development would still exceed the allowable figures. Planning Commission May 27, 1998 Lands of Chambers&Hill Page 2 Code Requirements Review authority for lot line adjustments is outlined in Section 66412(d) of the State's Subdivision Map Act, which states that: "A local agency shall limit its review and approval to a determination of whether or not the parcels resulting from the lot line adjustment will conform to local zoning and building ordinances. A local agency shall not impose conditions or exactions on its approval of a lot line adjustment except to conform to local zoning and building ordinances... " The Town's Codes do not address lot line adjustments, but the standard Town process includes a public hearing before the Planning Commission, and Council consideration as a New Business item. After approval, the lot line adjustment is effectuated by the recordation of a grant deed and a certificate of compliance. Analysis Both lots are presently developed with residences, and are accessed from separate driveways off Stonebrook Drive. The existing improvements that cross the property line have been in place since 1991 when the Hill property was developed. Both properties are developed in excess of the allowable MFA and MDA. If either property were to be redeveloped, the existing level of development would be recognized as being a legal nonconforming situation. Although all other dimensional criteria of the Zoning Ordinance would be required to be met, the established floor and development area on both sites would be the maximums allowed. The actual level of development and the degree of nonconformity with the existing and proposed lots is as follows (numbers all reflect square footage): Existing Degree of Existing' Degree of Dev. However, as there would be a slight increase in the net lot area and the LUF after the lot line adjustment, and the degree of nonconformity would not increase, staff believes that the lot line adjustment would be consistent with provisions of the Zoning Code to allow use of existing non-conforming lots. No non-conforming setbacks would be created by the lot line adjustment and there would still be 160 foot building circles on both sites. All existing easements on both lots will remain other than the access easement on the Chambers property which would be abandoned. Because the entire driveway would be on the Hill property with thelot line change, the access easement would no longer be needed. Access easements are removed from the lot area for purposes of slope density calculations. The removal of the access easement is the impetus for the increase in the Planning Commission May 27, 1998 Lands of Chambers&Hill Page 3 Chambers net lot area, and the slight increase in the LUF and allowable floor and development area for both lots. CONCLUSION The proposed lot line adjustment will result in lots which remain consistent with the Town's Zoning Code, given the existing non-conforming size of the lots, and other zoning, site development and building requirements would be applied to any future development. Upon approval, the applicant must submit to the Town a copy of the signed and notarized grant deeds, with plats, as prepared by a registered civil engineer or licensed surveyor, and the Town will prepare certificates of compliance for recordation.
