Approve the requested Site Development Permit and Variance subject to the attached findings and conditions of approval; OR 2. Deny the requested Site Development Permit and Variance, and direct the applicant to modify the structures to comply with the Code, not later than by July 15, 1998. BACKGROUND • The subject property is located on the south side of Stonebrook Drive, at the end of the road beyond the entrance to the Quarry Hills Subdivision. There is a 20 foot right of way width for the access easement off of Stonebrook Drive at the north side of the panhandle and an overlapping 20 foot wide Public Utility Easement. The right of way is half of the 40 foot wide Stonebrook Drive right of way between this lot and the Quarry Hills property. This property was annexed to the Town simultaneous with the annexation of Quarry Hills, effective October 3, 1996. The applicants have indicated that they were proceeding under County rules and were not notified of the finalization of the annexation. No County permits were obtained for the construction, however. CODE REQUIREMENTS According to Section 10-2.301 of the Site Development Code, any structures within the front setback of 40 feet from access easements are limited to 6 feet in height. Generally, structures would be reviewed for height, color and lighting conformance with the Code. The evaluation of the Variance should include many of the same items, concurrently evaluating the physical site conditions which result in an undue hardship on the property. The approval of a Variance also requires that certain findings be approved by the Planning Commission. Staff has prepared findings for approval (see Attachment #2) for the Commission's review. DISCUSSION The applicant requests approval of a Site Development Permit and a Variance for the, existing entryway and an 8 foot gate which has not been constructed. The entryway was brought to the Town's attention as a code complaint in late 1997, by a neighboring property owner. Planning Commission Lands of Gorham and Shuler May 27, 1998 Page 2 The maximum height of the entryway is 16 feet to the top of the arch. The height of the entry would comply with the Fire Department's requirement for vertical clearance of 131/2 feet and the width would meet the Fire Department's requirement for a 14 foot clear width, as the pillars are spaced 151/2 feet apart. The existing pillars are painted white to match the wall and residence. There are existing oaks along the southwest property line which partially screen the structure. The applicant has planted several vines and bushes which will help to screen the entryway from neighboring properties and from distant views. Staff recommends that, if the variance is approved, the color of the entryway pillars be changed to match the wood arch and meet the Town's colorboard to reduce the visibility of the structure (condition 4). Staff has also included a condition of approval (#3) requiring that the applicant submit a landscape deposit for the planting which has been planted to screen the structure. The deposit would be returned 2 years after the approval of the project to ensure that the planting has been maintained. The proposed gate is shown with an 8 foot height, which also requires a Variance, as fences located within the setback may not exceed 6 feet in height. Staff recommends that the applicant redesign the size of the gate to meet the 6 foot limit (condition#1). Lighting As shown on sheet 1 of the plans, 4 lights have been designed as part of the entryway. Staff has included a condition requiring that the lighting be reduced to 2 fixtures to meet Code requirement 10-1.505(a) (condition#5). Variance The applicant began the project prior to the property's incorporation into the Town. The applicant has outlined the circumstances which led them to believe that the property was still in the County (see Attachment #3). The applicant has provided receipts for the material for the project which date prior to the annexation. In addition, the applicant has indicated that they located the gate at a distance from the property line which would meet the County's requirements, although the necessary permits were not obtained through the County prior to construction (letter from the County is attached#4). Pursuant to Section 10-1.1107(2)(b) the Planning Commission must make four findings in order to approve a Variance. First, the Commission must find that there are physical circumstances on the lot which create a practical hardship for the applicant to comply with the provisions of the Code. In this case, the location of the structure was placed at a distance from the property line which would have met the County's gate requirements, as the applicant did not receive specific notification that the annexation had been completed. In addition, there is a 20 foot wide private right of way located along the first 20 feet of the panhandle, with the entryway located an additional 20 feet from the property line. Second, the Commission must find that granting the Variance will maintain the intent and purpose of the Zoning Code and will not provide special privileges to the applicant. The proposed entryway with a gate is a use that numerous property owners in the Town as well as in the immediate vicinity enjoy. The structure would meet the Code if it were located an additional 20 feet from the property line, 40 feet from the edge of a private right of way. Planning Commission Lands of Gorham and Shuler May 27, 1998 Page 3 Third, the approval of the Variance would not be materially detrimental or injurious to the neighboring property owners, as the structure in the setback would be located an adequate distance from the neighbors, and if painted as recommended, would not be visually obtrusive. Lastly, the proposed addition would not permit a use that is not authorized by the Zoning Code, as the entryway and gate maintain the residential use of the property. Staff has prepared findings for approval, included as attachment#2. If the Commission cannot affirm anyone or more of the findings, the variance should be denied. If denied, staff suggests allowing approximately 45 days for the applicants to bring the project into compliance. Staff is available to answer any questions that the Commission or community may have. PLANNING DEPARTMENT: 1. The applicant shall redesign the gate to limit the height to 6 feet. Any further modifications to the approved plans requires prior approval of the Planning Director or Planning Commission depending upon the scope of the changes. 2. Staff will visit the site prior to final inspection to determine if any additional plantings will be needed to screen the additions, to replace damaged trees, or to restore areas disturbed by grading or construction. 3. A landscape maintenance deposit (or certificate of deposit), equal to the cost of materials and installation for all landscaping required for screening purposes (including the vines and shrubs which have already been planted and any additional screening required by the Town) or for erosion control (as determined by the City Engineer), but not to exceed $5,000.00, shall be posted prior to final inspection. An inspection of the landscape to ensure adequate establishment and maintenance shall be made two years after installation. The deposit will be released at that time if the plantings remain viable. 4. The paint color of the entryway pillars shall be chosen by the applicant to approximate the wood arch and approved by staff in conformance with the Town's adopted color board, and shall exhibit a light reflectivity value of 50 or less. A color sample shall be submitted to the Planning Department for approval prior to acceptance of plans for building plan check for the gate. All applicable structures shall be painted in conformance with the approved color(s)prior to final inspection. 5. The lighting within the pillars shall be reduced to one fixture on each pillar. Lighting shall be low wattage. B. ENGINEERING DEPARTMENT: 6. Any revisions or additions to the existing grading and drainage shall be submitted by the project engineer for review by the Engineering Department, including any plans to regrade and repave the driveway. The plan shall be reviewed by the Engineering Department and approved prior to commencement of the project. 7. No grading shall take place during the grading moratorium between November 1 and April 1 except with prior approval from the City Engineer. No grading shall take place within ten feet of any property line. Planning Commission ' Lands of Gorham and Shuler May 27, 1998 Page 5 8. If any trees or large shrubs are proposed to be planted within the right of way or public utility easements, a letter shall be required to be submitted which has been stamped and signed by a registered civil engineer verifying that the proposed plantings, when mature, will not conflict with any existing public utilities that are located either underground or overhead and will not negatively impact the available sight distance for traffic on the adjacent roadways or block existing pathways or roadways. The letter shall be required to be submitted to the Engineering Department prior to final project approval and prior to commencement of planting. Upon completion of construction, a final inspection shall be set with the Planning Department and Engineering Department at least two weeks prior to final building inspection approval. CONDITION NUMBERS 1 AND 4 SHALL BE COMPLETED AND SIGNED OFF BY THE PLANNING DIRECTOR AND THE CITY ENGINEER PRIOR TO ACCEPTANCE OF CONSTRUCTION PLANS FOR PLAN CHECK BY THE BUILDING DEPARTMENT. NOTE: The Site Development permit is valid for one year from the approval date (until May 27, 1999). All required building permits must be obtained within that year and work on items not requiring a building permit shall be commenced within one year and completed within two years. • Planning Commission Lands of Gorham and Shuler May 27, 1998 Page 6 ATTACHMENT 2 RECOMMENDED FINDINGS FOR VARIANCE LANDS OF GORHAM AND SHULER, 15829 STONEBROOK DRIVE FILE#75-98-ZP-SD-VAR 1. That, because of exceptional or extraordinary circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the provisions of this Title is found to deprive such property of privileges enjoyed by other properties in the vicinity and under identical zoning classification; The project commenced prior to the property being annexed into the Town limits. The applicant did comply with the County requirements, although no permits were obtained from the County. The entryway is located 40 feet from the property line and roadway and at the end of a private right of way. The right of way comprises the old Stonebrook Drive which will become a private drive to serve 3 residences from the new Quarry Hills subdivision cul de sac. With mitigating screening, the structure will not be highly visible from offsite. 2. That upon the granting of the Variance, the intent and purpose of the applicable sections of this Title will still be served and the recipient of the Variance will not be granted special privileges not enjoyed by surrounding property owners; The entryway and gate are uses which are allowed by the Code and which numerous other properties within the Town and immediate vicinity enjoy. The intent and purpose of the code addressing height within the setbacks will be served, as the structure will be screened with planting and painted to mitigate the visibility from offsite. 3. That the granting of such Variance will not be materially detrimental to the public welfare or injurious to the property, improvements or uses within the immediate vicinity and within the same zoning district; The project would not alter the parking situation and would not impact neighbors by encroaching on the setbacks as there is adequate distance from the project location to neighboring residences. The private access road will provide access only to the applicant and 2 other neighbors. 4. That the Variance will not authorize a use or activity which is not otherwise expressly authorized by the zoning district regulations governing the parcel of property. The existing entryway and proposed gate is authorized by the Code and would be consistent with the continuing residential use of the site. • l T-- F�, ATTACHMENT .s PAGE1 FROM: Nat, Jan and Skate Gorham 15829 Stonebrook Dr. Los Altos Hills, CA 94022 (650) 917-0362 TO: Planning Commission and Staff Town of Los Altos Hills' RE: 1998 MINOR VARIANCE APPEAL FRONT GATE Dear Planning Commissioners and Staff, In the discussions with Staff which led to this minor variance request, it was determined that the relevant issue involving our entrance gate was setback. Therefore, we ask that you consider the following as you review the enclosed findings. 1) When work on the gate began, our property was still part of the County of Santa Clara, and the gate was designed and constructed to conform with County setback requirements. Since that time, our property was annexed by the Town of Los Altos Hills as part of the Quarry Hills master development plan. In our recentmeetings with Staff, it was explained that notification of the annexation was included in one of the Public Hearing announcements regarding the Vidovich project— but we've received literally hundreds of notices on this topic over the past decade or so, and honestly never saw this one. Since no certified, "signature-required" notification of our annexation was sent out, we naturally thought that our property was still in Santa Clara County. For an entrance gate higher than eight feet, the County requires a 30-foot setback to the property line; our gate; with its 40-foot setback, exceeds that distance. 2) We now understand that our gate conforms with the Town of Los Altos Hills' requirement of a setback of 40 feet from the property line, but additionally, the Town requires a 40-foot setback from any public easement. With the Town's approval of the Quarry Hills development, the public road (Stonebrook Drive, which currently dead-ends at the beginning of our driveway)will be completely re-routed to end in a cul-de-sac, more than 60 feet from our from our property; access to our lot will be via private driveway, and our gate is setback 40 feet from the private driveway. 3) We strongly believe that a personal visit to the site is extremely helpful, and we'd be more than happy to arrange a time, at your convenience, when we can meet with you. Most people think our property line is where the white wall ends, but that's not true. The stakes which mark our property line lie in the middle of the dirt road, a distance of 40 feet from our gate; likewise, the closest edge of the new private driveway will be 40 feet from our gate. The old ramshackle house • • PAGE2 on the property next to ours, set in an oak grove, will be torn down by the beginning of May, and the cul-de-sac where Stonebrook Drive turns around will be located there, some 60-plus feet from our gate. The power pole that you see at the end of our wall will be replaced by underground utilities on the far side of the new private driveway, some 60 feet from our gate. Additionally, the elevation of the private driveway will be more than a foot above the existing grade of the dirt road. These physical changes have a huge impact on this minor variance request— to the point where we thought that perhaps this variance procedure should be postponed until the road and utility improvements for Quarry Hills have been completed, so the Planning Commission and Staff could see, firsthand, how the findings for granting this variance are supported. If it was suggested to us that this course of action would be wiser, we'd probably follow that advice. However, the personal reason we don't wish to wait for a decision involves our family's security—we had a frightening incident out here with an unwelcome nighttime visitor, and we want to get the gate up and functional as soon as possible. FINDINGS 1) EXCEPTIONAL AND EXTRAORDINARY CIRCUMSTANCES APPLICABLE TO THE SUBJECT PROPERTY Since the 1800s, our property has been part of the County of Santa Clara, and we've been homeowners at this location for more than 20 years. (Indeed, an extremely time-consuming and expensive part of that 20-year history involves a very minor lot line adjustment we did just a few years ago with LAFCO and the Town of Los Altos Hills to exchange a small portion of property with a neighbor — he being in the Town of Los Altos Hills, and we, in the County.) In recent years, our peaceful co-existence with the local rattlesnakes, deer, coyotes, and poison oak in this relatively undeveloped part of the world began tochange dramatically. With the Town's approval to build the many new ridge-line and hillside developments we now see from our home (Lohr, Emerald Hills, Finn Lane, and others), a surprisingly large number of "lost" vehicles began driving up the long, 400-plus foot driveway of our flagship lot. These lost souls thought our driveway was a continuation of Stonebrook Drive which (until it is re-routed for the Quarry Hills development), dead-ends at the entrance to our property. These lost folks ranged from pleasant delivery people (consulting their Thomas Brothers maps — the. bible of the delivery trade — which show Stonebrook Drive going through to Magdalena), to an abundance of real estate agents, noisy motorcycle riders, curious construction workers, young beer-drinking, trash-depositing joyriders, and some outright dangerous folks who were just looking for a secluded spot to discharge their firearms. After one particularly scary incident in 1994, late at night (the Los Altos police wouldn't r t • PAGE 3 FINDINGS continued respond because it was out of their jurisdiction, and it took the County Sheriff two hours to find our house), we decided that more than privacy had been shattered by the rapidly increasing traffic pattern; the family's security was at stake. Work on the gate began immediately — long before our property was annexed by the Town of Los Altos Hills, as invoices and..purchase receipts provided to Staff indicate — and the gate was designed to exceed the County of Santa Clara's setback requirements. Had the traffic patterns not changed to the degree they did, likely we never would have expended the time, money and effort. However, while waiting...waiting...and still waiting for the Quarry Hills development to re-route Stonebrook traffic some distance from our driveway in a cul-de-sac, we needed an immediate remedy to insure our family's safety. 2) INTENT AND PURPOSE OF ORDINANCE IS MAINTAINED EVEN AFTER SPECIFIC MINOR VARIANCE IS GRANTED. In granting this minor variance, the integrity of the ordinance would be maintained because our situation is truly unique: We were residents of the County of Santa Clara, NOT-the Town of Los Altos Hills, when work on our gate began, and our 40-foot setback from the property line exceeds the County's requirement of 30 feet from the property line. This distance conforms with the Town of Los Altos Hill's setback requirement of 40 feet from the property line, but additionally (unlike Santa Clara County and most other municipal entities) the Town also requires a 40-foot setback from any public easement. Again, the uniqueness of our situation applies in granting this variance. The public road — Stonebrook Drive — will soon be replaced by'a PRIVATE DRIVEWAY at the end of our driveway, and an existing power pole (and corresponding 20-foot utility easement) will be replaced by underground utilities located on the opposite side of the private driveway (please review the approved Quarry Hills maps in the enclosed materials.) As approved by the Town, these forthcoming development changes will leave our entrance gate more than 60 feet from the public road and 40 feet from the private driveway which replaces the small part of Stonebrook Drive which currently fronts our driveway, thus leaving the ordinance's intent of setback well-maintained. 3) NOT DETRIMENTAL TO THE PUBLIC WELFARE NOR INJURIOUS TO THE PROPERTY The gate meets the minimum height requirements and allows safe ingress/egress for all vehicles on public roads. (This was, of course, the factor which dictated the minimum height of the pilasters and beam.) Please note that the current road grade is several feet LOWER than the final grade of the soon-to-be completed Quarry Hills private driveway; and when. finished, the new grade will reduce the height of the gate, both physically and visually. Additionally, the gate is set in a grove of young oak trees which already tower over the top of the beam (please see the enclosed photos). As these trees continue to grow PAGE4 FINDINGS continued and mature, they will create an even more dense and elegant canopy over the gate. The wooden beam itself has been left natural, finished only with many coats of spar varnish. ' Vigorous, quick-growing, deer-resistant evergreen flowering vines have already been planted, and these are now beginning to cover the pilasters with an abundance of vegetation, further helping to blend the gate with its natural surroundings. Beautiful antique wrought iron gates — rather than the prevalently used spiked iron fencing — and Spanish-style white stucco pilasters and walls — instead of the not-too-attractive chain-link fencing.— complete the "old world" design. We sincerely invite Planning Commissioners and Staff to come and see our gate, and review on site how the future development of the adjoining Quarry Hills project will mitigate the setback issue, and support these findings for granting this minor variance. 4) VARIANCE WILL NOT ALLOW A USE OR ACTIVITY NOT EXPRESSLY AUTHORIZED BY THE ZONING ORDINANCE. Granting this minor variance does not allow a use or activity not expressly authorized by the -. zoning ordinance because of the exceptional situation which applies to our property alone: We were residents of Santa Clara County when work on the gate began, long before our property was annexed by the Town of Los Altos Hills. Moreover, our gate exceeds the County's setback requirements. We believe that the "grandfather" clause was created for this type of situation, to protect not only the homeowner, but the integrity of the Town's ordinances as well. • IN CONCLUSION It has always been our goal to make this home and property stand the test of time, and blend beautifully with its surroundings — whether in Santa Clara County or the Town of Los Altos Hills — a fact which we hope a personal visit will corroborate. In the big picture, and with much thought and painstaking effort, we have tried to create a residence that will forever make the Town and the owners proud. We hope this history and explanation aid the Planning Commission in granting us this minor variance. Again, we invite you to personally inspect the gate, the landscaping, and the setting under a beautiful oak tree canopy which is literally hundreds of feet below the dozens of new ridge-line homes that are now part of our view (a change indeed, but one we're realistic enough to accept). We believe it helps to see in person howthese findings relate to our unique situation, and support our minor variance request. The gate shown on the drawing includes an arched beam 14 to 15 feet above finished grade. Two supporting walls approximately 4 feet wide support the beam, along with an 8-foot high gate that apparently would part in the middle and swing open, or may slide open. This structure would have required both Design Review from the County Zoning Administrator, and, if approved, a building permit from the County Building Inspection Office. The design review process would involve a public hearing, and would check for compliance with health and safety features required by the Fire Marshal as well as the esthetics of the design. We wanted to be here to meet each of you, but our son is playing in a youth basketball tournament held in Reno over the Memorial Day weekend, and Dad is the head coach. We encourage you all to please come again or call any time (917-0362) if we can answer any additional questions you may have. Now...specifics: 1) Please step up on the little box at the end of our driveway. That will be (approximately) the finished grade of the new private driveway which will replace the old public road. 2) Visually connect the dark pencil marks on the inside of each pilaster (about 4 inches above the existing grade) with the-top of the box you are standing on. There is a 2% slope from our driveway at the gate to the new finish grade of the • private driveway (not public road) that willconnect us with the new public road which ends in a cul=de-sac, just beyond the oak grove you see to your left (about 75 feet from the gate). 3) A grading stake has been placed to mark the radius of that cul-de-sac (public road) if you wish to see it, but please be careful for poison oak and rattlesnakes (seriously!). 4) Please note that it is the intention of the Quarry Hills developer to leave all of the oak trees standing. Although they're still young, they already tower over the gate, and will only grow to form a more lovely canopy over the beam and gate. • 5) We have planted an abundance of hardy, quick-growing, deer-resistant flow- ering evergreen vines (solanum jasminoides [potato vine] and gelsemium sem- pervirens [Carolina jessamine]) which grow to 20 feet high; shortly these will completely cover both the pilasters and the wooden beam, for a truly natural, old California look. These varieties thrive out here — we have some in the back of our house which grow as fast as we can tie them up. Moreover, everything is on an automatic sprinkler system, to keep it green and growing year round. Page Two • 7) We've chosen to completely hide the pilasters and beam by planting ever- green vines. The white stucco matches the color of our home and existing walls, and while we firmly believe that it will soon be hidden by the.greenery of the vines and shrubs, we'd be more than willing to include the following as a condition for granting the variance: If both the beam and pilasters have not been completely obscured by the climbing evergreen vines one year from now, we will paint the pilasters an acceptable color. 8) The setback of the gate from the new private driveway is 40 feet. The set • - back from the new public road cul-de-sac, scheduled to be completed this sum- mer, greatly exceeds that distance. 9) The 14-foot elevation from the bottom of the beam to the finish grade of our driveway at the edge of the pilasters is the necessary minimum clearance required for any emergency vehicles. Again, the flowering vines will soon be all you see of the pilasters and walls. 10) The old wrought iron that will be used in the gates themselves has been carefully restored from a 75-year-old fence formerly owned by Marion Davies. Please refer to the drawing which shows the lovely pattern — not the spike and dagger points seen so often in modern gate construction. 11) We have the support of our immediate neighbors (with one exception who has his own agenda). 12) In our 21-plus years at this residence, we feel we have created a home that truly fits in with old Los Altos Hills and its natural surroundings. Merely turn around on this box and look at some of the new ridge-line homes which now dominate our view to the Bay for examples of development without an overrid- ing desire to blend. We also encourage you to walk up our driveway toward the house a hundred feet or so, to observe the gate from a different,perspective.
